Mayor Roth called the Special Meeting to order at 2:00 p.m. on September 5,
1986, noting that written "Notice of Special Meeting" had been authorized by
him at 3:30 p.m. on September 3, 1986, and delivered to news media and all
five Council Members 24 hours in advance of this special meeting in accordance
with Section 507 of the City Charter.
City Attorney Jack White requested a Closed Session to consider litigation
matters as named in the "Notice of Special Meeting" with Golden West Baseball
Company, Orange County Superior Court Case Nos. 40-92-46, 44-98-97, 46-23-88
and 46-31-03.
RECESS- CLOSED SESSION: Mayor Roth moved to recess to closed session to
discuss matters relating to litigation as articulated by the City Attorney.
Councilman Pickler seconded the motion. (Councilman 0verholt absent.) MOTION
CARRIED (2:05 P.M.)
AFTERRECESS: Mayor Roth called the meeting to order, all Council Members
being present. (2:15 P.M.)
123/112: GOLDEN WEST BASEBALL COMPANY SETTLEMENT AND RELEASE AGREEMENT:
Mayor Roth moved that the City Council approve (1) the Settlement and Release
Agreement; (2) the Second Amendment to Amended and Restated Lease Agreement;
(3) Agreement to Arbitrate all said agreements between City of Anaheim and
Golden West dated September 5, 1986; and that the City Council authorize the
Mayor and City Clerk to execute these for and on behalf of the City of
Anaheim. Councilman Bay seconded the motion. (Councilwoman Kaywood
abstained.) MOTION CARRIED.
At the invitation of the Mayor, Mr. Michael Schreter, Executive Vice
President, and Assistant Secretary, Golden West Baseball Company thanked the
City Council members on behalf of the Angels and Mr. Autry for approving these
agreements. He noted that during the negotiations leading to these agreements
there was a spirit of determination on both sides, wanting to make it work.
He voiced the opinion that there is now a superb opportunity to to work
together to continue Anaheim Stadium as the best baseball stadium in the
world. He especially thanked Irv Pickler and Don Roth for their enthusiasm,
optimism and leadership during the negotiations.
Mayor Roth announced that there would be a Press Conference regarding these
agreements at 4:00 P.M. at Anaheim Stadium.
There being no further business to address at the special meeting, Mayor Roth
moved to adjourn. Councilman Pickler seconded the motion. MOTION CARRIED.
