AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM APPROVING SPECIFIC PLAN ADJUSTMENT
NO. 7 TO THE NORTHEAST AREA SPECIFIC PLAN NO.
94-1, AMENDING ORDINANCE NO. 5517, AS
PREVIOUSLY AMENDED, AND AMENDING VARIOUS
SECTIONS OF CHAPTER 18.110 OF TITLE 18 OF THE
ANAHEIM MUNICIPAL CODE RELATING TO FREEWAY
ORIENTED SIGNS.
WHEREAS, pursuant to the procedures set forth in Chapter
18.93 of the Anaheim Municipal Code, on September 12, 1995, the
City Council of the City of Anaheim adopted Ordinance No. 5518
amending the zoning map to reclassify certain real property
described therein into the Northeast Area Specific Plan Zone
subject to certain conditions as specified therein, and Ordinance
No. 5517 relating to the establishment of Zoning and Development
Standards for the Northeast Area Specific Plan No. 94-1 by the
addition of Chapter 18.110 to said Code; and
WHEREAS, in connection with adoption of Specific Plan No.
94-1 (Northeast Area), the City Council certified EIR No. 317
with the Statement of Overriding Considerations finding that the
Northeast Area Specific Plan incorporates measures to mitigate or
avoid significant impacts on the environment and will itself act
as effective mitigation for potential environmental impacts
identified in Environmental Impact Report No. 317; and,
WHEREAS, on June 4, 1996, the City Council adopted Ordinance
No. 5563 amending Ordinance No. 5517 relating to the Northeast
Area Specific Plan No. 94-1, which amendment added a provision
permitting service stations as a conditional use in Development
Area 4 (Transit Core) ("Adjustment No. 1"); and
WHEREAS, on June 4, 1996, the City Council adopted Ordinance
No. 5564 amending Ordinance No. 5517, Northeast Area Specific
Plan No. 94-1, relating to automotive vehicle repair as a
conditional use in Development Area 4 (Transit Core) ("Adjustment
No. 2"); and
WHEREAS, on June 11, 1996, the City Council adopted
Ordinance No. 5565 amending various Chapters of Title 18
including Chapter 18.110 amending Ordinance No. 5517, the
Northeast Area Specific Plan No. 94-1, relating to eating and
drinking establishments ("Adjustment No. 3"); and,
WHEREAS, on August 20, 1996, the City Council adopted
Ordinance No. 5574 amending Ordinance No. 5517, Northeast Area
Specific Plan No. 94-1, related to deleting a time limitation for
churches ("Adjustment No. 4"); and
WHEREAS, on January 11, 2000, the City Council adopted
Ordinance No. 5714 amending Ordinance No. 5517, Northeast Area
Specific Plan No. 94-1, related to self-service laundries
("Adjustment No. 5") , and
WHEREAS, on April 18, 2000, the City Council adopted
Ordinance No. 5728 amending Ordinance No. 5517, Northeast Area
Specific Plan No. 94-1, to amend the boundaries of Development
Area 5 (Commercial Area) and Development Area 2 (Expanded
Industrial) at the northwest corner of La Palma Avenue and
Hancock Street ("Amendment No. 1"), and
WHEREAS, on April , 2001, the City Council adopted
Ordinance No. amending Ordinance No. 5517, Northeast Area
Specific Plan No. 94-1, related to asphalt and concrete
processing by conditional use permit in Development Area 6 (Open
Space) ("Adjustment No. 6" SPN Tracking No. 2001-00002), and
WHEREAS, the proposed adjustment requests amendment of the
requirements for freeway oriented signs ("Adjustment No. 7" SPN
Tracking No. 2001-00003, hereafter "Adjustment No. 7); and
WHEREAS, on March 26, 2001, the Anaheim City Planning
Commission considered and approved the proposed Adjustment No. 7
and recommended to the City Council that it adopt an ordinance
incorporating said proposed Adjustment; and
WHEREAS, pursuant to the provisions of the California
Environmental Quality Act ("CEQA"), the City Council has
determined that the project is categorically exempt from CEQA
under CEQA Guidelines Section 15061 (b) (3), which provides that
where it can be seen with certainty that there is no possibility
that the activity in question may have a significant effect on
the environment, the activity is not subject to CEQA.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES
ORDAIN THAT ADJUSTMENT NO. 7 BE, AND THE SAME IS HEREBY,
APPROVED, AND ORDINANCE NO. 5517 BE, AND THE SAME IS HEREBY,
AMENDED TO REVISE THE ZONING AND DEVELOPMENT STANDARDS IN CHAPTER
18.110 OF THE ANAHEIM MUNICIPAL CODE AS FOLLOWS:
I
SECTION 1.
That subsection .140 of Section 18.110.050 of Chapter 18.110
of Title 18 of the Anaheim Municipal Code be, and the same is
hereby, amended to read as follows:
".140 Freestanding Freeway Oriented Signs: Freestanding
freeway oriented on-site identification signs, limited to parcels
adjacent to the north and south sides of the Riverside (SR -91)
Freeway or associated freeway frontage roads between the Santa
Ana Riverbed and the Orange (57) Freeway, shall be permitted in
this Development Area subject to a conditional use permit and
further subject to the following requirements:
".1401 Freestanding freeway oriented identification signs
shall be permitted only for (i) service stations,
restaurants, lodging facilities and regional shopping
centers as defined in Section 18.05.020.032 of this Chapter
and (ii) vehicle sales agencies and lots occupying a minimum
lot area of three (3) acres, and having a freeway frontage
of no less than three hundred (300) linear feet.
.1402 The height, location and sign copy shall be designed
in a manner which permits identification from adjacent
freeways.
.1403 There shall be no more than one freestanding freeway
oriented sign per parcel.
.1404 The sign shall be limited to identifying only
eligible business(es) occupying the site.
.1405 The sign shall be located in the landscape setback
area, perpendicular to the freeway and shall be located
approximately midway between side property lines within the
middle twenty percent (200) of the property frontage.
Landscaping shall include shrubs planted at the base of the
sign supports to visually screen the sign supports within
three (3) years of the time of planting.
.1406 The maximum height of the freestanding sign shall be
limited to thirty (30) feet above finished grade. The
applicant shall submit the following information, which
shall be considered by the Planning Commission and/or City
Council in determining the height of the sign:

(a) line -of -sight drawings illustrating the minimum
height necessary to afford freeway visibility from the
direction of the freeway lanes closest to the property;
(b) photographed balloon tests or computerized
simulations including existing signage in the area to
adequately describe the proposed sign in the context of
its specific location and to permit easier
visualization of the proposal;
(c) illustrations depicting compatibility and scale of
sign design with building architecture and existing
signs on the property;
(d) plans which identify distances to freeway off -
ramps and demonstrate access to the property from the
freeway offramp; and
(e) renderings depicting illumination at night.
.1407 The maximum width of the freestanding sign, including
the sign support structure, shall not exceed twenty (20)
feet.
.1408 The area of each face of a double faced freestanding
sign panel shall not exceed one hundred twenty five (125)
square feet and be in the form of a maximum ten (10) foot
high and twelve and one-half (12 '-�) foot wide sign panel.
.1409 The sign shall be supported by a two post structure.
The posts and associated framing or metal skin shall not be
less than twenty-five percent (25%) of the total sign width.
The sign panel shall be recessed into the sign structure on
each side four (4) inches. No riders or attachments shall be
added to the sign structure.
.1410 Graphics shall be limited to the sign panel only.
Lettering including logo, shall constitute not more than
sixty percent (600) of total graphic area with background
forty percent (400). Lettering shall be limited to the name
of the business.
.1411 Sign panel materials shall conform to the established
sign design criteria of the City. The sign support structure
shall be constructed with high quality materials as approved
in the conditional use permit. The sign structure shall be
similar in color to the associated business building.

.1412 Freeway Oriented Wall Signs. One Freeway Oriented
Wall Sign, as defined in Section 18.05.030.054, subject to
the requirements of Section 18.05.030.140, shall be
permitted provided no Freeway Oriented Sign as defined in
Section 18.05.030.053 exists on the property to identify the
same use as the Freeway Oriented Wall Sign, and further
provided the total area of any such Freeway Oriented Wall
Sign shall not exceed 100 of the area of the face of the
building to which said sign is attached or 250 square feet,
whichever is greater."
SECTION 2.
That subsection .140 of Section 18.110.060 of Chapter 18.110
of Title 18 of the Anaheim Municipal Code be, and the same is
hereby, amended to read as follows:

in the conditional use permit. The sign structure shall be
similar in color to the associated business building.

.1312 Freeway Oriented Wall Signs. One Freeway Oriented
Wall Sign, as defined in Section 18.05.030.054, subject to
the requirements of Section 18.05.030.140, shall be
permitted provided no Freeway Oriented Sign as defined in
Section 18.05.030.053 exists on the property to identify the
same use as the Freeway Oriented Wall Sign, and further
provided the total area of any such Freeway Oriented Wall
Sign shall not exceed 100 of the area of the face of the
building to which said sign is attached or 250 square feet,
whichever is greater."
SECTION 6. EXEMPTIONS
Nothing contained in this ordinance shall apply to any
Freeway -Oriented Sign or Freeway -Oriented Wall Sign which
lawfully existed within the City of Anaheim at the time this
ordinance became effective; provided, however, that any
structural change or alteration of any such sign shall be subject
to the approval of the Planning Commission and/or City Council
through a variance proceeding as set forth in Sections 18.03.040
and 18.05.051 of this Code.
Nothing contained in this ordinance shall prevent the City
from approving applicable building permits to construct any
Freeway -Oriented Sign for which a valid entitlement was granted
prior to the effective date of this ordinance and provided said
entitlement has not expired.
SECTION 7. SEVERABILITY
The City Council of the City of Anaheim hereby declares that
should any section, paragraph, sentence or word of this ordinance
of the Code, hereby adopted, be declared for any reason to be
invalid, it is the intent of this Council that it would have
passed all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 8. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal of any
other ordinance of this City shall in any manner affect the
prosecution for violations of ordinances, which violations were
committed prior to the effective date thereof, nor be construed
as a waiver of any license or penalty or the penal provisions
applicable to any violations thereof. The provisions of this
ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to

the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
SECTION 9. PENALTY
It shall be unlawful for any person, firm or corporation to
violate any provision or to fail to comply with any requirements
of this ordinance. Any person, firm or corporation violating any
provision of this ordinance or failing to comply with any of its
requirements shall be deemed guilty of a misdemeanor and upon
conviction thereof shall be punished by a fine not exceeding One
Thousand Dollars ($1,000.00) or by imprisonment not exceeding six
(6) months, or by both such fine and imprisonment. Each such
person, firm or corporation shall be deemed guilty of a separate
offense for each day during any portion of which any violation of
any of the provisions of this ordinance is committed, and shall
be punishable therefor as provided for in this ordinance.
THE FOREGOING ORDINANCE is approved and adopted by the City
