ORDINANCE NO. 5203
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY
OF ANAHEIM AMENDING SUBSECTION 18.70.060.040
OF THE ANAHEIM MUNICIPAL CODE AND ADDING A
CONDITION OF APPROVAL TO ORDINANCE NO. 4861
RELATING TO SPECIFIC PLAN 87-1 ZONING FOR THE
HIGHLANDS AT ANAHEIM HILLS
WHEREAS, the City Council of the City of Anaheim has
heretofore adopted Ordinance No. 4860 pursuant to Chapter 18.93
of the Anaheim Municipal Code relating to establishment of zoning
and development standards by addition of Chapter 18.70 to said
Code; and
WHEREAS, the City Council has further duly adopted
Ordinance No. 4861, as amended from time to time, relating to
reclassification of certain real property described therein into
the Specific Plan 87-1 Zone subject to certain conditions as
specified therein; and
WHEREAS, the City Council desires to (1) amend the.
zoning and development standards to transfer 24 dwelling units
from Development Areas 4 and 7 to Development Area 6, and (2) add
a condition of approval to Ordinance No. 4861, and has complied
with the procedures set forth in Chapter 18.93.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM
DOES ORDAIN AS FOLLOWS:
SECTION 1.
That subsection .040 of Section 18.70.060 of Chapter
18.70 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, amended by the addition of the following paragraphs
(b) through (e) relating to development standards in Development
Area 6 to read as follows:
"(b) Required Lot Frontage. That all lots shall be
permitted to front upon a private or public accessway.
(c) Minimum Lot Width. All lots to be utilized as
vehicular accessways shall have a minimum width of not
less than forty-two feet.
(d) Minimum Site Area per Dwelling Unit. The minimum
site area per dwelling unit shall be 2,068 square feet
per dwelling unit. However, the overall site area per
dwelling unit figure for the development area as a
whole shall average no less than 3,000 square feet per
dwelling unit.

(e) Maximum Structural Height. The maximum height of
any building shall not exceed thirty-five (35) feet,
exclusive of roof structure. Within one hundred and
fifty (150) feet of any single-family residential zone,
the maximum height of any building shall not exceed one
(1) story, exclusive of roof structure, unless detailed
drawings are submitted to, and approved by, the
Building and Zoning Divisions showing that no proposed
buildings greater than one-story in height visually
intrude on any abutting or adjacent single-family
dwelling; in no event, however, shall any such building
be located less than sixteen (16) feet from any such
residential zone boundary."
SECTION 2.
That Ordinance No. 4861 be, and the same is hereby,
amended by adding the following condition of approval to Specific
Plan 87-1:
"That prior to the introduction of an ordinance
authorizing this amendment, the developer shall reduce
the number of residential lots within tentative tract
12685 from 84 to 78 by either:
(a) recording said tract map indicating a maximum of
78 residential lots;
(b) revising said tract map indicating a maximum
of 78 residential lots; or
(c) withdrawing said tentative tract map."
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 12th day of February,
1991.
