A RESOLUTION OF THE ANAHEIM PLANNING COMMISSION
APPROVING RECLASSIFICATION NO. 2013-00252 AND MAKING
CERTAIN FINDINGS IN CONNECTION THEREWITH.

WHEREAS, the Plannin Commission of the Cit of Anaheim (the "Plannin
Commission" did receive a verified petition for reclassification, desi as Reclassification
No. 2013-00252, for that certain real propert located at 2726 West Lincoln Avenue, in the Cit
of Anaheim, Count of Oran State of California, as g enerall y depicted on Exhibit A attached
hereto and incorporated herein b this reference (the "Propert and
WHEREAS, the Propert is currentl developed with a plant nurser and is
located in the T (Transition) Zone. The Anaheim General Plan desi this Propert for
Medium Densit Residential land uses; and
WHEREAS, the applicant re to rezone the propert from the T (Transition)
Zone to the RM-4 (Multiple-Famil Residential) Zone; and
WHEREAS, on Ma 6, 2013, the Plannin Commission did hold a public hearin
at the Civic Center in the Cit of Anaheim, notice of said public hearin havin been dul g iven
as re b law and in accordance with the provisions of Chapter 18.60 (Procedures) of the
Anaheim Municipal Code (the "Code"), to hear and consider evidence for and a said
proposed Reclassification No. 2013-00252 and to investi and make findin and
recommendations in connection therewith; and
WHEREAS, as the "lead a under the California Environmental Qualit Act
(Public Resources Code Section 21000 et se herein referred to as "CEQA"), the Plannin
Commission finds and determines that Environmental Impact Report No. 330 ("EIR 330"
certified in conjunction with the Cit General Plan Update pro is all that is necessar in
connection with the proposed reclassification of the Propert and its approval and that none of
the conditions set forth in Sections 15162 or 15163 of the State CEQA Guidelines callin for the
preparation of a subse environmental impact report or a supplement to EIR 330 have occurred;

WHEREAS, the Plannin Commission, after due inspection, investi and
stud made b itself and in its behalf, and after due consideration of all evidence and reports
offered at said heariner
does find and determine the followin facts:
I. Reclassification of the Propert from the T (Transition) Zone to the RM-4
(Multiple-Famil Residential) Zone is consistent with the Propert existin Medium Densit
Residential land use desi in the General Plan.
2. The proposed reclassification of the Propert is necessar and/or desirable
for the orderl and proper development of the communit and is compatible with the adjacent
propert to the east, which is desi for Medium Densit Residential land uses and is
developed with apartments.

3. The proposed reclassification of the Property does properly relate to the zone
and its permitted uses locally established in close proximity to the Property and to the zones and
their permitted uses generally established throughout the community.
NOW, THEREFORE, BE IT RESOLVED, that the Planning Commission does
hereby unconditionally approve Reclassification No. 2013 -00252 to authorize an amendment to
the Zoning Map of the Anaheim Municipal Code to rezone and reclassify the Property into the
RM -4 (Multiple - Family Residential) Zone.
BE IT FURTHER RESOLVED, that this Resolution shall not constitute a
rezoning of, or a commitment by the City to rezone, the Property; any such rezoning shall require
an ordinance of the City Council, which shall be a legislative act, which may be approved or
denied by the City Council at its sole discretion.
THE FOREGOING RESOLUTION was adopted at the Planning Commission
meeting of May 6, 2013.
