RESOLUTION 2012- 101 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE SALE OF CERTAIN CITY OWNED PROPERTY LOCATED AT 2123 WEST SUNRISE AVENUE (APN 072 - 501 -02). WHEREAS, the City of Anaheim ( "City ") owns that certain real property, consisting of approximately 7,395 square feet, located at 2123 West Sunrise Avenue in the City of Anaheim, County of Orange, State of California, APN 072 - 501 -02 ( "Property"); and WHEREAS, the vacant remnant/surplus property is zoned Single - Family Residential and has a general plan designation of Low Density Residential; and WHEREAS, the Property is an abandoned water well site that has been destroyed pursuant to Well Completion Report No. 731217; and WHEREAS, the Property is no longer required for municipal use; and WHEREAS, an appraisal of the Property was conducted and determined that the fair market value of the Property to be $170,000.00; and WHEREAS, pursuant to California Government Code § §54222 — 54232 ( "Surplus Land Act "), the City provided a written offer to sell the Property to public agencies and City departments; and WHEREAS, no public agency or City department notified the City of its intention to purchase the Property within the Surplus Land Act's sixty (60) day notification period; and WHEREAS, Section 1222 of the City Charter states that no municipal real property with a fair market value in excess of Fifty Thousand Dollars ($50,000.00) be sold at not less than fair market value to the highest bidder after publication of a request for bids in a the official newspaper of the City; and WHEREAS, the City desires to proceed with the sale of the Property in accordance with the requirements of the Surplus Land Act. NOW, THEREFORE, BE IT RESOLVED that, in accordance with Section 1222 of the City Charter, the Property shall be advertised for sale and sold by sealed bid. Said bids shall be opened at 2:00 p.m. on September 25, 2012, in the Office of the City Clerk located at 200 South Anaheim Boulevard, 2nd Floor, Anaheim, CA 92805. All bids shall be accompanied by deposit in the form of a certified or cashier's check in the sum of at least ten percent (10 %) of the bid price. Notice is given that the City must reject any bid which does not equal or exceed the Property's appraised value of One Hundred and Seventy Thousand Dollars ($170,000.00) unless the City Council, by at least a two - thirds vote, determines that the sale of the Property at a lesser amount to be -1- in the best interests of the City of Anaheim. BE IT FURTHER RESOLVED that the City Clerk shall open said bids and forward qualified bids to the Director of Public Works for evaluation and recommendation of the bid to be accepted by the City Council. The City reserves the right to reject any and all bids.
