ORDINANCE NO. 5206
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING SECTION 18.70.030 OF THE
ANAHEIM MUNICIPAL CODE, AMENDING CONDITIONS
OF APPROVAL AND ADDING A CONDITION TO
ORDINANCE NO. 4861 RELATING TO SPECIFIC PLAN
87-1 ZONING (THE HIGHLANDS AT ANAHEIM HILLS)
WHEREAS, the City Council of the City of Anaheim has
heretofore adopted Ordinance No. 4860 pursuant to Chapter 18.93
of the Anaheim Municipal Code relating to establishment of zoning
and development standards by addition of Chapter 18.70 to said
Code; and
WHEREAS, the City Council has further duly adopted
Ordinance No. 4861, as amended from time to time, relating to
reclassification of certain real property described therein into
the Specific Plan 87-1 Zone subject to certain conditions as
specified therein; and
WHEREAS, the City Council desires to amend the zoning
and development standards to revise the methods and procedures to
allow for processing of a parcel map prior to site plan approval;
and
WHEREAS, the City Council further desires to amend
Ordinance No. 4861 to amend conditions of approval Nos. 3 and 5
to require submission of precise plans prior to site plan
approval for the commercial development area (Development Area 8)
and to add a condition of approval; and
WHEREAS, the City Council has complied with the
procedures set forth in Chapter 18.93.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM
DOES ORDAIN AS FOLLOWS:
SECTION 1.
That subsections .010 and .020 of Section 18.70.030 of
Chapter 18.70 of Title 18 of the Anaheim Municipal Code be, and
the same are hereby, amended to read as follows:
".010 Implementation. The Specific Plan shall
be implemented through the processing of site
plans in conjunction with residential tract maps
and parcel maps and prior to the issuance of
building permits for the commercial development
area (Development Area (8). The site plans may be
prepared separately from the tentative subdivision
maps or may be submitted on the same document

provided the map(s) submitted are in sufficient detail
to determine conformance with the Specific Plan.
.020 Site Plan Approval. The site plans(s) for
a particular development area, or portion thereof,
shall be reviewed at a duly noticed public hearing by
the Planning Commission for consistency with the
specific Plan and this chapter. Notice of hearings for
residential site plans shall be given at the same time
and in the same manner as specified for hearings for
tentative tract maps in the Municipal Code. Notice of
site plan hearings for the commercial development area
(Development Area 8) shall be given in the same manner
as specified for hearings for tentative tract maps in
the Municipal Code. Subject to minor boundary
variation as authorized by Section 18.70.020.040 of
this chapter, and density transfers as authorized by
Section 18.70.020.050 of this chapter, if the site plan
is found to be consistent with the Specific Plan and
this chapter, the Planning Commission shall approve the
site plan and direct that the Zoning Map of the City be
amended when necessary. The decision of the Planning
Commission shall be final subject to appeal or review
by the City Council in the same time and manner as
provided for appeal from decisions of the advisory
agency on tentative tract maps as set forth in the
Municipal Code."
SECTION 2.
That Ordinance No. 4861 be, and the same is hereby,
amended by amending conditions No. 3 and 5 to read as follows:
113. That in conjunction with the submittal of all
residential tentative tract or parcel maps and prior to the
approval of all commercial site plans, the following information
and/or plans shall be submitted to the Planning Department for
planning Commission review and approval in conformance with
Section 18.85.060 of the Anaheim Municipal Code:
(a) Location map - drawn to the same scale as the maps
in Exhibit A (Specific Plan) and relating the tract to the
overall Highlands Project.
(b) Topographic Map.
(c) Lot dimensions and pad sizes - of all lots
sufficient to indicate the relationship of the proposal to the
nature and extent of the cut and fill earthwork involved.

(d) Landscaping plans - indication the extent and type
of proposed landscaping and including any existing vegetation
which is to be retained.
(e) Vehicular circulation and parking plan -
indicating the nature and extent of public and private streets,
alleys and other public accessways for vehicular circulation,
off-street parking, and vehicular storage.
(f) Fence and wall plans - indicating the type of
fencing along any lot line of a site abutting a street, creek,
lake or open storm drain. The specific fence or wall location
shall be shown in addition to the color, material and height.
Any fencing located in a manner which may obstruct the view from
a public right-of-way shall consist of decorative open-work
materials.
(g) Signing plans - indicating the proposed signing
program and including, but not limited to, any identification,
business or other signs; and specifying the size, height,
location, color, material and lighting of such signs.
Development area identification signs shall be constructed in
compliance with the Anaheim Highlands Specific Plan. The
developer shall provide signs to identify the Eastern
Transportation Corridor Area within one-half (1/2) mile of the
corridor. In addition, signs shall be provided to identify
proposed future land uses, such as the commercial site, future
park/school site, residential land uses, etc. All signage shall
be subject to the review and approval of the City Traffic
Engineer for vehicular and pedestrian visibility and the Planning
Department for Specific Plan Conformance."
"5. That prior to residential tentative tract or
parcel map approval and prior to the approval of all commercial
site plans, the petitioner shall submit preliminary site plans,
floor plans and building elevations to the Planning Commission
for review and approval; said plans shall include building
materials and colors. Final site plans, floor plans and building
elevations ultimately approved by the City shall be in
substantial conformance with said preliminary plans."
SECTION 3.
That Ordinance No. 4861 be, and the same is hereby
amended by adding the following condition of approval to Specific
Plan 87-1:
"That in the event a parcel map to subdivide
Development Area 8 is recorded, an unsubordinated reciprocal
access and parking agreement in a form satisfactory to the City
Attorney shall be recorded with the office of the Orange County
Recorder. A copy of the recorded agreement shall then be

submitted to the Zoning Division. In addition, provisions shall
be made in the agreement to guarantee that the entire complex
shall be managed and maintained as one integral parcel for
purposes of parking, vehicular circulation, signage, land usage
and architectural control."
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 5th day of March
1991.
