AN ORDINANCE OF THE CITY OF ANAHEIM
ADOPTING AMENDMENT NO. 3 TO SPECIFIC PLAN
NO. 88-1, EXHIBIT A (THE SYCAMORE CANYON
SPECIFIC PLAN)
WHEREAS, pursuant to the procedures set forth in
Chapter 18.93 of the Anaheim Municipal Code, the City Council
of the City of Anaheim has heretofore adopted its Resolution
No. 88R-69 approving Specific Plan No. 88-1 and Resolution No.
88R-70 approving Zoning and Development Standards Relating to
Specific Plan 88-1 (the Sycamore Canyon Specific Plan) , which
resolutions have been amended from time to time; and
WHEREAS, pursuant to said procedures, the City
Council further adopted Ordinance No. 4910 amending the zoning
map to reclassify certain real property described therein into
the Sycamore Canyon Specific Plan No. 89-1 Zone subject to
certain conditions as specified therein, and Ordinance No.
4909 relating to establishment of zoning and development
standards for Specific Plan No. 89-1 by the addition of
Chapter 18.71 to said Code, which ordinances have been amended
from time to time; and
WHEREAS, Exhibit A of the Sycamore Canyon Specific
.Plan, as previously amended, provides for development of up to
1,204 residential dwelling units, 20 acres of commercial uses,
133 acres of general open space and certain public facilities
on property consisting of 329 acres located on both sides of
Weir Canyon Road approximately 1,650 feet southeast of Santa
Ana Canyon Road; and Exhibit Nos. 4 and 12 contained in the
Sycamore Canyon Specific Plan and the Public Facilities Plan,
including Exhibit No. 6, designate a site consisting of 1.87
acres located at the southerly terminus of Dream Street
approximately 344 feet south of Monte Vista Road and further
described as 8186 South Dream Street, as a Police Substation
site; and
WHEREAS, in November 1998, an election was conducted
for the residents of the three planned communities consisting
of Sycamore Canyon, Summit of Anaheim Hills and The Highlands
at Anaheim Hills to determine whether Mello -Roos funds
collected from the three participating community facility
districts should be used to purchase and construct a Police
Substation facility outside the Sycamore Canyon Specific Plan
area boundary; and
WHEREAS, the residents voted to allow the City of
Anaheim to purchase the former Anaheim Memorial Medical Office
Building at 8165 - 8195 East Santa Ana Canyon Road (a 6 -acre
property having a frontage of 660 feet on the north side of

WHEREAS pursuant to the procedures set forth in Chap-

WHEREAS, the proposed amendments include deleting
references to the Police Substation from Exhibit No. 4 "Land
Use Plan" and Exhibit No. 12 "Specific Plan" of the Specific
Plan document and from the Public Facilities Plan, including
Exhibit No. 6 "Open Space and Recreation Plan"; and re-
place the site designated for a Police Substation on each of
those exhibits with the General Open Space land use desig-
nation; and
WHEREAS, the City Planning Commission did hold a pub- j
lic hearing at the Civic Center in the City of Anaheim on No-
vember 20, 2000, at 1:30 p.m., notice ofsaid public hearing
having been duly given to hear and consider evidence for
and against said proposed Amendment No. 3 and to investi-
gate and make findings and recommendations in connec-
tion therewith; and
WHEREAS, said Commission, after due inspection, investi
gation and study made by itself and in its behalf, ani' after �
due consideration of all evidence and reports offered at said
hearing adopted its Resolution No. PC2000-132 recommend

Plan No. 88-1 be approved; and
WHEREAS, the City Council of the City of Anaheim did
hold a duly noticed public hearing on JAnuary 9, 2001, to
consider the recommendation of the Planning Commission
regarding the approval of Amendment No. 3 to Specific
Plan No. 88-1, notice of which hearing was given in the man-
ner required by law; and
WHEREAS, the Anaheim City Council has reviewed
Amendment No. 3 to Specific Plan No. 88-1, Exhibit A (the
Sycamore Canyon Specific Plan), to amend Exhibit Nos. 4
and 12 of the Specific Plan, and to amend the Public Facili-
ties Plan, including Exhibit No. 6, to remove the Police Sub-
station designation from a site consisting of 1.87 acres locat.:
ed at the southerly terminus of Dream Street approximately
344 feet south of Monte Vista Road and further described as
8186 South Dream Street, and to redesignate said site for
General Open Space land use; and does hereby approve
the Negative Declaration upon finding that the declaration re I
flects the independent judgement of the lead agency and
that it has considered the Negative Declaration together
with any comments received during the public review proc-
ess and further finding on the basis of the initial study and
any comments received that there is no substantial evi-
dence that the project will have a significant effect on the en-
vironment; and
WHEREAS, the City Council desires to amend the specific
plan to redesignate the 1.87 -acre site at 8186 South Dream
Street for General Open Space land uses until such time as
a future development proposal is received and considered
by the City; and
WHEREAS, the City Council has compliedwith the proce-
dures set forth in Chapter 18.93.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY
OF ANAHEIM DOES ORDAIN AS FOLLOWS:
SECTION 1.
That the City Council of the City of Anaheim does hereby
adopt Amendment No. 3 to Specific Plan No, 88-1, Exhibit A.
(the Sycamore Canyon Specific Plan), to amend Exhibit
Nos. 4 and 12 of the Sycamore Canyon Spec'rfic Plan and
does hereby amend the Public Facilities Plan, including d
hibit No. 6, to delete the Police Substation designation from

SECTION t
That except as expressly amended herein Ordaiance
Nos. 4909 and 4910, as previously amended, shall re-,fi- rr
full force and effect.
SECTION 3. SEVERABILITY
The City Council of the City of Anaheim hereby eeclare
that should any section, paragraph, sentence w vorc
this ordinance of the Code hereby adopteobe declares
for any reason to be invalid, it is the intent of the Cou—'-
that it would have passed all other portions of this ordi-
nance independent of the elimination heref,om of any u -
portion as may be declared Invalid.
SECTION 4. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal c,
any other ordinance of this City shall in any manner affed
the prosecution for violations of ordinances, which viola
tions were committed prior to the effective date hereof. ca
be construed as a waiver of any license or penalty or the pe
nal provisions applicable to any violation thereof. The pro,
cions of this ordinance, insofar as they are substantially the
same as ordinance provisions previously adopted by lhe
City relating to the same subject matter, shall be construed
as restatements and continuations. and not as neve
enactments.
