6302ORDINANCE NO. 6302 AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING THE ZONING MAP REFERRED TO IN TITLE 18 OF THE ANAHEIM MUNICIPAL CODE RELATING TO ZONING. (RECLASSIFICATION NO. 2012-00248) (DEV201 1 -00110) WHEREAS, following a duly noticed public hearing held on April 21, 2014, pursuant to the provisions of Chapter 18.60 of the Anaheim Municipal Code, the Planning Commission of the City of Anaheim (the "Planning Commission") did adopt its Resolution No. PC2014-033, determining that a change or changes in the zone or zones should be made to rezone or reclassify that certain real property located at 200 and 282 North Lemon Street, 107-127 West Lincoln Avenue and 120 West Cypress Street in the City of Anaheim, County of Orange, State of California, having Assessor's Parcel Nos. 255-081-01, 255-081-02, 255-081-03, 255-081-04, 255-081-05 and 255-081-06 and as generally depicted on the map attached hereto as Exhibit A and more particularly described on the legal description attached hereto as Exhibit B, both of which exhibits are incorporated herein by this reference (the "Property"); and WHEREAS, by the adoption of said Resolution No. PC2014-033, the Planning Commission determined that that portion of the Property commonly known as 120 West Cypress Street and having Assessor's Parcel No. 255-081-03 should be rezoned or reclassified from the "T" (Transition) Zone to the "C -G" (General Commercial) Zone; and WHEREAS, by the adoption of said Resolution No. PC2014-033, the Planning Commission also determined that that portion of the Property located to the west of and immediately adjacent to 120 West Cypress Street, which is similar in size and shape to the parcel making up the parcel commonly known as 120 West Cypress Street and fronts on West Cypress Street, should be rezoned or reclassified from the "T" (Transition) Zone to the "C -G" (General Commercial) Zone. Said real property is a part of that certain real property commonly known as 200 and 282 North Lemon Street, which is collectively identified as Assessor's Parcel No. 255- 081-01 and, except for the aforementioned reclassification of a portion of 200 and 282 North Lemon Street (Assessor's Parcel No. 255-081-01), is currently zoned as "C -G" (General Commercial); and WHEREAS, by the adoption of said Resolution No. PC2014-033, the Planning Commission also determined that the land use and development standards set forth in Chapter 18.32 (Mixed Use Overlay Zone) of Title 18 (Zoning) of the Anaheim Municipal Code should be applied to the Property in combination with the underlying zone, i.e., the "C -G" (General Commercial) Zone Property, meaning that the provisions of Chapter 18.32 (Mixed Use Overlay Zone) would apply in addition to and, where inconsistent with, supersede the corresponding regulations of the underlying zone. Accordingly, the Planning Commission determined that the Property should be rezoned or reclassified to the Mixed Use ("MU") Overlay Zone; and WHEREAS, by the adoption of this ordinance, the City Council of the City of Anaheim desires to ensure that the Property will have the same underlying zoning classification, i.e., "C- G" (General Commercial), combined with the Mixed Use ("MU") Overlay Zone; and WHEREAS, the proposed rezoning is consistent with the Anaheim General Plan, which designates the Property for Mixed Use land uses. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. That the Zoning Map referred to in Title 18 of the Anaheim Municipal Code be, and the same is hereby, amended by rezoning and reclassifying the entirety of the Property, as described above, into the "C -G" (General Commercial) Zone, combined with the Mixed Use ("MU") Overlay Zone. SECTION 2. The City Zoning Map shall be, and the same is hereby, amended and that portion of the above-described Property presently classified as "T" (Transition) shall be excluded from the zone in which it is now situated and incorporated in and made a part of the zone or zones as above set forth, and said City Zoning Map, as amended, is hereby adopted and the Planning Department is hereby directed to prepare a sectional zoning map to be added to the City Zoning Map showing the changes hereby approved and adopted. SECTION 3. CERTIFICATION The City Clerk shall certify to the passage of this ordinance and shall cause the same to be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper of general circulation, published and circulated in the City of Anaheim, and thirty (30) days from and after its final passage, it shall take effect and be in full force.
