97-090RESOLUTION NO. 97R -90 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM ADOPTING THE POLICIES ESTABLISHED BY THE ANAHEIM LIBRARY BOARD FOR THE USE OF LIBRARY COMMUNITY MEETING ROOMS AND THE FEES AND CHARGES REQUIRED PURSUANT THERETO, AMENDING RESOLUTION NO. 66R -286 AND RESCINDING CERTAIN OTHER RESOLUTIONS WHEREAS, the Library Board of the City of Anaheim has previously established policies governing the use of the community meeting rooms at the various City public libraries, which policies have been previously approved by the City Council by Resolution No. 66R -286 and amended from time to time by other Resolultions; and WHEREAS, the City Council has established fees and charges for the use of Library Community Meeting Rooms through Resolutions, as amended from time to time by the City Council; and WHEREAS, the Library Board has recommended, at its meeting on April 30, 1997, that the City Council adopt a resolution establishing new policies and fees governing the use of the library community meeting rooms; and WHEREAS, it is in the best interests of the City of Anaheim to establish and approve the policies recommended by the Library Board for the use of the meeting rooms at the Anaheim public libraries by amending Resolution No. 66R -286; and WHEREAS, the fees hereinafter adopted do not exceed the estimated reasonable cost of providing the service for which the fee is charged; and WHEREAS, the following fees have been considered at a duly noticed public hearing. WHEREAS, it is in the best interests of the City of Anaheim to establish and approve fees and charges for use of Library Community Meeting Rooms. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim that the attached Anaheim Public Library Policies Governing the Public's Use of Community Meeting Rooms and setting fees and charges in connection therewith be, and the same are hereby adopted. The policies attached hereto are incorporated herein by this reference as though the same were set forth in full BE IT FURTHER RESOLVED that Resolution No. 66R -286 is hereby amended and that Resolutions No. 79R -139, 82R -411, 8SR -76 and 92R -133 and 94R -225 are hereby rescinded and that any other Resolutions that are inconsistent herewith are hereby superseded. CITY CLERK OF THE CITY OF ANAHEIM ANAHEIM PUBLIC LIBRARY POLICIES GOVERNING THE PUBLIC'S USE OF COMMUNITY MEETING ROOMS As the Libraries are City facilities priority shall be given to City of Anaheim uses. The meeting rooms are available for public use within the provisions of the following policies. Failure to adhere to the policies governing the use of the meeting rooms will result in use privileges being revoked or denied. 1. A completed application along with other applicable paperwork and full payment for use of the room must be received by the library two months prior to the date of the use of the room. Rooms may be scheduled for up to a year in advance. Refunds will not be available unless a notice of cancellation is received by the library at least seven days in advance of the scheduled date for the use of the room. The library reserves the right to levy a special charge for unusual setups. 2. Pursuant to Resolution 97R- prepared by the City Council of the City of Anaheim, the following charges apply for the usage of each library meeting room for each four hour period within the normal operating hours of the library unless otherwise indicated: Non profit, charitable (Anaheim based) Non profit, other, one (1) room used two (2) rooms used three (3) rooms used For profit (Anaheim business license) one (1) room used two (2) rooms used three (3) rooms used For profit (non Anaheim business license) one (I) room used two (2) rooms used three (3) rooms used Before /After hours fee Cleaning/Damage deposit No charge $20.00 $30.00 $40.00 $45.00 $55.00 $65.00 $60.00 $80.00 $100.00 $35.00 each additional hour $35.00 /use 3. The person signing the application must be at least 18 years of age and a representative of the group /organization in a position of authority. 4. The Anaheim Public Library reserves the right to pre -empt previously scheduled meetings needed for City use provided 48 hours notice of cancellation is given. 5. Permission to serve refreshments in the meeting rooms must be requested at the time of application and only the meeting room equipment can be used. A refundable charge of a $35.00 cleaning/damage deposit will be required in relation to the request to serve refreshments. If a coffee setup is desired, there is an initial charge of $5.00 for the first coffee setup to include cups, cream and sugar, with additional coffee packets at a cost of $2.50 each. 04/30/97 6. Applicants must be willing to accept responsibility for the use of the meeting rooms and for the condition in which they are left and may be held liable for any damages. Users are expected to exercise reasonable care and to leave the meeting rooms in the same condition in which they were occupied. Failure to comply will result in forfeiture of future use. A refundable cleaning/damage deposit of $35.00 will be charged if the proposed use of the room involves products that could potentially damage the premises such as paint, clay, etc. Additional charges could be assessed if the damage to the room exceeds the $35.00 deposit. The deposit will be returned if the room is in no worse condition than it was at the time of occupation. 7. No admission fees may be charged, items sold, or fund raising conducted in connection with the use of these rooms 8. The meeting rooms are available during the times and days when the libraries are open for public use. Prior arrangements need to be made if a group needs to utilize a community meeting room prior to or after normal business hours of the library. A before /after hours fee of $35.00 per hour will be charged for each use and is due at the same time the rental fee is due. 9. Requests for the use of these meeting rooms will be denied when such use is determined to be contrary to State or Federal law or local ordinance; or when inconsistent with the proper and regular use of the library. 10. Applicants using any meeting room of the Anaheim Public Library more than twice in any given month shall furnish to the City of Anaheim public liability and property damage insurance naming the City as an additional insured in a minimal amount of one million dollars ($1,000,000) for each and every separate use. The City's Risk Manager is authorized to reduce the requirements set forth herein in the event he determines that such a reduction is in the City's best interest. 11. All applicants using any library meeting room shall be required to personally execute a hold harmless agreement which will protect the City of Anaheim from any and all liability arising from the use and occupancy of the premises.
