IDA82-01RESOLUTION NO. IDAA 82-1 A RESOLUTION OF THE INDUSTRIAL DEVELOPMENT AUTH- ORITY OF ANAHEIM ADOPTING A CONFLICT OF INTEREST CODE; SUBMITTING SAID CODE TO THE CODE REVIEWING BODY; AND RESCINDING RESOLUTION NO. IDAA 81-3. WHEREAS, Section 87300 of the Government Code requires local government agencies to adopt a Conflict of Interest Code; and WHEREAS, Section 83303 of the Government Code requires local government agencies to submit their Conflict of Interest Code to a code reviewing body; and WHEREAS, the legal staff of the Fair Political Practices Commission of the State of California has advised that the City Council of the City of Anaheim is the code reviewing body of the IDAA Conflict of Interest Code; and WHEREAS, the Conflict of Interest Code adopted by Resolution No. IDAA 81-3 and transmitted to the Board of Supervisors of the County of Orange for review has been returned by the County without having been reviewed by the County; and WHEREAS, the legal staff of the County of Orange indicates that the City Council of the City of Anaheim is the code reviewing body of the IDAA. NOW, THEREFORE, BE IT RESOLVED as follows: The IDAA does hereby adopt the Conflict of Interest Code, consisting of four (4) pages, attached hereto as Exhibit e The Secretary is hereby authorized and directed to transmit said Conflict of Interest Code to the City Council of the City of Anaheim for review and approval. e The Conflict of Interest Code shall become effective upon approval of said Code by the City Council of the City of Anaheim. Resolution No. IDAA 81-3 and the Conflict of Interest Code adopted thereby are hereby rescinded. ATTEST: ~T~Y CLERK O~ ~HE-CITY OF ANAHEIM CONFLICT OF INTEREST CODE OF THE INDUSTRIAL DEVELOPMENT AUTHORITY OF ANAHEIM I. Purpose. Pursuant to the provisions of Government Code Section 87300, et seq., the Industrial Development Authority of Anaheim, (hereinafter "IDAA') hereby adopts the following Conflict of Interest Code. Nothing contained herein is intended to modify or abridge the provisions of the Political Reform Act of 1974 (Government Code Section 81000, et seq.). The provisions of this Code are additional to Government Code Section 87100, et seq. and other laws pertaining to conflicts of interest. Except as other- wise indicated, the definitions of said Act and regulations adopted pursuant thereto are incorporated herein and this Code shall be interpreted in a manner consistent therewith. II. Designated Positions. The positions listed on Exhibit "A" are designated positions. Persons holding designated posi- tions are deemed to make, or participate in the making of, deci- sions which may foreseeably have a material effect on a financial interest of that person. III. Disqualification. No person holding a designated posi- tion shall make, participate in the making of, or use his or her official position to influence the making of any governmental decision which will foreseeably have a material financial effect, distinguishable from its effect on the public generally, on: -~-- A. Any business entity in which the member has a direct or indirect investment worth more than one thousand dollars ($1,000); B. Any real property in which the member has a direct or indirect interest worth more than one thousand dollars ($1,000); C. ..Any source of income, other than loans by a commer- cial lending institution in the regular course of business on terms available to the public without regard to official status, aggregating two hundred fifty dollars ($250) or more in value pro- vided to, received by, or promised to the member within twelve months prior to the time when the decision is made; or D. Any business entity in which the member is a direc- tor, officer, partner, trustee, employee, or holds any position of management. No IDAA member shall be prevented from making or partici- pating in the making of any decision to the extent his or her participation is legally required for the decision to be made. The fact that the vote of a member who is on a voting body is needed to break a tie does not make his or her participation legally required for purposes of this section. For purposes of this section, indirect investment or in- terest means any investment or interest owned by the spouse or dependent child of a member, by an agent on behalf of a member or by a business entity or trust in which the member, the member's agents, spouse and dependent children own directly, indirectly, or beneficially a 10-percent interest or greater. -2- IV. Financial Disclosure. Persons holding designated posi- tions are required to disclose their financial interests pursuant to conflict of interest codes adopted by other entities.
