A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM ACCEPTING CERTAIN DEEDS CONVEYING TO
THE CITY OF ANAHEIM CERTAIN INTERESTS IN REAL
PROPERTIES (CITY DEED NOS. 11741- 11750; 11755).
WHEREAS, certain deeds described in Exhibit "A" (individually "DEED" and
collectively "DEEDS ") and Exhibit `B" ( "LA PALMA DEED ")have been presented to the City of
Anaheim (hereinafter, "CITY" or "Anaheim "); and,
WHEREAS, the grantors of the DEEDS and the LA PALMA DEED have offered to
convey to the CITY certain real property interests in connection with their utility services or to fulfill
a development condition; and,
WHEREAS, the DEEDS and the LA PALMA DEED and the real property interests
therein will assist the CITY in providing utility services to the real properties of the grantors; and,
WHEREAS, the TIC Land Investment LLC (the "IRVINE COMPANY ") has
presented and offered to the CITY certain deeds in Exhibit "C" ( "IRVINE COMPANY DEEDS ")
and Exhibit D ( "TEMPORARY EASEMENT DEED ") to satisfy certain dedication requirements for
Mountain Park Development ( "Mountain Park Development ")in connection with paragraph 43 of City
Council Ordinance No. 5993 and that certain Amended & Restated Water Facility Design and
Installation Agreement for the Mountain Park Development dated July 12, 2011; and,
WHEREAS, the Mountain Park Development is located in the City of Anaheim, County
of Orange, State of California commonly known as the Mountain Park Specific Plan No. 90 -4 Zone; and,
WHEREAS, Exhibits "A ", "B ", "C ", and "D" are attached hereto and incorporated
herein by reference; these Exhibits describe the grantors, property interests conveyed and locations of
the properties.
WHEREAS, based on the foregoing, the Anaheim City Council does hereby find and
determine it is in the best interests of the CITY to accept the DEEDS, the LA PALMA DEED, the
IRVINE COMPANY DEEDS, and the TEMPORARY EASEMENT DEED.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim as follows:
1. The DEEDS, the LA PALMA DEED, the IRVINE COMPANY DEEDS, the
TEMPORARY EASEMENT DEED, and the real property interests contained therein are hereby
accepted by the CITY. In connection with the foregoing, the City Clerk is authorized to execute a
certificate of acceptance for the DEEDS, the LA PALMA DEED, and the IRVINE COMPANY
DEEDS.
2. Nothing herein shall be construed to be an acceptance of any parcel or
property into the CITY street system (Streets and Highways Code, Section 1806).
3. The Mayor is authorized to execute the LA PALMA DEED and the
TEMPORARY EASEMENT DEED.
4. The City Clerk is authorized and directed to cause the DEEDS and the LA
PALMA DEED to be recorded in the Office of the County Recorder of the County of Orange.
5. The IRVINE COMPANY or its title company is authorized and directed to
cause the IRVINE COMPANY DEEDS to be recorded in the Office of the County Recorder of the
County of Orange. Until recordation, the IRVINE COMPANY or its title company shall place the
IRVINE COMPANY DEEDS in escrow, and this recordation shall occur prior to the IRVINE
COMPANY's conveyance to the County of Orange of that portion of the Mountain Park
Development subject to the IRVINE COMPANY DEEDS.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the City
of Anaheim this 21 st Day of October , 2014, by the following roll call vote:
