ORDINANCE NO. 1561
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDIT40
TITLE 4 OF THE ANAHEIM MUNICIPAL CODE BY
ADDING A CHAPTER THERETO ENTITLED, "CHAPTER
4.02 SPECIAL EVENTS."
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN
AS FOLLOWS:
SECTION 1.
That Title 4 of the Anaheim Municipal Code is hereby
amended by adding thereto a chapter designated as Chapter 4.02
"SPECIAL EVENTS," which shall read as follows:
"CHAPTER 4.02 SPECIAL EVENTS
"SECTION 4.02.010 SPECIAL EVENT DEFINED. A Special event
is any event sponsored by a business or shopping center which
is held outside the confines of the building, whether or not
a business license is required, and which may include rides,
games, booths, or similar amusement devices, whether or not
a fee or admission is charged for such event.
"SECTION 4.02.020 PERMIT REQUIRED. No person or organization
shall conduct a Special Event without having first applied
for and obtained a permit so to do as provided in this
chapter.
"SECTION 4.02.030 APPLICATION FOR PERMIT. Application for
permits to conduct Special Events shall be in writing and
shall be filed with the City Manager not less than fourteen
(14) days prior to the opening date of such event. Such
application shall state: The name of the sponsoring business
or organization; the exact location where the event is to be
staged; the name and address of the operator or operators
of the event to be conducted; a list of communities in
California where the event has previously been conducted by
the operators of the proposed event; the number and types of
riles, games, shows, displays, and other individual concessions
comprising the event; the number of persons who will be
engaged in conducting the event; and such other information
as shall be required by the City Manager.
"SECTION 4.02.040 INVESTIGATION OF APPLICATION. Before
issuing a permit for a Special Event, the City Manager shall
cause an investigation to be made regarding the application
and shall have the findings set forth in writing and attached
to the application.
"SECTION 4.02.050 ISSUANCE OR DENIAL OF. PERMIT. If the
City Manager determines, after the investigation, that all
applicable provisions of the law and of the Anaheim Municipal
Code, including the provisions of this chapter, are or will
be complied with and that the granting of the permit will
not be detrimental to the public safety, then he shall
issue a permit; otherwise, the application shall be denied.
"SECTION 4.02.060 REGULATIONS FOR CONDUCT OF SPECIAL EVENT.
The following regulations shall govern the operation of any
Special Event for which a permit has been issued by the City

Manager, and violation of any such regulation shall be
grounds for immediate revocation of such permit:
1. No structure for amusement device, shall exceed
the height of the adjoining business structures
or thirty (30) feet whichever is the lesser
height.
2. No wild or ferocious animals shall be displayed.
3. All regulations imposed by the Police and Fire
Departments for safety, health and the general
welfare must be complied with.
4. The physical layout of the area set apart for
the conduct of the Special Event, including
area used for installation or storage of all
equipment, shall be such that the parking area
designed to serve the business or shopping center
is not reduced below the minimum required for
such business or shopping center by the provisions
of the Anaheim Municipal Code.
5. Before erection of any structures, including
structures for amusement devices and rides,
application must be made to the Building and
Electrical Departments and all applicable building
and electrical regulations must be complied
with. For all rides certificates of safety must
be furnished to the Building Department, and
no rides, amusement devices or concessions
shall be put into operation until 'inspected and
cleared by the Building and/or Electrical
Department.
6. No trailers, tents or other temporary living
quarters will be allowed on the premises where
the Special Event is to be conducted.
7. The conduct of the Special Event shall be confined
to the hours when the business establishment or
shopping center is open for business, and in
no event shall the Special Event be operated
after 9:30 P.M. of any night.
8. The Special Event shall not be operated for any
period longer than fourteen (14) calendar days
from the permitted opening date as specified
in the permit.
"SECTION 4.02.070 LIABILITY AND PROPERTY DAMAGE INSURANCE.
Prior to the erection of any structure in connection with
a Special Event, the operator or operators of said event
shall furnish certificates to the City Manager showing
that there is in full force and effect liability and
property damage insurance covering every activity of the
proposed Special Event in a minimum amount of $100,000
for injury of one person and $300,000 for death or injury
of more than one person in any accident and $25,000
property damage, or, in such additional amount as deemed
necessary by the City Manager.
"SECTION 4.02.060 POWERS OF CITY COUNCIL. The City
Council of the City of Anaheim shall have the power to
review any action taken by the City Manager in denying

any application for a permit and shall have the power
to revoke a permit granted by the City Manager when,
in the opinion of the City Council, such action on
their part is in the public interest.
The City Council shall also have the power to modify or
waive any regulation as specified in Section 4.02.050
with regard to any specific application when such mod-
ification or waiver would be in the best public interest.
When the City Council has acted upon any application
for a Special Event, all of the regulations set forth
in Section 4.02.050 shall apply to such Special Event
unless some regulation set forth therein is expressly
waived or modified and, in:such event, the regulations
shall apply as specified by the City Council in their
action.
The City Council shall also have the exclusive power
to grant a renewal or extension of a permit beyond the
original 14 -day period.
Any action of the City Council shall be taken in a public
meeting, but no notice or public hearing shall be
necessary before such action is taken."
SECTION 2.
The City Clerk shall certify to the passage of this
ordinance and shall cause the same to be published once within
fifteen (15) days after its adoption, in the Anaheim Bulletin,
a newspaper of general circulation, printed, published and
circulated in said City, and thirty (.30) days from and after
its final passage, it shall take effect and be in full force.
THE FOREGOING ORDINANCE is approved and signed by
