ORDINANCE NO. 5548
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
TITLE 12 OF THE ANAHEIM MUNICIPAL CODE BY ADD-
ING THERETO A NEW CHAPTER 12.02 PERTAINING TO
AUTHORIZED ENCROACHMENTS IN CITY STREETS AND
EASEMENTS
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN
AS FOLLOWS:
SECTION 1.
That Title 12 of the Anaheim Municipal Code be, and the
same is hereby, amended by adding thereto a new Chapter 12.02 to
-- read as follows:
"Chapter 12.02 ENCROACHMENTS
12.02.010 ENCROACHMENTS AUTHORIZED
The Director of the Public Works
Department is authorized to issue written permits to
encroach in and upon public streets and utility ease-
ments; provided, however, that no such permit shall be
issued unless said permit is terminable on not more than
ninety (90) days notice. The decision of the Director of
Public Works approving or denying any such permit shall
be subject to review by the City Council upon the request
of any member of the City Council or upon the written
request of any interested person filed with the City
Clerk not later than fifteen (15) days following the date
of the Director's decision. The City Council may grant
encroachment permits which are terminable on longer than
ninety (90) days notice.
12.02.020 ENCROACHMENT PERMIT - APPLICATION FEE
No application for a permit to encroach
in or upon any public street or utility easement shall
be accepted unless accompanied by the Encroachment Permit
Application Fee. The amount of the Application Fee shall
be established by resolution of the City Council.
12.02.030 ENCROACHMENT PERMITS - LEGISLATIVE ACT
The grant of an encroachment permit shall be a
legislative act undertaken in the sole discretion of the
City. No notice or hearing shall be required to consider
an application for encroachment permit."

SECTION 2. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance of the Code, hereby adopted, be declared for any reason
to be invalid, it is the intent of the Council that it would have
passed all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 19th day of December,
1995.
