RES-2013-154RESOLUTION NO. 201 3 -15 4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM AUTHORIZING THE HUMAN RESOURCES DIRECTOR TO ENTER INTO SETTLEMENT AGREEMENTS WHERE THE COMPENSATION EXCHANGED IS LESS THAN TEN THOUSAND DOLLARS WHEREAS, Chapter 1.06 of the Anaheim Municipal Code provides for the establishment and administration of an employer- employee relations system in the City; and WHEREAS, Section 1.06.020 provides that the employer - employee relations system shall be administered by a City Management Representative designated by the City Manager, who shall serve as the City's principal management representative in all matters of employer - employee relations, shall administer all of the provisions of Chapter 1.06, and is authorized to delegate the duties and powers conveyed under Chapter 1.06; and WHEREAS, the Human Resources Director has been designated as the City Management Representative since Chapter 1.06 was adopted, and, in that capacity, has administered the employer - employee relations system of the City, has met and conferred and executed memoranda of understanding with recognized employee organizations, and has exercised City Management rights pursuant to Section 1.06.040, including, but not limited to, the right to take disciplinary action, resolve employee grievances, relieve employees from duty for legitimate reasons, and determine the method, means and personnel by which City operations are conducted; and WHEREAS, as the City Management Representative charged with administering and overseeing all matters of employer - employee relations, the Human Resources Director exercises substantial judgment and discretion on behalf of the City and is in a position to resolve employee grievance and disputes expeditiously, economically and prior to any undue escalation; and WHEREAS, the City Council has previously delegated to the Human Resources Director /City Management Representative (hereinafter "Human Resources Director ") or his /her designee the authority to enter into settlement agreements with City employees and designated employee organizations, provided that either no monetary compensation or minimal monetary compensation is being paid by the City; and WHEREAS, the Human Resources Department desires to memorialize its longstanding, historical delegated authority in resolution form, including the authority of the Human Resources Director or his/her designee to enter into and execute settlement agreements with City employees on behalf of the City if no monetary compensation is being exchanged, or if the amount of compensation being paid by the City is less than Ten Thousand Dollars ($10,000.00). NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as follows: I . The Human Resources Director of the City of Anaheim or his/her designee is authorized to enter into and execute settlement agreements with City employees on behalf of the City if no monetary compensation is being exchanged, or if the amount of compensation being paid by the City is less than Ten Thousand Dollars ($10,000.00).
