A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AUTHORIZING THE CITY ATTORNEY TO
WAIVE OUTSIDE LAW FIRM'S PROFESSIONAL /ETHICAL
CONFLICTS AND EXECUTE CONFLICT WAIVER
REQUESTS
WHEREAS, the City of Anaheim from time to time enters into agreements with private
law firms to provide legal services to the City, as permitted by City Charter Section 703; and
WHEREAS, these private law firms, on occasion, ask the City Attorney's Office to waive
professional /ethical conflicts or potential conflicts arising out of services the firm has performed
for other clients; and
WHEREAS, the City Attorney's Office is in the best position to determine if a conflict
should be waived as governed by the California Rules of Professional Conduct and, before
agreeing to waive any disclosed conflict, determine that the waiver would not detrimentally
impact the interests of the City; and
WHEREAS, at the request of and pursuant to delegated authority from the City Council,
the City Attorney's Office has an historical and established practice of executing conflict waiver
requests without bringing those requests to the City Council after conducting due diligence to
ensure that such a waiver will not adversely impact the interests of the City; and
WHEREAS, the City Attorney's Office desires to memorialize this longstanding
historical delegated authority in resolution form.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as
follows:
1. The City Attorney of the City of Anaheim is authorized to waive
professional /ethical conflicts or potential conflicts and execute related conflict
waiver requests upon a law firm disclosing such conflicts.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the
City of Anaheim this 26th day of March , 2013, by the following roll call vote:
