A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM RELATING TO THE INADEQUACY OF PUBLIC LANDS
IN THE VICINITY OF RIVERDALE ELEMENTARY SCHOOL SITE
TO MEET THE EXISTING AND FORESEEABLE NEEDS OF THE
COMMUNITY FOR PLAYGROUND, PLAYING FIELD, AND
OTHER OUTDOOR RECREATIONAL AND OPEN -SPACE
PURPOSES; AUTHORIZATION PERMITTING THE CITY
MANAGER ON BEHALF OF THE CITY TO EXPRESS INTEREST IN
NEGOTIATING POTENTIAL ACQUISITION OF THE RIVERDALE
ELEMENTARY SCHOOL SITE PURSUANT TO NAYLOR ACT;
AND DETERMINATION THAT SAID ACTION IS EXEMPT FROM
THE PROVISIONS OF THE CALIFORNIA ENVIRONMENTAL
QUALITY ACT (CEQA) UNDER SECTION 15004(B)(2)(A) OF THE
STATE CEQA GUIDELINES.
WHEREAS, on February 25, 2014, the City of Anaheim ( "City ") received notice
from the Orange Unified School District ( "District ") of the District's intent to sell its property
interest in certain real property consisting of approximately 11.54 acres of land located at 4540
East Riverdale Avenue, Anaheim California 92807, known generally as the District's former
Riverdale Elementary School site (the "Property"); and
WHEREAS, the whole or a portion of the Property consists of land which is used
for playground, playing field, and other outdoor recreational purposes and open -space land
particularly suited for recreational purposes; and
WHEREAS, the Property has been used for school playground, playing field, or
other outdoor recreational purposes and open -space land for at least eight (8) years immediately
preceding the determination of the District's Board of Trustees to sell the Property; and
WHEREAS, there is no other available publicly owned land in the vicinity of the
Property that is adequate to meet the existing and foreseeable needs of the community for
playground, playing field, or other outdoor recreational and open -space purposes because, as
further described in the associated Staff Report, the demand by the public to use existing athletic
field use far exceeds the number of available fields in the eastern part of the City where this
school site is located; and
WHEREAS, pursuant to the Naylor Act as codified in California Education Code
Section 17485 e seq., the City has priority to purchase the Property due to the fact that it includes
land used for school playground, playing field, or other outdoor recreational purposes and open -
space land particularly suited for recreational purposes, and the City has assumed that the
Property would be permanently available for recreational purposes.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim as follows:
1. The City Council finds and determines that for the reasons set forth in the
recitals above and as further provided in the associated Staff Report, which recitals and
conclusions in the staff report are incorporated by this reference, public land in the vicinity of the
Property is inadequate to meet the existing and foreseeable needs of the community for
playground, playing field, and other outdoor recreational open -space purposes.
2. The City Manager or his/her designee is hereby authorized to notify the
District of the City's intention to negotiate for the acquisition of the Property pursuant to the
Naylor Act.
3. The action of City Manager or his/her designee notifying the District of
City's intention to negotiate for the acquisition of the Property is exempt from the provisions of
CEQA under Section 15004(b)(2)(A) of the State CEQA Guidelines because any subsequent
action taken by the City Council with respect to the future use of the Property shall be
preceded by, and is conditional and contingent upon, environmental assessment and review
under, and in compliance with, CEQA.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 22nd day of April , 2014, by the following roll call
vote:
