AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
SECTION 18.01.130 OF CHAPTER 18.01 OF TITLE 18
OF THE ANAHEIM MUNICIPAL CODE RELATING TO THE
DEFINITION OF "LOT."
THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS
AS FOLLOWS:
SECTION 1.
That Section 18.01.130 of Chapter 18.01 of Title 18 of the
Anaheim Municipal Code be, and the same is hereby, amended to read as
follows:
1118.01.130 'L' WORDS, TERMS AND PHRASES.
'Liquor Store.' A retail establishment in
which the primary use is the sale of alcoholic beverages
for off -premise consumption.
'Loading Space.' An off-street space or
berth on the same lot with a building, or contiguous to a
group of buildings, for the temporary parking of a
commercial vehicle while loading or unloading merchandise
or materials.
'Lodging House.' Any building or one or more
portions thereof, containing not more than five guests
where rent is paid in money, goods, labor or otherwise.
'Lot.(1) A parcel of real property as
shown on the effective date of Ordinance No. 3484 as a
delineated parcel of land with a number or other
designation on a plat recorded in the Office of the County
Recorder of Orange County; or (2) a parcel of real
property, lawfully created, not delineated as in (1) above,
and abutting at least one public street, private street
with direct legal vehicular access to a public right-of-
way, or alley, and held under separate ownership from
adjacent property prior to the effective date of Ordinance
No. 3484; or (3) a parcel of real property, lawfully
created, not delineated as in (1) above, and containing an
area not less than the prescribed minimum square footage
and lot width required for the zone in which it is located,
and abutting at least one public street, private street
with direct legal vehicular access to a public right-of-
way, or alley, if the same was a portion of a larger piece
a
of unsubdivided real property held under single ownership
prior to the effective date of Ordinance No. 3484.
'Lot Area.' The total horizontal area within
the boundary lines of a lot. For the purpose of determining
lot area in the case of an irregular, triangular or
gore -shaped lot, a line ten feet in length within the lot
and farthest removed from the front lot line and at right
angles to the line comprising the depth of such lot shall
be used as the rear lot line.
'Lot, Corner.' A lot situated at the
intersection of two or more streets, having an angle of
intersection of not more than one hundred thirty-five
degrees, and a width not greater than seventy-five feet.
' Lot Depth. ' The depth of a lot shall be the
horizontal length of a straight line connecting the
bisecting points of the front and the rear lot lines.
'Lot, Interior.' A lot other than a corner
lot.
'Lot, Key.' The first lot to the rear of a
reversed corner lot and whether or not separated by an
alley.
'Lot Line, Front.' In the case of an
interior lot, a line separating the lot from the street; in
the case of a corner lot, the line separating the narrowest
street frontage of the lot from the street.
'Lot Line, Rear.' A lot line which is
opposite and most distant from the front lot line. For the
purpose of establishing the rear lot line in the case of an
irregular, triangular or gore -shaped lot, a line ten feet
in length within the lot and farthest removed from the
front lot line and at right angles to the line comprising
the depth of such lot shall be used as the rear lot line.
'Lot Line, Side.' Any lot boundary line not
a front lot line or a rear lot line.
'Lot, Reversed Corner. ' A corner lot, the
side street line of which is substantially a continuation
of the front lot line of the corner upon which it rears.
' Lot, Through. ' A lot having frontage on two
parallel or approximately parallel streets.
'Lot Width.' The horizontal distance between
the side lot lines measured along a line constituting the
closest permissible location of the main building to the
front property line."

SECTION 2. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance of the Code, hereby adopted, be declared for any reason to
be invalid, it is the intent of the Council that it would have passed
all other portions of this ordinance independent of the elimination
herefrom of any such portion as may be declared invalid.
SECTION 3. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal of
any other ordinance of this City shall in any manner affect the
prosecution for violations of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as a
waiver of any license or penalty or the penal provisions applicable
to any violation thereof. The provisions of this ordinance, insofar
as they are substantially the same as ordinance provisions previously
adopted by the City relating to the same subject matter, shall be
construed as restatements and continuations, and not as new
enactments.
SECTION 4. PENALTY
It shall be unlawful for any person, firm or corporation to
violate any provision or to fail to comply with any of the
requirements of this ordinance. Any person, firm or corporation
violating any provision of this ordinance or failing to comply with
any of its requirements shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be punished by a fine not exceeding One
Thousand Dollars ($1,000.00) or by imprisonment not exceeding six (6)
months, or by both such fine and imprisonment. Each such person,
firm or corporation shall be deemed guilty of a separate offense for
each day during any portion of which any violation of any of the
provisions of this ordinance is committed, continued or permitted by
T such person, firm or corporation, and shall be punishable therefor as
provided for in this ordinance.
THE FOREGOING ORDINANCE is approved and adopted by the City
Council of the City of Anaheim this 28th day. -,of February, 1995.
