A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. la.04 BE GR~ITED
WHEREAS, the Ci~ Planni.g Commission of the City of Anaheim ~drec~ve a verified Pe~tion Mr Variance ~om
RINKER DEVF~OPMENT CORPORATION, 10600 Katella Avenue, Anaheim, California, Ovmers of certain
real property si'tuated in the City of Anaheim. County of Orange, State of California, as
oescribed in Exhibit "A" attached hereto and referred to herein as though set forth in full
; and
WHEREAS, the City Planning Commission did bold a public hearing at the City Hal] in the City of Anaheim on
July 6, 1966~ at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by
law amd in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for
and against said proposed variance and to investigate and make findings and recommendations in connection therewith;
and
WHEREAS, said Commission. after due inspection, investigation, and study made by itself and in its behalf,
and after due consideration of all evidence and reports offered as said hearing, does find and determine the following
fncis:
1. That the petitioner requests a variance from tile Anaheim Municipal Code: to permit the establishment of
a single family subdivision on R-2 Zoned pro~erty with waivers of:
SE.CTION 18.2~..030~a) - 7200 square foot mini,,~um building site area required - 5000 square foot site area proposed.
S£LTION t8o2ao030~9) - 70 foot lot widths required - 50 foot lot widths proposed.
SE~'flON 18.24.030~1) - 25 foot front yard setback required ~ 10 foot front yard
setback proposed.

2. That there are exceptional or extraordinary circumstances or conditions applicable
· to the property involved or ta th~ intended us~ of the property that do not apply 9ene~-ally
to the property or class of use in the saae vicinity and zone.
3. That the requested variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity and zone~ and den!e~
to the property in question.
ao That the requested variance will not be materially detrimental to the public welfare
or inaurious to the property or improvements in suck vicinity and zone in which the property is
iOCd'~ed.
5. That property to the south and west is now being developed with similar ~ubdivision
of the property, therefore~ tile request for the above waiVe~ it reasonsble.
6. That the proposed subdivision offers an alternative method of developing property
considered appropriate for low-medium density, and the proposed subdivision would provide
privacy to property owners which could not be accomplished if subject property were developed
for Multiple Family Residential use.
7. That no one appeared in opposition to subaect petition.

NOW, THEREFORE, SE IT RESOLVED thet the Anaheim City Planning Commission does hereby grant subject
Petition for Veriance, upon the following conditions which are hereby found to be a necessary prerequisite to the pro-
posed use of the subject property in order to preserve t~e safety and generel welfare of the Citizens of the City of
Anaheim.
