Environmental Determination: The Planning Commission will consider whether to find the project to be Categorically Exempt from the provisions of the California Environmental Quality Act and Guidelines as a Class 1 (Existing Facilities) Categorical Exemption. Resolution No. PC2015-040 (Dalati / Caldwell) Approved VOTE: 6-0 Chairman Seymour and Commissioners Bostwick, Caldwell, Dalati, Lieberman and Ramirez voted yes. Commissioner Agarwal was absent. Environmental Determination: The Planning Commission will consider whether to find the project to be Categorically Exempt from the provisions of the California Environmental Quality Act and Guidelines as a Class 1 (Existing Facilities) Categorical Exemption. Resolution No. PC2015-041 (Lieberman / Bostwick) Approved, with modification to Condition No. 2, clarifying that banquet rooms, accessory to the restaurant, are permitted. Corrected language in Condition No. 43, related to the permitted hours of operation. VOTE: 6-0 Chairman Seymour and Commissioners Bostwick, Caldwell, Dalati, Lieberman and Ramirez voted yes. IN GENERAL: Two persons spoke expressing concerns related to traffic, safety, noise, and the proposed hours of operation. DISCUSSION TIME: 28 minutes (5:13 to 5:41) JUNE 15, 2015 PLANNING COMMISSION ACTION AGENDA 06/15/15 Page 4 of 5 ITEM NO. 4 ZONING CODE AMENDMENT NO. 2015-00126 CONDITIONAL USE PERMIT NO. 2015-05789 VARIANCE NO. 2015-05014 PUBLIC CONVENIENCE OR NECESSITY NO. 2015-00117 (DEV2015-00029) Location: 500 South Anaheim Boulevard Request: For: 1) a conditional use permit to permit a brewery, winery and distillery with on-premises sales and consumption of alcoholic beverages, an outdoor patio and tasting area, and a retail store to include the sale of beer and wine for off-premises consumption; 2) a Zoning Code amendment to allow Alcoholic Beverage Manufacturing facilities and the sale of alcoholic beverages for off- premises consumption in the Neighborhood Commercial district of the South Anaheim Boulevard Corridor Overlay zone; 3) an associated determination of public convenience or necessity related to the sale of alcoholic beverages for off-premises consumption in conjunction with the aforementioned uses; and 4) a variance to permit less parking than required by Code and off-site parking for the aforementioned brewery, winery, and distillery and retail store. Environmental Determination: The Planning Commission will consider whether a Negative Declaration is the appropriate environmental documentation for this request under the California Environmental Quality Act. Recommended City Council Approval of Zoning Code Amendment Resolution No. PC2015-042 Resolution No. PC2015-043 (Dalati / Lieberman) Approved CUP and VAR, with the following modifications: Modified Condition No. 9, related to the permitted hours of operation. Modified Condition No. 15, related to providing a security guard or employee in the outdoor patio area. Modified Condition No. 18, related to allowing construction of an enclosed room to be used for storage, manufacturing or office areas and to be used exclusively by the licensee(s). Deleted Condition No. 19 ---------------------------------------------Approved PCN Modified Condition Nos. 4, 9 & 13 (Same changes as made to the CUP & VAR conditions of approval modifications - Condition Nos. 9, 15 and 18, as stated above). Deleted Condition No. 14 --------------------------------------------- VOTE: 6-0 Chairman Seymour and Commissioners Bostwick, Caldwell, Dalati, Lieberman and Ramirez voted yes. Project Planner: David See dsee@anaheim.net JUNE 15, 2015 PLANNING COMMISSION ACTION AGENDA 06/15/15 Page 5 of 5 OPPOSITION: None IN GENERAL: During the public hearing staff noted that correspondence had been received expressing concerns related to increased housing density in the downtown area, public safety, lack of parking, potential traffic hazards, and a concentration of alcohol licenses in the area and its effects on the neighborhood. Staff addressed each of these concerns during their presentation and in response to questions from the Commission. Three persons spoke expressing concerns related to safety, traffic, noise, and parking issues in the area. DISCUSSION TIME: 1 hour and 7 minutes (5:42 to 6:49) MEETING ADJOURNED AT 6:50 P.M.
