PC2011 -068 A RESOLUTION OF THE ANAHEIM PLANNING COMMISSION APPROVING A CATEGORICAL EXEMPTION, SECTION 15301, CLASS 1 (EXISTING FACILITIES) AND APPROVING CONDITIONAL USE PERMIT NO. 2011-05569 (DEV2011- 00071) (1711 WEST KATELLA AVENUE) WHEREAS, the Anaheim Planning Commission did receive a verified Petition for Conditional Use Permit for certain real property situated in the City of Anaheim, County of Orange, State of California, shown on Exhibit A, attached hereto and incorporated herein by this reference. WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on September 26, 2011, at 5:00 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.60, to hear and consider evidence for and against said proposed conditional use permit and to investigate and make findings and recommendations in connection therewith; WHEREAS, this property is developed with a commercial center. The property is located in the CG (General Commercial) zone and the Anaheim General Plan designates the property for General Commercial land uses; and WHEREAS, said Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use to establish a drive- through bank is properly one for which a conditional use permit is permitted under authority of Code Section No. 18.08.030.010 (drive - through facilities). 2. That the proposed drive- through bank, as conditioned herein, would not adversely affect the adjoining land uses and the growth and development of the area in which it is located because. 3. That the size and shape of the site for the drive- through bank is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area or to the health and safety. 4. That the traffic generated by the drive - through bank will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area; and 5. That granting of the conditional use permit under the conditions imposed, will not be detrimental to the health and safety of the citizens of the City of Anaheim and will provide a land use that is compatible with the surrounding area. -1- PC2011 -068 WHEREAS, the proposed project falls within the definition of Categorical Exemptions, Section 15303, Class 1 (Existing) as defined in the State CEQA Guidelines, and is therefore, exempt from the requirement to prepare additional environmental documentation. NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby approve Conditional Use Permit No. 2011 -05569 and subject to the conditions of approval described in Exhibit "B" attached hereto and incorporated by this reference, which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the health, safety and general welfare of the Citizens of the City of Anaheim. Extensions for further time to complete conditions of approval may be granted in accordance with Section 18.60.170 of the Anaheim Municipal Code. Timing for compliance with conditions of approval may be amended by the Planning Director upon a showing of good cause provided (i) equivalent timing is established that satisfies the original intent and purpose of the condition (s), (ii) the modification complies with the Anaheim Municipal Code and (iii) the applicant has demonstrated significant progress toward establishment of the use or approved development. 13E IT FURTHER RESOLVED, that this permit is approved without limitations on the hours of operation or the duration of the use. Amendments, modifications and revocations of this permit may be processed in accordance with Chapters 18.60.190 (Amendment to Permit Approval) and 18.60.200 (City- Initiated Revocation or Modification of Permits) of the Anaheim Municipal Code. BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. BE IT FURTHER RESOLVED that approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. BE IT FURTHER RESOLVED that the applicant is responsible for paying all charges related to the processing of this discretionary case application within 15 days of the issuance of the final invoice. Police Department 3 Provide silent robbery /panic alarm for all tellers, customer service desks and ATMs. Police Department Closed circuit television (CCTV) security cameras are recommended, with the following coverage areas: • Lobby entrances • Teller queue and general public areas • Building perimeter • All ATMs • Drive -Up Teller /ATM • Exterior entrance • AlI Teller windows • Parking lot CCTV monitor and recorders should be secured in a separate locked compartment or be off -site to prevent theft or, or tampering with, the tape /recording. CCTV recording should be kept for a minimum of 30 days before being recorded over or deleted. CCTV videotapes should not be recorded over more than 10 items per tape. Use of digital recording equipment as an alternative to videotape is encouraged. Police Department 5 Address numbers shall be positioned so as to be readily readable from the street. Number should be illuminated during hours of darkness. Police Department 6 Rear entrance doors shall be numbered in the same address numbers or suite number of the business. Minimum height of 4" recommended. Police Department EXHIBIT "13" CONDITIONAL USE PERMIT NO. 2011-05569 (DEV2011- 00071) -5- PC2011 -068 7 Rooftop address numbers for the police helicopter. Minimum size 4' in height and 2' in width. The lines of the numbers are to be a minimum of 6" thick. Numbers should be spaced 12" to 18" apart. Numbers should be painted or constructed in a contrasting color to the roofing material. Numbers should face the street to which the structure is addressed. Numbers are not to be visible from the ground level. Police Department 8 All exterior doors to have adequate security hardware, e.g. deadbolt locks. Police Department 9 Interior doors to private or secure areas should require authorized access only via card reader, keypad, key or other security device /system. Police Department 10 Wide -angle peepholes or other viewing device should be installed in solid doors where natural surveillance is compromised. Police Department 11 Consideration should be given to including bullet resistant glass and paneling for the secured area of the bank. This should include any teller windows or access points to the employee area within the building_ Police Department 1 ,� Windows accessible from the side and rear of the building and not viewable from the street shall consist of rated burglary resistant glazing or its equivalent that attaches to the frame. police Department l 3 Large store/business display windows shall consist of burglary resistant glazing or its equivalent that attaches to the frame. Police Department 14 Louvered windows shall not be used. Police Department 15 All glass skylights on the roof of any building shall be provided with: • Rated burglary resistant glass or glass -like acrylic material or • Security bars of at least V2 round steel, or 1" by `A" flat steel material, spaced no more than 5" apart under the skylight and securely fastened. • A steel grill of at least 1/8" material under the skylight and securely fastened. Police Department 16 All hatchway openings on the roof of any building shall be secured as follows: • If the hatchway is of wooden material, if shall be covered on the outside with at least 16 -gauge sheet steel or its equivalent attached with screws. • Outside hinges on all hatchway openings shall be provided with non - removable pins when using pin - type hinges. Police Department 17 All air duct or air vent openings exceeding 8 "x12" on the rooftop of exterior walls of any building shall be secured by Police -6- PC2011 -068 -7- PC2011 -068 covering the same with either of the following: • Security bars of at least 1/2" round steel, or 1" by 1 /4" flat steel material, spaced no more than 5" apart and securely fastened or • A steel grill of at least 1/8" material and securely fastened. If the barrier is secured to the outside of the structure, it shall be secured with galvanized rounded head flush bolts of at least 3/8" diameter on the outside. Department 18 Monument signs and addresses shall be well lighted during hours of darkness. Police Department 19 Adequate lighting of parking lots, drive up window /ATM, passageways, and grounds contiguous to buildings shall be provided with lighting of sufficient wattage to provide adequate illumination to make clearly visible the presence of any person on or about the premises during the hours of darkness and provide a safe, secure environment for all person, property, and vehicles on -site. Police Department 20 All exterior doors shall have their own light source, which shall adequately illuminate door areas at all hours to make clearly visible the presence of any person on or about the premises and provide adequate illumination for persons exiting the building. Police Department 21 Consideration should be given to adding supplemental exterior flood lighting to enhance the existing area lights in the parking lot. The area immediately surrounding the walk- up and drive -thru ATM should be well illuminated. Police Department ■ 22 "No Trespassing 602(k) P.C." posted at the entrances of parking lots /structures and located in other appropriate places. Signs must be at least 2'xl' in overall size, with white background and black 2" lettering. Police Department 23 All entrances to parking areas shall be posted with appropriate signs per 22658(a) C.V.C., to assist in removal of vehicles at the property owners /managers request. Police Department Marked parking spaces for company Presidents /CEO's should be eliminated for safety reasons. Police Department 25 The property shall be developed substantially in accordance with plans and specifications submitted to the City of Anaheim by the applicant and which plans are on file with the Planning Department marked Exhibit No. 1 (Site Plan), Exhibit No. 2 (Floor Plan) and Exhibit No. 3 (Elevation Plan), and as conditioned herein.
