PC2011 -093 A RESOLUTION OF THE ANAHEIM CITY PLANNING COMMISSION DETERMINING THAT A MITIGATED NEGATIVE DECLARATION IS THE APPROPRIM E ENVIRONMENTAL DOCUMENTATION AND AMENDING CONDITIONAL USE PERMIT NO. 2003 -04800 AND APPROVING VARIANCE NO. 2011 -04853 AMENDING CONDITIONS OF APPROVAL OF RESOLUTION NO. 2006R -26 (DEV2010- 00163) (200 NORTH VIA CORTEZ) WHEREAS, on February 10, 2004, the Anaheim City Council did, by its Resolution No. 2006R -26, granted Conditional Use Permit No. 2003 -04800 in part, to construct an automotive sales dealership with accessory roof - mounted equipment with a maximum structural height of 32 feet; and WHEREAS, on May 30, 2007, the Planning Commission, by its Resolution No. PC2007 -50, did amend certain conditions of approval of Resolution No. 2006R -26 to permit additional signs, modify elevations, and construct a canopy and an outdoor vacuum facility with a variance for the landscape setback requirements; and WHEREAS, the Planning Commission did receive a verified Petition for an amendment to Conditional Use Permit No. 2003 -04800 and Variance No. 2011- 04853, as described below; and WHEREAS, the applicant requests an amendment to Conditional Use Permit No. 2003 -04800 to permit the expansion of an existing automobile dealership to include an automobile service facility. The proposal includes an expansion of the existing automobile showroom and sales building and the construction of a new three - story, 115,493- square -foot automobile service and vehicle storage building. Automobile service is also proposed in the existing car wash building located east of the sales building. The applicant is also requesting variances to allow a building setback less than required by Code adjacent to the Riverside (SR- 91) Freeway and abutting a residential zone, and fewer parking spaces than required by Code; and WHEREAS, the subject property is developed with an automobile sales facility and is located in the C -G (SC) (General Commercial, Scenic Corridor Overlay) Zone, and the Anaheim General Plan designates this property for General Commercial land uses; and WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on November 21, 2011, at 5:00 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.60, to hear and consider evidence for and against said proposed amendment to conditional use permit and variance and to investigate and make findings and recommendations in connection therewith; and 1 - PC2011 -093 WHEREAS, said Planning Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. The proposed request to permit the expansion of an existing automobile dealership to include an automobile service facility, the expansion of the existing automobile showroom and sales building and to permit automobile service in the existing car wash building with variances to allow a building setback less than required by Code adjacent to the Riverside (SR -91) Freeway and abutting a residential zone, and fewer parking spaces than required by Code in the C -G (SC) (General Commercial, Scenic Corridor Overlay) Zone is properly one for which a conditional use permit is authorized by Anaheim Municipal Code Section 18.08.30.040.0402 (Automotive - Car Sales and Rental). 2. The proposed amendment to the conditional use permit, as conditioned herein, would not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located because an environmental assessment has been performed for the project and any potential impacts have been addressed with mitigation measures and design features. 3. The size and shape of the site for the use is adequate to allow the full development of the proposed project in a manner not detrimental to the particular area or to the health and safety because an environmental assessment has been performed for the project and any potential impacts have been addressed with mitigation measures and design features. 4. The traffic generated by the proposed project will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area. A traffic study was completed as a part of the environmental review and mitigation measures have been identified to address any potential traffic impacts. 5. The granting of the conditional use permit and the variance under the conditions imposed will not be detrimental to the health and safety of the citizens of the City of Anaheim as the proposed project will be compatible with the surrounding area through conditions of approval and mitigation measures for the use and is not a health or safety risk to the citizens of the City of Anaheim. WHEREAS, the Planning Commission does further find and determine that the request for a variance to permit a building setback less than required by Code adjacent to the Riverside (SR -91) Freeway and abutting a residential zone and fewer parking spaces than required by Code in the C -G (SC) (General Commercial, Scenic Corridor Overlay) Zone should be approved for the following reasons: (a) SECTION NO. 18.18.090.010.0101 Landscape setback adjacent to Riverside Freeway (90 foot structural, 25 foot landscaped required; 9'to 27' -6" 2 - PC2011 -093 (b) SECTION NO. 18.08.060.010 (c) SECTION NO. 18.42.040.010 structural proposed, 6' to 27'6" landscaped proposed) Landscape setback adjacent to residential zone (76 foot structural, 10 foot landscaped required; 36'11" to 46'6" structural proposed, 6' to 26'6" landscaped proposed) Minimum required parking spaces (468 spaces required; 236 spaces proposed) 1. Waivers A and B are hereby approved based on the fact that the property is linear and narrow and is intersected by a flood control channel, limiting the developable area on the site; and, 2. Strict application of the Zoning Code deprives the property of privileges enjoyed by other property under identical zoning classification in the vicinity as the property to the west of the subject property is developed with a hotel with a setback that is less than required by Code. 3. Waiver C is hereby approved based upon the parking study prepared by Linscott, Law and Greenspan Engineers determining the necessary demand for parking spaces for the proposed project. The parking study concludes that the demand for the dealership and repair facility is far less than required by Code based upon the current parking demand at this site and other similar automobile dealerships with repair facilities. For this reasons, this request will not cause fewer off - street parking spaces to be provided for the proposed use than the number of such spaces necessary. 4. The variance will not will not increase the demand and competition for parking spaces upon the public streets in the immediate vicinity of the proposed use because all parking will be contained on the subject property. 5. The variance will not increase the demand and competition for parking spaces upon adjacent private property in the immediate vicinity of the proposed use because all parking will be contained on the subject property. 6. The variance will not increase traffic congestion within the off- street parking areas or lots provided for the proposed use because the project does not propose new ingress or egress points and is designed to allow adequate on -site circulation. 7. The variance will not impede vehicular ingress to or egress from adjacent properties upon the public streets in the immediate vicinity of the proposed use because the - 3 - PC2011 -093 project does not propose new ingress or egress points and is designed to allow adequate on -site circulation and therefore will not impede vehicular ingress to or egress from adjacent properties upon the public streets in the immediate vicinity of the property. WHEREAS, the Anaheim City Planning Commission has reviewed the proposal and does hereby find that the Mitigated Negative Declaration and the associated Mitigation Measures included as conditions of approval is adequate to serve as the required environmental documentation in connection with this request upon finding that the declaration reflects the ' independent judgment of the lead agency and that it has considered the Mitigated Negative Declaration together with any comments received during the public review process and further finding on the basis of the initial study and any comments received that there is no substantial evidence that the project will have a significant effect on the environment. NOW THEREFORE BE IT RESOLVED that the Planning Commission, for the reasons hereinabove specified does hereby grant the amendment to Conditional Use Permit No. 2003 -04800 to permit the expansion of an existing automobile dealership to include an automobile service facility, the expansion of the existing automobile showroom and sales building and to permit automobile service in the existing car wash building with variances to allow a building setback less than required by Code adjacent to the Riverside (SR -91) Freeway and abutting a residential zone, and fewer parking spaces than required by Code in the C -G (SC) (General Commercial, Scenic Corridor Overlay) Zone and grant Variance No. 2010 - 04853. BE IT FURTHER RESOLVED, that the Planning Commission does hereby amend and restate the conditions of approval adopted in connection with Resolution No. 2006R- 26, approving Conditional Use Permit No. 2003 - 04800, to read as stated in Exhibit `B" attached hereto and incorporated herein by this reference, which conditions are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the health, safety and general welfare of the citizens of the City of Anaheim. Extensions for further time to complete conditions of approval may be granted in accordance with Section 18.60.170 of the Anaheim Municipal Code. Timing for compliance with conditions of approval may be amended by the Planning Director upon a showing of good cause provided (i) equivalent timing is established that satisfies the original intent and purpose of the condition (s), (ii) the modification complies with the Anaheim Municipal Code and (iii) the applicant has demonstrated significant progress toward establishment of the use or approved development. BE IT FURTHER RESOLVED that, except as expressly amended herein, the provision of Resolution No. 2006R -26, amending Conditional Use Permit No. 2003- 04800, shall remain in full force and effect. BE IT FURTHER RESOLVED, that this approval is for a period of three (3) years and that amendments, modifications and revocations of this permit may be processed in accordance with Chapters 18.60.190 (Amendment to Permit Approval) and 18.60.200 (City - Initiated Revocation or Modification of Permits) of the Anaheim Municipal Code. - 4 - PC2011 -093 BE IT FURTHER RESOLVED that the Anaheim City Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. BE IT FURTHER RESOLVED that approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. BE IT FURTHER RESOLVED that the applicant is responsible for paying all charges related to the processing of this discretionary case application within 15 days of the issuance of the final invoice. CONDITIONS OF APPROVAL REVIEW BY SIGNED OFF BY PRIOR TO ISSUANCE OF A GRADING PERMIT 1 Prior to commencement of any construction all necessary permits required by the State of California shall be obtained to develop over the flood control channels. Planning Department, Building Division 2 MM 5 Prior to grading plan approval, a site - specific soils and geotechnical report shall be prepared for the project. The report shall be submitted to the City of Anaheim Building Division for review and approval. Any mitigation measures recommended therein shall be added to the project as directed by the City of Anaheim Planning Department. Planning Department, Building Division 3 Prior to grading plan approval, the developer shall obtain an Encroachment Permit from the Orange County Flood Control District (OCFCD) for grading and development within the OCFCD easement. Planning Department, Building Division 4 Prior to grading plan approval, the developer shall obtain a clearance letter from the Metropolitan Water District (MWD) for grading and development within the MWD easement. Planning Department. Building Division 5 Prior to grading plan approval, the developer shall obtain an Encroachment Permit or clearance letter from Caltrans for grading and development within the Caltrans easements. Planning Department, Building Division 6 MM 2 A City- approved archaeologist shall be retained by the applicant on an on -call basis. The archaeologist shall attend one pre -grade meeting and provide specific communication and grading activity protocols to be followed in the event of a possible find, even though the probability of discovering any finds is low. In addition, the archaeologist shall conduct at least one site visit during active grading hours to ensure that recommended protocols are being followed. Should potential archaeological finds be discovered during grading, all grading shall be halted and the archaeologist shall be called to record newly discovered resources and to salvage and catalog cultural materials as necessary. The archaeologist shall establish procedures for archaeological resource surveillance and would have authority, in Planning Department, Building Division EXHIBIT "B" CONDITIONAL USE PERMIT NO. 2003-04800 AND VARIANCE NO. 2011-04853 (DEV201 0- 00163) -8 PC2011 -093 -9- PC2011 -093 cooperation with the City, to temporarily halt or divert work to permit sampling, identification, and evaluation of artifacts as appropriate. If the archaeological resources are found to be significant, the archaeologist shall determine appropriate actions, in cooperation with the City, for exploration and /or salvage. The archaeological monitor would (1) ascertain the significance of the resource, (2) establish protocol with the City to protect such resources, and (3) ascertain the presence of additional resources. Significant resources may require additional excavation and cultural resource work. Any monitoring program shall be reviewed and approved by the Planning Director prior to the continuation of grading activities. 7 A City- approved paleontologist shall be retained by the Planning MM 3 applicant/developer on an on -call basis. The paleontologist shall attend one pre - grading meeting and provide specific communication and grading activity protocols to be followed in the event of a possible find, even though the probability of discovering any finds is very low. In addition, the paleontologist shall conduct at least one visit during the active hours of grading operations to ensure that recommended protocols are being followed. Department, Building Division If paleontological resources are encountered during ground - disturbing excavation, construction in the vicinity of the discovery would be halted until the finds have been assessed by a qualified paleontologist. The paleontologist shall be empowered to evaluate and remove the discovery, if necessary. The paleontologist would determine whether a Paleontological Resource Impact Mitigation Program is required for the remaining excavation activity for the project. 8 The applicant shall submit to the Building Department for Planning MM 6 review and approval, a Water Quality Management Plan, in accordance with the latest WQMP requirements which went into effect as of August 17, 2011, that: Department, Building Division • Addresses site design best management practices (BMPs) such as minimizing impervious areas, maximizing permeability, minimizing directly connected impervious areas, creating reduced or "zero discharge" areas, and conserving natural areas. • Incorporates the applicable routine source control BMPs as defined in the Drainage Area Management Plan (DAMP). • Incorporates treatment control BMPs as defined in the DAMP. • Describes the long -term operation and maintenance requirements for the treatment control BMPs. • Identifies the entity that will be responsible for long -term operation and maintenance of the treatment control BMPs, -9- PC2011 -093 - 10- PC2011 -093 and describes the mechanism for funding the long -term operation and maintenance of the treatment control BMPs. 9 Prior to grading plan approval, the developer shall submit a Hydrology report to the Public Works Department for review and approval. Public Works, Development Services Division 10 MM 15 Prior to the start of construction, all requests for new water service or fire lines, as well as any modifications, relocations, or abandonments of existing water services and fire lines, shall be coordinated through the Water Engineering Division of the Anaheim Public Utilities Department. Public Utilities, Water Engineering Division PRIOR TO ISSUANCE OF A BUILDING PERMIT 11 MM 1 The property owner /developer shall submit plans that detail the lighting systems for the proposed project adjacent to residential or other light - sensitive uses. The system shall be designed and maintained in such a manner as to conceal the light sources to the extent feasible to minimize light spillage and glare to adjacent uses. The plans shall be prepared and signed by a licensed electrical engineer with a letter from the engineer stating that, in the opinion of the engineer, the requirement has been met. After hours, lighting within the dealership shall be reduced to the minimum level required for security. Planning Department, Planning Services Division 12 The design and placement of any proposed security bollards shall be submitted to the Planning Services Division for review and approval. Any decision made by the Planning Services Division regarding such plan may be appealed to the Planning Commission or City Council. Said information shall be specifically shown on the plans submitted for building permits. Planning Department, Planning Services Division 13 All roof and /or ground mounted equipment shall be contained within an acoustical enclosure and shall be completely screened from visibility to surrounding properties streets and the SR 91 Riverside Freeway in conformance with the Anaheim Municipal Code pertaining to development standards for roof mounted equipment in the (SC) Scenic Corridor Zone Overlay Zone. Said information shall be specifically shown on the plans submitted for building permits. Planning Department, Planning Services Division 14 The plans submitted for building permits shall include information demonstrating that the lighting from the signs shall not cause excessive light and /or glare towards the residences to the south and that the onsite advertising signs shall be illuminated only during hours of operation. Planning Department, Planning Services Division - 10- PC2011 -093 15 Four (4) foot high street address numbers shall be displayed on the roof of the building in a contrasting color to the roof material. The numbers shall not be visible to adjacent streets or properties. Said information shall be specifically shown on plans submitted to the Police Department, Community Services Division for review and approval. Planning Department, Planning Services Division 16 All plumbing or other similar pipes and fixtures located on the exterior of the building shall be fully screened by architectural devices and/or appropriate building materials and that such information shall be specifically shown on the plans submitted for building permits. Planning Department, Planning Services Division 17 MM 8 The proposed service area in the preparation building shall be separated from the car wash by interior walls, or by other barriers needed to prevent water from the car wash from entering the service area. The project applicant shall have the project architect prepare construction drawings of walls or other barriers to keep water from the car wash out of the service area. The project applicant shall submit such drawings to the City for review and approval before issuance of building permits for the project. Planning Department, Building Division 18 Plans shall be submitted to the City Traffic and Transportation Manager for review and approval showing conformance with the current versions of Engineering Standards pertaining to parking standards and driveway locations. Subject property shall thereupon be developed and maintained in conformance with said approved plans. Public Works, Traffic Engineering Division 19 Trash storage areas shall be provided and maintained in locations acceptable to the Public Works Department, Streets and Sanitation Division and in accordance with approved plans on file with said Department. Said storage areas shall be designed, located, and screened so as not to be readily identifiable from adjacent streets or highways. The walls of the storage areas shall be protected from graffiti opportunities by the use of plants such as minimum one gallon sized clinging vines planted on maximum three (3) foot centers or tall shrubbery. Said information shall be specifically shown on the plans submitted for building permits. Public Works, Streets and Sanitation Division 20 A plan sheet for solid waste storage and collection and a plan for recycling shall be submitted to the Public Works Department Streets and Sanitation Division for review and approval. Public Works, Streets and Sanitation Division 21 An on -site trash truck turn - around area shall be provided in accordance with Engineering Standard Detail No. 610 and maintained to the satisfaction of the Public Works Department, Streets and Sanitation Division. Said turn Public Works, Streets and Sanitation PC2011 -093 - 12 - PC2011 -093 around area shall be specifically shown on the plans. submitted for building permits. Division 22 The locations for future above ground utility devices including but not limited to electrical transformers water backflow devices gas communications and cable devices etc. shall be shown on the plans submitted for building permits. Such plans shall also identify the specific screening treatment of each device (i.e., landscape screening color of walls materials identifiers access points, etc.) and shall be subject to review and approval by the appropriate City departments. Public Utilities, Water Engineering Division Public Utilities, Electrical Engineering Division 23 Prior to approval of permits for improvement plans, the property owner /developer shall coordinate with Electrical Engineering to establish electrical service requirements and submit electric system plans, electrical panel drawings, site plans, elevation plans, and related technical drawings and specifications. Public Utilities, Electrical Engineering Division 24 Prior to connection of electrical service, the legal owner shall provide to the City of Anaheim a Public Utilities easement with dimensions as shown on the approved utility service plan. Public Utilities, Electrical Engineering Division 25 Any required relocation of City electrical facilities shall be at the developer's expense. Landscape and /or hardscape screening of all pad mounted equipment shall be required and shall be shown on the plans submitted for building permits. Public Utilities, Electrical Engineering Division 26 Prior to commencement of structural framing, fire hydrants shall be installed and charged as required and approved by the Fire Department. Fire Department 27 An all- weather access road as approved by the Fire Department shall be provided during construction. Fire Department 28 Fire hydrants shall meet minimum Fire Department Specifications and Requirements for spacing, distance to structure and available fire flow. Fire Department 29 Emergency vehicular access shall be provided and maintained in accordance with Fire Department Specifications and Requirements. The dimensions, including the turning radii, shall be shown on the site plan. Fire Department 30 An automatic fire sprinkler system shall be designed, installed and maintained as required by the Fire Department. Fire Department 31 Lockable pedestrian and/or vehicular access gates shall be equipped with Knox devices as required and approved by the Fire - 12 - PC2011 -093 - 13 - PC2011 -093 Fire Department. Department 32 All new aboveground/underground storage tanks shall be approved and permitted by the Anaheim Fire Department prior to installation. Fire Department 33 That a final landscaping and irrigation plan shall be submitted to the Planning department for review and approval. Said plan shall include planting details for the "green wall" proposed on the south elevation of the proposed parts and service building. Planning Department, Planning Services Division ONGOING DURING CONSTRUCTION 34 MM 4 In the event that human remains are discovered during project ground- disturbing activities, the project construction contractor shall halt all ground - disturbing activities until the Coroner has conducted an investigation into the circumstances, manner and cause of any death, and the recommendations concerning the treatment and disposition of the human remains have been made to the person responsible for the excavation, or to his or her authorized representative. Planning Department, Building Division 35 MM 9 Construction activities, deliveries, and haul trucks shall be restricted to the daytime hours of 7:00 AM to 7:00 PM, Monday through Friday. Construction shall be prohibited on Saturday, Sunday, and on federal holidays for the duration of the construction period. Planning Department, Building Division 36 MM 10 Prior to the start of and for the duration of construction, the contractor shall properly maintain and tune all construction equipment in accordance with the manufacturer's recommendations to minimize noise emissions. Planning Department, Building Division 37 MM 11 Prior to use of any construction equipment, the contractor shall fit all equipment with properly operating mufflers, air intake silencers, and engine shrouds no less effective than as originally equipped by the manufacturer. Planning Department, Building Division 38 MM 12 During construction, the construction contractor shall place stationary construction equipment and material delivery (loading/unloading) areas as far from adjacent residential uses as feasible. Planning Department, Building Division 39 MM 13 The construction contractor shall post a sign, clearly visible onsite, with a contact name and telephone number of the owner's authorized representative to respond in the event of a noise complaint. Planning Department, Building Division - 13 - PC2011 -093 PRIOR TO FINAL BUILDING AND ZONING INSPECTIONS 40 MM 7 Prior to issuance of certificate of occupancy, the applicant shall: • Demonstrate that all structural best management practices (BMPs) described in the project water quality management plan (WQMP) have been constructed and installed in conformance with approved plans and specifications. • Demonstrate that the applicant is prepared to implement all nonstructural BMPs described in the project WQMP. • Demonstrate that an adequate number of copies of the approved project WQMP are available onsite. • Submit for reviews and approval by the City an operation and maintenance plan for all structural BMPs. Planning Department, Building Division 41 MM 14 Prior to Certificate of Occupancy, the applicant shall work with the City of Anaheim Public Works Department to modify the existing traffic signal and install a southbound right -turn overlap phase on Via Cortez. Eastbound U -Turns on Santa Ana Canyon Road shall be prohibited. Additionally, double left -turn phasing shall be implemented for the eastbound left -turn movement, or an equivalent signal timing improvement to reduce the eastbound left turn queue length. In addition, the property owner /developer shall install "Keep Clear" pavement legends in front of the commercial shopping center driveway entrance from Via Cortez to ensure that access to and from the shopping center is not obstructed by southbound traffic on Via Cortez. The owner /developer shall coordinate with the Public Works Department, Traffic Engineering Division prior to installing the pavement legends to ensure proper placement of the legends. Public Works, Traffic Engineering Division 42 Prior to final building and zoning inspection, fire lanes shall be posted with "No Parking Any Time." Curbs adjacent to the drive aisles within fire lanes shall be painted red to prohibit parallel parking in the drive aisles. Said information shall be specifically shown on plans submitted for building permits. Subject property shall thereupon be developed and maintained in conformance with said plans. Public Works, Traffic Engineering Division 43 The business shall be equipped with an alarm system (silent or audible). Police Department 44 Address numbers shall be positioned so as to be readily readable from the street. Numbers should be visible during hours of darkness. Police Department 45 Complete a Burglary /Robbery Alarm Permit application, Form APD 516, and return it to the Police Department prior to initial alarm activation.
