AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING SUBSECTION .060 OF, AND
ADDING SUBSECTION .065 TO, SECTION 15.02.090
OF CHAPTER 15.02 OF TITLE 15 OF THE ANAHEIM
MUNICIPAL CODE RELATING TO ROOF COVERINGS
(UNIFORM BUILDING CODE, 1991 EDITION,
SECTIONS 3201 AND 3203)
THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS
AS FOLLOWS:
SECTION 1.
That Subsection .060 of Section 15.02.090 of Chapter 15.02
of Title 15 be, and the same is hereby, amended to read as
follows:
11.060 Section 3201 (a) of the Uniform Building Code is
hereby amended to read as follows:
"Sec. 3201 (a) General. Notwithstanding any other
provision to the contrary, the roof covering of any
building hereafter constructed, regardless of occupancy
classification, including any re -roofing of an existing
building as specified in Chapter 32 of the Appendix
shall be of noncombustible or fire retardant
construction as defined in Section 3202.
"Roof coverings shall be secured or fastened to the
supporting roof construction and shall provide weather
protection for the building at the roof.
"Skylights shall be constructed as required in Chapter
34.
"Penthouses shall be constructed as required in Chapter
36.
"For use of plastics in roofs, see Chapter 52.
"For solar energy collectors located above or upon a
roof, see Section 1715."
SECTION 2.
That new Subsection .065 be, and the same is hereby, added
to Section 15.02.090 of Chapter 15.02 of Title 15 of the Anaheim
Municipal Code to read as follows:
11.065 Section 3203 of the Uniform Building Code is
hereby amended to read as follows:
"Section 3203 `Roof Covering Requirements.'
Notwithstanding any other provision of this Building
Code and Appendix to the contrary, and with the

exception of attached room additions to existing
residences in all Group R-3 occupancy classifications,
the roof covering of any building hereinafter
constructed regardless of Type or Occupancy
classification, including any re -roofing of any
existing building when 50% or more of the total roof
area is re -roofed within any one-year period, as
specified in Chapter 32 of the Appendix hereto, shall
be Class A roof covering in all areas of the City of
Anaheim located east of the Costa Mesa Freeway (SR -55)
and south of the Riverside Freeway (SR -91).
"The roof covering on any structure regulated by this
code shall be as specified in Table No. 32-A and as
classified in Section 3204.
"The roof -covering assembly includes the roof deck,
underlayment, interlayment, insulation and covering
which is assigned a roof -covering classification."
SECTION 3. PENALTY
It shall be unlawful for any person, firm or corporation to
violate any provision or to fail to comply with any of the
requirements of this ordinance. Any person, firm or corporation
violating any provision of this ordinance or failing to comply
with any of its requirements shall be deemed guilty of a
misdemeanor and upon conviction thereof shall be punished by a
fine not exceeding One Thousand Dollars ($1,000.00) or by
imprisonment not exceeding six (6) months or by both such fine
and imprisonment. Each such person, firm or corporation shall be
deemed guilty of a separate offense for each day during any
portion of which any violation of any of the provisions of this
ordinance is committed, continued or permitted by such person,
firm or corporation, and shall be punishable therefor as provided
for in this ordinance.
SECTION 4. SEVERABILITY
The City Council of the City of Anaheim hereby declares that
should any section, paragraph, sentence or word of this ordinance
of the Code, hereby adopted, be declared for any reason to be
invalid, it is the intent of the Council that it would have
passed all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 5. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal of any
other ordinance of this City shall in any manner affect the
prosecution for violations of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as
a waiver of any license or penalty or the penal provisions
applicable to any violation thereof. The provisions of this
ordinance, insofar as they are substantially the same as

ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
SECTION 6. EFFECTIVE DATE AND PUBLICATION
This ordinance shall become effective thirty (30) days from
and after the date of its adoption by the City Council. The City
Clerk shall cause this ordinance to be published at least once in
the official newspaper within fifteen days after its adoption.
THE FOREGOING ORDINANCE is approved and adopted by the City
Council of the City of Anaheim this 3rd day of October 1995.
