AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
SECTION 1.04.395.040 OF CHAPTER 1.04 OF TITLE 1 OF
THE ANAHEIM MUNICIPAL CODE (EXCEPTION TO
LIMITATIONS ON CITY BOARD AND COMMISSION
SERVICE) AND SECTION 1.04.955.030 OF CHAPTER 1.04 OF
TITLE 1 OF THE ANAHEIM MUNICIPAL CODE (ANAHEIM
SISTER CITY COMMISSION -- COMPOSITION AND
APPOINTMENT OF MEMBERS) RELATING TO
APPOINTMENTS OF EDUCATIONAL SECTOR VOTING
STAKEHOLDER MEMBERS OF THE SISTER CITY
COMMISSION
WHEREAS, cultural exchange is one of the key objectives of the Anaheim Sister
City Commission, and is achieved by facilitating interaction between students and residents in
order to foster community and international friendship; and
WHEREAS, one of the most active and longstanding events held by the Commission
has been its educational sector component pertaining to the annual student exchange visit with Mito,
Japan, whereby the Commission regularly sends a group of Anaheim high school students to Mito to
learn about the Japanese culture and to enhance their foreign language skills. As part of this program,
Mito sends a group of students to Anaheim and the students stay with Anaheim host families. The
student exchange pivotally provides the opportunity for youth to increase their knowledge of cultures
and diversity by experiencing a new culture firsthand; and
WHEREAS, the amendments sought regarding the appointed educational sector
voting stakeholder members will ensure advisory continuity on the integral components of the
student exchange function underlying this key objective of the Sister City Commission.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1
That Section 1.04.395.040 of Chapter 1.04 (Limitations on City Board and
Commission Service) of Title 1 of the Anaheim Municipal Code be, and the same is hereby,
amended to read in full as follows:
.040 Any person serving as an ex- officio member, educational sector voting stakeholder
member, or non - voting emeritus member of any City board or commission shall not be deemed a
member of such board or commission for purposes of the limitations imposed by this section.
SECTION 2
That Section 1.04.955.030 of Chapter 1.04 (Anaheim Sister City Commission) of
Title 1 of the Anaheim Municipal Code be, and the same is hereby, amended to read in full as
follows:
1.04.955.030 COMPOSITION AND APPOINTMENT OF MEMBERS
(a) The Anaheim Sister City Commission shall consist of fifteen (15) members
appointed by the City Council. Each member of the Commission shall be a resident of the City of
Anaheim or other parties, including business owners and representatives from the educational
sector, that have a vested interest in Anaheim and the success of the sister city program.
Representatives from the educational sector shall be members of the Anaheim Union High
School District Board of Trustees, who are recommended by the Anaheim Union High School
District and selected by the Anaheim City Council, and shall be designated as educational sector
voting stakeholder members. Appointed members shall not hold any paid office or employment
in the City government.
(b) For the initial appointment of the Commission only, each member of City Council
will be responsible for appointing two (2) members with the remaining five (5) members of the
commission (representing Anaheim's business, tourism and educational sectors) to be appointed
collectively by the Mayor and Council. In accordance with subsection .040, for the initial
appointments by the each member of the City Council, each member will appoint one
commissioner who shall have a term expiring on the thirtieth day of June of the first year and one
commissioner who shall have a term expiring on the thirtieth day of June of the second year.
Thereafter, as members' terms expire, the members of the commission will be appointed
collectively by the Mayor and Council by the affirmative votes of the majority thereof.
(c) The City Manager shall appoint a City representative to serve as the staff liaison
to the Commission. This member of City staff shall be an ex official member and will not have
voting rights at meetings of the Commission and shall not be counted for purposes of
determining a quorum at the Commission meetings.
SECTION 3 . IDENTIFICATION OF EXISTING MEMBERS
That Brian O'Neal and Anna Piercy are the current educational sector voting
stakeholder members on the Anaheim Sister City Commission.
SECTION 4 . SEVERABILITY.
The City Council of the City of Anaheim hereby declares that should any section,
paragraph, sentence or word of this ordinance hereby adopted be declared for any reason to be
invalid, it is the intent of the City Council that it would have passed all other portions of this
ordinance independent of the elimination herefrom of any such portion as may be declared
invalid.
SECTION 5 . SAVINGS CLAUSE.
Neither the adoption of this ordinance nor the repeal of any other ordinance of this
City shall in any manner affect the prosecution for violations of ordinances, which violations
were committed prior to the effective date hereof, nor be construed as a waiver of any license or
penalty or the penal provisions applicable to any violation thereof. The provisions of this
ordinance, insofar as they are substantially the same as ordinance provisions previously adopted
by the City relating to the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
