A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING ITS RESOLUTION NO. 2014-192, NUNC
PRO TUNC, TO CORRECT AN INADVERTENT AND CLERICAL
DRAFTING ERROR, RELATiNG TO THE APPROVAL AND
ADOPTION OF AN AMENDMENT TO THE PLATINUM
TRIANGLE MASTER LAND USE PLAN.

WHEREAS, on October 21, 2014, by the adoption of its Resolution No. 2014-192, the
City Council of the City of Anaheim ("City Council") approved Miscellaneous Case No. 2014-
00593, which had the effect of amending the Platinum Triangle Master Land Use Plan to modify
(i) Chapter l, Table 1- General Plan Development Intensities, (ii) Chapter 3, Section 3.1, (iii)
Chapter 3, Section 3.4, (iv) Chapter 3, Table 3, and (v) Appendix G("Miscellaneous Case No.
2014-00593"); and
WHEREAS, Miscellaneous Case No. 2014-00593 was considered and approved by the
City Council in response to the petition from Platinum Vista Apartments, LP, a California
limited partnership (herein referred to as the "Owner") for new entitlements on that certain real
property consisting of approximately 4.I3 acres commonly known as 1005-1105 East Katella
Avenue in the City of Anaheim, County of Orange, State of California, as generally depicted on
the map attached hereto as Exhibit A and incorporated herein by this reference (the "Property"),
to reflect proposed revisions to the development intensities for the Property, including an
increase in the number of residential dwelling units from 350 to 389; and
WHEREAS, Miscellaneous Case No. 2Q14-00593 was considered and approved in
conjunction with the Owner's application for (a) an amendment to the General Plan to modify
"Table LU-4: General Plan Density Provisions for Specific Areas of the City" to increase the
number of dwelling units from 350 to 389 residential apartment units ("General Plan
Amendment No. 2014-00495"), (b) an amendment to the Zoning Code to make the Zoning Code
consistent with General Plan Amendment No. 2014-00495, and (c) a Second Amended and
Restated Development Agreement No. 2007-00002 (Development Agreement No. 2007-
00002D); and
WHEREAS, it has been discovered that an inadvertent and clerical error was made in the
drafting of that portion of Resolution No. 2014-192 comprised of "Table 3- General Plan
Designations" of Chapter 3 of the Platinum Triangle Master Land Use Plan, which was attached
as Exhibit C to Resolution No. 2014-192. Specifically, "Table 3- General Plan Designations" of
Chapter 3 of the Platinum Triangle Master Land Use Plan, attached as Exhibit C to Resolution
No. 2014-192, incorrectly identified the maximum square footage for office uses within the
Katella District as 1,921,666 square feet when it should have been identified as 1,921,639 square
feet; and
WHEREAS, the City Council now desires and intends to amend Resolution No. 2014-
192, nunc pro tunc; that is, to now correct said inadvertent and clerical drafting error that, upon
adoption of this Resolution, will have the same legal force and effect as if made at the time when
it should have been made, i.e., upon the adoption of Resolution No. 2014-192 on October 21,
2014; and
WHEREAS, the City Council has inherent authority to amend its resolutions under these
circumstances, which will have retroactive legal effect upon the adoption of this Resolution.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as
follows:
1. To cure the inadvertent and clerical drafting error made in "Table 3- General Plan
Designations" of Chapter 3 of the Platinum Triangle Master Land Use Plan, which was attached
as Exhibit C to Resolution No. 2014-192, said "Table 3- General Plan Designations" is hereby
deleted in its entirety, and the revised "Table 3- General Plan Designations", attached hereto as
Exhibit C and incorporated herein by this reference, is hereby substituted in its place.
2. All references to "Table 3- General Plan Designations" of Chapter 3 of the
P}atinum Triangle Master Land Use Plan herein and in Resolution No. PC2014-192 shall be to
the revised "Table 3- General Plan Designations" attached to this Resolution as Exhibit C, nunc
pro tunc; that is, having retroactive legal effect.
