A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
AMENDING RATES, RULES AND REGULATIONS FOR THE SALE AND
DISTRIBUTION OF ELECTRICITY AND WATER AS ADOPTED BY
RESOLUTIONS NOS. 71-478 AND 72-600 AND MOST RECENTLY
AMENDED BY RESOLUTIONS NOS. 99R-142 AND 2001R-85.
WHEREAS, the City of Anaheim (Anaheim) maintains electric
generation and distribution systems and a water transmission and
distribution system for the distribution of electricity and water
to residents and inhabitants of Anaheim and has adopted Rates,
Rules and Regulations for the sale and distribution of
electricity and water; and
WHEREAS, the Anaheim Municipal Code authorizes the City
Council to approve reasonable Rates, Rules and Regulations
governing water and electric service and fees for providing water
and electric services; and
WHEREAS, these fees shall be based on the actual costs of
providing water and electric services including labor costs and
other direct and indirect costs to Anaheim; and
WHEREAS, the City Council has previously established some of
the fees authorized by the Anaheim Municipal Code; and
WHEREAS, due to increases in Anaheim's costs it is in the
public interest and welfare to establish fees heretofore
authorized but not established and to amend other fees heretofore
established; and
WHEREAS, due to a review and analysis of actual costs to
provide water and electric services it is appropriate to
establish or increase such fees;
WHEREAS, the City Council hereby finds that said fees, in
the amounts hereinafter set forth, are less than or equal to, but
in any event not greater than, the actual direct and indirect
costs and expenses incurred by the City in providing the related
water and electric services; and
WHEREAS, text revisions to the Electric and Water Rates,
Rules and Regulations are necessary to clarify applicability of
the Rates, Rules and Regulations.
WHEREAS, the City Council further finds and determines that
this, establishment of and amendment to fees is exempt from the
California Environmental Quality Act pursuant to Section
21080(b) (8) of the California Public Resources Code.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Anaheim as follows:
1. The changes and additions to the Water and Electric
Rates, Rules and Regulations as set forth in Appendix A shall be,
and are hereby, adopted and shall be effective July 30, 2001.
2. The fees established and/or amended herein shall, upon
effectiveness, supersede any previously adopted fees for the same
water and/or electric services.
3. The City Council hereby declares that should any one or
more fees established by this Resolution or any portion of this
Resolution be declared for any reason to be invalid, it is the
intent of the City Council that it would have adopted all other
fees and portions of this Resolution independent of the
elimination herefrom of any such fees or portion as may be
declared invalid.
THE FOREGOING RESOLUTION is approved and adopted by the
City Council of the City of Anaheim this 10th day of July, 2001.

Each applicant for utility service Will be required to satisfactorily establish credit wkich will be deemed established
upon.qualifying under any one of the following:
1. If appl/cant makes a cash deposit to secure payment of bills or summary bills for service in the
amount prescribed in Rule No. 7; or

service within the past two years if billed monthly, three years if billed bimonthly, service was
not disconnected due to non-payment or theft of service, any closing bill was paid within 30
days of the date of issuance, and the last twelve consecutive billing periods of that prior service
reflected a credit rating of "Good", provided that the periodic bill for such previous service was
equal to at least 50% of that estimated for the new service and provided further, that the credit
of the applicant is unimpaired in the opinion of the Utility; or

REESTABLISHMENT OF CREDIT - ALL CLASSES OF SERVICE
I. An applicant who previously has been a customer of the Utility and whose service has been
discontinued by the Utility one or more times during the past twelve billing periods of that prior

3. A customer wbo fails to pay bills or summary bills before they become past due as prescribed in
Rule No. ll-B~ and who further fails to pay such bills by the date indicated on a discontinuance
of service notice for nonpayment of bills, may be required to pay said bills and reestablish his

GENERAL
Deposits will be required when a'customer is otherwise unable to satisfactorily establish or reestablish credit as set
forth .in Rule 6.
AMOUNT OF DEPOSIT ~
The a'mount of deposit required to establish or reestablish credit for service is twice the estimated average bill or an
amount equal to the expenses incttrred by the department in supplying the service plus a sum equal to twice the
estimated average bill for such service; but in no case shall the amount be less than the minimum deposit as set forth
in Rule 21.
In the event that a customer of the Utility has diverted water, a separate deposit shall be assessed. This
deposit shall be twice the amount of the estimated loss to the Utility resulting from the diversion; but in no
case shall the amount be less than the mininmm Diversion deposit as set forth in Rule No. 21.
RETURN OF DEPOSIT
1. Upon discontinuance of service, the Utility w/il refund the customer's deposit or the balance in excess of
the unpaid bills for service; except the City shall not be required to refund any advanced deposit where the
cost to the City for processing such refund, whicb is herewith detemfined to be five dollars ($5.00),
exceeds said advanced deposit balance.
2. After the customer has paid bills or :u..~'x:aD' ~i..s for service for 12 months and has maintained a Good
credit rating (no more than one Final Notice), or after 24 months and has maintained a Fair credit
ratiug (no more thau two Final Notices), or has an otherwise unimpaired credit ratiug, the Utility
will refund the deposit. If the customer fails to meet tbe criteria for return of the deposit, the Utility
will thereafter review the account every billing period and will refund the deposit when the

INTEREST ON DEPOSITS
There shall be no interest paid on utility deposits held by the City.

main extension improvement plans.
d. Right-of-Way Processing Fee: Three Hundred Forty-Five Dollars ($345.00) per document
submitted to the City as aa easement for public utility purposes.

($10.00) will be charged by the Water Engineering Division, Public Utility Deparlment for each
copy of the Water Engineering Division's Standard Specification for Construction of Domestic

GENERAL

only a small domestic service (2 inch or smaller), the Utility shall furnish and install the

3. The service connection, meter, and meter box will generally be installed at a convenient location
between the curb or edge of pavement and the property line. If it is considered impractical to
install the facilities in this location, they may be installed upon the customer's premises, in which
case an easement will be required.
4. Any existing galvanized or plastic service line serving a property undergoing development,
renovation or building construction shall be replaced with a new copper service at the Customer's
expense as required to comply with applicable Federal, State and Local laws and regulations. This
shall also include the cost of abandonment of the existing service.

GENERAL
I. The character of service available at any particular location should be ascertained by. inquiry at the
City's Electrical Engineering Division office.

2. The rate schedules included heroin are applicable for service where the customer purchases his
entire electrical requirements from the Utility, except where such schedules specifically provide,
otherwise, and are not applicable where a part of the customer's electrical requirements are
supplied from some other source.
3. The rate schedules included herein are only applicable for 'service provided from overhead
distribution facilities (or where underground distribution facilities are provided for the Utility's
operating convenience or in accordance with the provisions of Rules Nos. 15, 15.1, 16 and 20)
except where schedules specifically provide otherwise.
4. Alternating current service of approximately 60-cycle frequency will be supplied.
5. Voltages referred to in the tariff schedules are nominal voltages and in some few instances
reasonable variatious may occur.
6. Service will be supplied at one standard voltage for each class of service. Each service shall have
a service main disconnecting device with an ampere rating equal to or less than the ampere
rating of the underground pull section and the service conductors. The total ampere rating
of the service main disconnecting devices including taps to underground pull section shall be
equal to or less than the ampere rating of the service conductors.
PHASE AND VOLTAGE SPECIFICATIONS
I. Standard nominal voltages of the Utility are as follows:
a. Distribution voltages - 120, 120/240, 240, 240/480, 277/480, 2400 and 4160 volts.
b. Voltages in excess of 33,000 volts are transmission voltages. For its operating
convenience, the City may elect to supply a customer from lines of transmission voltage.
In such case, the customer may select as a standard delivery voltage one of the follow/ng:
2400, 4160, 6900, 12,000 volts or such other voltage as the City may approve.
c. Where the City maintains four-wire wye-connected polyphase secondary mains: 120,
120/208, and 208 volts.

ESTABLISHMENT OF CREDIT - ALL CLASSES OF SERVICE
Each applicant for utility service, including applicants who will obtain their electric power and ancillary
services from an Energy Service provider, will be required to satisfactorily establish credit which will be
deemed established upon qualifying under any one of the following:
If applicant makes a cash deposit to secure payment of bills for service in the amount prescribed in
Rule No. 7; or

within the past two years if billed monthly, three years if billed bimonthly, service was not
disconnected due to non-payment or theft of service, any closing bill was paid within 30 days
of the date of issuance, and the last twelve consecutive billing periods of that prior service
reflected a credit rating of "Good" (no more than one Final Notice) provided that the
periodic bill for such previous service was equal to at least 50% of that estimated for the new
service and provided further, that the credit of the applicant is unimpaired in the opinion of
the Uti!ity; or

required to reestablish credit by depositing the amounts prescribed in Rule No. 7 for that

3, A customer who fails to pay bills before they become past due as prescribed in Rule No. ll-
B, and who further fails to pay such bills by the date indicated on a discontinuance of service
uotice for nonpayment of bills, may be required to pay said bills and reestablish credit by
depositing the amount prescribed in Rule No. 7. This rule will apply regardless of whether
or not service has been discontinued for such nonpayment.
4. A customer may be required to reestablish credit in accordance with Rule No. 6-A in case the
conditions of service or basis on which credit was originally established hav~, in the opinion of the
Utility, materially changed.

GENERAL
Deposits will be required when a customer is othera, ise unable to satisfactorily establish or reestablish
credit as set forth in Rule No. 6. '
AMOUNT OF DEPOSIT
The amount of deposit required to establish or reestablish credit for electric service is twice the estimated
average bill or an amount equal to the expenses incurred by the Public Utilities Department in supplying the
service plus a sum equal to twice the estimated average bill for such services; but in no case shall the
amount be less than the minimum deposit as set forth in Rule No. 23.
In the event that a customer of the Utility has diverted electricity, a separate deposit Shall be
assessed. This deposit shall be twice the amount of the estimated loss to the Utility resulting from the
diversion; but in no case shall the amount be less than the Minimum Diversion Deposit as set forth in
Rule No. 23.
r~TURN OF DEPOSIT
1. Upon discontinuance of service the Utility will refund the customer's deposit or the balance in
excess of the uupaid bills for service; except the City shall not be required to refund any advanced
deposit balance where the cost to the City for processing such refund, which is herewith
determined to be five dollars ($5.00) exceeds said advanced deposit balance.
2. After the customer has paid bills for service for 12 months and has maintained a Good credit
rating (no more than one Final Notice), or after 24 months and has maintained a Fair credit
rating (no more than two Final Notices), or has an otherwise unimpaired credit rating, the
Utility will refund the deposit. If the customer fails to meet the criteria for return of the
deposit, the utility will thereafter review the account every billing period and will refund the
deposit when the customer meets the criteria described above. ""~
3. The Utility may return the deposit at any time upon request, provided the customer's credit m~y
otherwise be established in accordance with Rule No. 6.
INTEREST ON DEPOSITS
There shall be no interest paid on utility deposits held by the City.
