A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE ANAHEIM DIRECTOR OF
PUBLIC WORKS OR HER DESIGNEE TO SUBMIT A GRANT
APPLICATION ON BEHALF OF THE CITY OF ANAHEIM TO
OCTA FOR MEASURE M2 PROJECT S (TRANSIT
EXTENSIONS TO METROLINK) FUNDING AND IF
AWARDED, AUTHORIZING THE ACCEPTANCE OF SUCH
FUNDING ON BEHALF OF THE CITY AND AMENDING THE
BUDGET ACCORDINGLY
WHEREAS, Measure M2 Project S (Transit Extensions to Metrolink) is a competitive
transit program (the "Program ") to provide funding for local agencies to enhance regional transit
capabilities through the creation of new connections to Orange County Metrolink stations; and
WHEREAS, projects must meet specific criteria in order to compete for funding through
this Program; and
WHEREAS, on December 12, 2011, the Orange County Transportation Authority
( "OCTA ") Board of Directors approved the Measure M2 Project S Bus and Station Van Call for
Projects Guidelines which establishes the procedures and criteria for reviewing proposals; and
WHEREAS, on February 27, 2012 OCTA Board of Directors directed staff to issue the
2012 Project S Bus and Station Van Call for Projects and return with programming
recommendations in July 2012 (the "Grant "); and
WHEREAS, the City of Anaheim desires to submit an application for a new and
expanded bus service connecting the Anaheim Canyon Station to Downtown Anaheim and The
Anaheim ResortTM ( "Application "); and
WHEREAS, the City proposes the Anaheim Transportation Network ( "ATN ") serve as
the grant sub - recipient and the operator of the service outlined in the Application; and
WHEREAS, the City of Anaheim believes it meets the criteria set forth by OCTA
Measure M2 Project S Bus and Station Van Extension Guidelines to receive funding under this
Program; and
WHEREAS, the City of Anaheim has the ability to provide the local match requirement
(minimum of 11% of the capital cost identified in the Application) and fund the local share of
operations and maintenance as demonstrated in the Funding Plan in the Application; and
WHEREAS, the local match requirement outlined in the Funding Plan in the Application
is anticipated to be funded from the Anaheim Tourism Improvement District ( "ATID ") transit
funds or ATN's provision of a second Anaheim Resort Transit ( "ART ") bus subject to OCTA's
determination that this is an acceptable match component; and
WHEREAS, the City of Anaheim intends to request reimbursement from OCTA for up to
90% of the Operating and Maintenance costs from the service described in the Application as
allowed pursuant to the Measure M2 Project S Bus and Station Van Extension Guidelines; and
WHEREAS, the Application includes a five -year Funding Plan showing that the
Operations and Maintenance costs would be funded from a combination of ATN Metrolink
Reimbursement funds, AB2766 funds and reimbursement from OCTA for up to 90% of the
Operating and Maintenance costs and ATID funds; and
WHEREAS, the City is willing and able to conform to each of the terms, conditions and
limitations imposed upon any such Grant awarded to the City; and
WHEREAS, the City of Anaheim has determined that the services described in the
Application falls within the definition of Statutory Exemptions for Specified Mass Transit
Projects: 15275 (b) as defined in the State CEQA Guidelines, and is therefore, exempt from the
requirement to prepare additional environmental documentation; and
WHEREAS, the City desires to accept any such Grant which may be awarded to the City.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as
follows:
1. That the Anaheim Director of Public Works or her designee is hereby authorized
to submit the Grant Application for and on behalf of the City of Anaheim, a public entity
established under the laws of the State of California, and that the Anaheim Director of
Public Works or her designee is authorized to execute any actions necessary for the
purpose of obtaining the assistance provided by the Orange County Transportation
Authority, including any extensions and amendments thereof.
2. The City Council of the City of Anaheim hereby agrees to, and by this resolution,
does accept any such Grant so awarded to the City of Anaheim without further action of
the City Council being required therefore and further agrees to provide the minimum
eleven percent (11 %) matching funds by the Measure M2 Project S Bus and Station Van
Extension Guidelines.
3. The City of Anaheim hereby agrees to comply with each and all of the terms,
conditions and limitations imposed by OCTA upon said Grant, and the Anaheim
Director of Public Works or her designee is hereby authorized and directed to execute
any agreements, assurances, or other documents as may be necessary in connection with
the acceptance of said Grant as may be required by OCTA, if such Grant is awarded to
the City.

4. Contingent upon the award of said Grant, the annual budget of the City of
Anaheim is hereby amended by increasing revenue and expenditures in an amount equal
to the amount of the Grant Funds awarded.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the
City of Anaheim this 17th day of April , 2012, by the following roll call vote:
