ORDINANCE NO. 5329
AN ORDINANCE OF THE CITY OF ANAHEIM
AMENDING CHAPTERS 17.08, 18.04 AND
18.12 OF TITLES 17 AND 18,
RESPECTIVELY, OF THE ANAHEIM
MUNICIPAL CODE TRANSFERRING
AUTHORITY TO APPROVE TENTATIVE
PARCEL MAPS TO PLANNING COMMISSION
AND ZONING ADMINISTRATOR.
THE CITY COUNCIL OF THE CITY OF ANAHEIM HEREBY ORDAINS
AS FOLLOWS:
SECTION 1.
That subsection .020 of Section 17.08.060 of Chapter
17.08 of Title 17 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
10.020 Tentative Parcel Maps. The City
Planning Commission or the Zoning
Administrator shall constitute the advisory
agency for tentative parcel maps."
SECTION 2.
That Section 17.08.080 of Chapter 17.08 of Title 17 of
the Anaheim Municipal Code be, and the same is hereby, deleted in
its entirety.
SECTION 3.
That Section 17.08.090 of Chapter 17.08 of Title 17 of
the Anaheim Municipal Code be, and the same is hereby, amended to
read as follows:
"17.08.090 FILING OF TENTATIVE MAP
.010 When a parcel map is required by this
Chapter, a tentative parcel map shall first
be filed.
.020 Tentative tract maps and tentative
parcel maps shall be filed with the Planning
Department and shall be processed in
accordance with the Subdivision Map Act and
the provisions of this Chapter. The
subdivider shall submit the tentative map in
a form specified by the Planning Commission
and file as many copies of the map and
supporting documentation as specified by the
Planning Commission."

SECTION 4.
That subsection .015 of Section 17.08.100 of Chapter
17.08 of Title 17 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
11.015 The Zoning Administrator shall make
investigations on the design and improvement
of any proposed division of real property for
which a tentative parcel map is filed for
which the Zoning Administrator is the
advisory agency and shall have the authority
to approve, conditionally approve, or
disapprove such map and division of land.
The Planning Director or his/her designee
shall advise and assist in making
investigations and reports on tentative maps.
The City Engineer or his/her designee shall
advise and assist in making investigations
and reports on tentative maps."
SECTION 5.
That subsection .020 of Section 17.08.100 of Chapter
17.08 of Title 17 of the Anaheim Municipal Code be, and the same
is hereby, deleted in its entirety.
SECTION 6.
That new Section 17.08.105 be, and the same is hereby,
added to Chapter 17.08 of Title 17 of the Anaheim Municipal Code
to read as follows:
1117.08.105 PARCEL MAP IMPROVEMENT AGREEMENTS
The advisory agency may, as a condition of
approval of a tentative parcel map, impose a
requirement that any onsite or offsite
improvements be constructed within a
specified time period following recordation
of the parcel map and prior to issuance of a
permit or other grant of approval for the
development of a parcel upon a finding that
the fulfillment of the construction
requirements is necessary for either public
health and safety or is a necessary
prerequisite to the orderly development of
the surrounding area. An improvement
agreement shall be executed and improvement
security shall be posted prior to approval of
the final parcel map."

SECTION 7.
That Section 17.08.140 of Chapter 17.08 of Title 17 of
the Anaheim Municipal Code be, and the same is hereby, deleted in
its entirety.
SECTION 8.
That Section 17.08.620 of Chapter 17.08 of Title 17 of
the Anaheim Municipal Code be, and it is hereby, amended to read
as follows:
1117.08.620 LOTS
Lot areas shall be such as will conform to
the standards of development as defined in
Title 18 of this Code, entitled "Zoning," or
by other official plans adopted pursuant to
law."
SECTION 9.
That Section 17.08.630 of Chapter 17.08 of Title 17 of
the Anaheim Municipal Code be, and the same is hereby, deleted in
its entirety.
SECTION 10.
That Section 17.08.640 of Chapter 17.08 of Title 17 of
the Anaheim Municipal Code be, and it is hereby, amended to read
as follows:
" 17.08.640 LANDSCAPING AND NATURAL FEATURES
Landscaping and natural features shall be in
conformance with Chapter 17.06 and Title 18
of this Code and such other regulations as
the City Council may adopt."
SECTION 11.
That new subsections .021, .022 and .023 of Section
18.04.020 be, and the same are hereby, added to Chapter 18.04 of
Title 18 of the Anaheim Municipal Code to read as follows:
11.021 No lot shall be divided by a county or
city boundary line.
.022 The side lines of lots shall be
approximately at right angles to the street
centerline on straight streets or
approximately radial on curved streets.

.023 Residential lots adjacent to freeways
and scenic expressways shall rear or side
onto said freeway or expressway and shall
have a minimum depth, as measured from said
freeway or expressway, of one hundred fifty
feet. Residential lots adjacent to all other
classifications of arterial highways or
railroad rights-of-way shall have a minimum
depth of one hundred twenty feet."
SECTION 12.
That Section 18.12.045 of Chapter 18.12 of Title 18 of
the Anaheim Municipal Code be, and it is hereby, amended to read
as follows:
1118.12.045 PARCEL MAPS
Notwithstanding any other provision of this
Code to the contrary, the Zoning
Administrator shall have the authority, after
holding a public hearing as provided in
Chapter 17.08 of this code, to make
determinations on applications for tentative
parcel maps. Said authority shall be limited
to the following tentative parcel maps:
.010 The tentative parcel map, as proposed,
requires or the applicant requests a
conditional use permit and/or variance
which permit or variance the Zoning
Administrator is authorized to determine
under Sections 18.12.050 and 18.12.060
of this Chapter.
.020 The tentative parcel map, as proposed,
does not require, and the applicant has
not requested, a General Plan amendment
or zone reclassification, and the
property is not within a specific plan
zone."
SECTION 13.
That Section 18.12.090 of Chapter 18.12 of Title 18 of
the Anaheim Municipal Code be, and it is hereby, amended to read
as follows:
" 18.12.090 REFERRAL TO THE PLANNING
COMMISSION
The Zoning Administrator may refer any
petition for a tentative parcel map,

conditional use permit or variance to the
Planning Commission when the Zoning
Administrator determines that the general
public interest warrants such referral."
SECTION 14. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance of the Code, hereby adopted, be declared for any reason
to be invalid, it is the intent of the Council that it would have
passed all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 15. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal
of any other ordinance of this City shall in any manner affect
the prosecution for violations of ordinances, which violations
were committed prior to the effective date hereof, nor be
construed as a waiver of any license or penalty or the penal
provisions applicable to any violation thereof. The provisions
of this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 25th day of
August , 1992.
