A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM REVISING FEES
FOR THE UNDERGROUND STORAGE TANK
PROGRAM AND ESTABLISHING THE
EFFECTIVE DATE OF FEES.
WHEREAS, the City Council of the City of Anaheim has
heretofore amended the Anaheim Municipal Code to assume
responsibility for implementing Chapter 6.7 of Division 20 of the
Health and Safety Code relating to underground storage of
hazardous materials; and
WHEREAS, Section 25287(a) of the Health and Safety Code
requires the governing body of a City which assumes enforcement
jurisdiction to establish fees at a level sufficient to pay the
necessary and reasonable costs incurred by the City in
administering Chapter 6.7, including, but not limited to,
permitting and inspection responsibilities; and
WHEREAS, the City Council hereby finds and declares
that adoption of this fee schedule is exempt from the provisions
of the California Environmental Quality Act pursuant to Section
21080(b) (8) of the Public Resources Code and California Code of
Regulations Section 15273 in that the fees and rates are
established do not exceed the City's actual costs in
administering Chapter 6.7 to meet operating expenses, including
employee wage rates and fringe benefits; purchasing or leasing
supplies, equipment or materials; and
WHEREAS, the City of Anaheim has heretofore complied
with the applicable requirements of Chapter 8 of Division 1 of
Title 7 of the Government Code of the State of California
entitled Procedures for Adopting Various Fees;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Anaheim that it does hereby adopt the following fee
schedule for the underground storage tank program:

Transfer of Ownership

Permit to Change Contents or

Temporary Closure of Underground $100.00 per tank

BE IT FURTHER RESOLVED by the City Council that these
fees shall become effective July 11, 2001.
BE IT FURTHER RESOLVED that Resolution No. 95R-113 is
hereby rescinded effective July 11, 2001.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 10th day of July
2001.
