ORDINANCE NO. 5143
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
SUBSECTION .010 OF SECTION 1.13.020 AND
AMENDING SECTION 1.13.050 OF CHAPTER 1.13 OF
TITLE 1 OF THE ANAHEIM MUNICIPAL CODE RELATING
TO THE POLICE RESERVE CORPS.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS

That Subsection .010 of Section 1.13.020 of Chapter 1.13
of Title 1 of the Anaheim Municipal Code be, and the same is
hereby, amended to read as follows:
"1.13.020 QUALIFICATIONS FOR MEMBERSHIP
.010 The Chief of Police, with the
assistance of the Human Resources Department, shall
establish the requirements for qualifications to become
members of the Anaheim Police Department Reserve Corps.
Such requirements shall include but need not be limited to
the minimum selection and training requirements set forth
by the Commission on Peace Officers' Standards and
Training and those specified in the California Penal Code,
Section 832."

That Section 1.13.050 of Chapter 1.13 of Title 1 of the
Anaheim Municipal Code be, and the same hereby, amended to read as
follows:
"1.13.050 STATUS AS PEACE OFFICER
Each member, while serving as such, shall
have status as a police officer or as a peace officer as
provided by Section 830.6(a) and 832.6 of the California
Penal Code and as such, shall have the same power and
authority, except to the extent that the same may be
restricted or limited by the Chief of Police, as
prescribed by law, as does a regular police officer while
serving as such. However, each member, at all times other
than while serving as such:
.010 Shall not have status as a police
officer or as a peace officer;

.020 Shall not have any power, authority, or
duties as a police officer or as a peace officer; and
.030 Shall not represent, identify, or hold
himself out to be a police officer or a peace officer."
SECTION 3. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance, hereby adopted, be declared for any reason to be
invalid, it is the intent of the Council that it would have passed
all other portions of this ordinance independent of the elimination
herefrom of any such portion as may be declared invalid.
SECTION 4. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal
hereby of any other ordinance of this City shall in any manner
affect the prosecution for violations of ordinances, which
violations were committed prior to the effective date hereof, nor
be construed as a waiver of any license or penalty or the penal
provisions applicable to any violation thereof. The provisions of
this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to the
same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 26 day of June;. ,
1990.
