ORDINANCE NO. 5014
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
VARIOUS SUBSECTIONS, SECTIONS AND CHAPTERS
OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE
RELATING TO ZONING
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That new subsection .045 be, and the same is hereby,
added to Section 18.32.050 of Chapter 18.32 of Title 18 of the
Anaheim Municipal Code, relating to conditional uses in the
RM -2400 Zone, to read as follows:
".045 Attached or semi -attached one -family
dwellings which comply with the criteria set forth in Section
18.32.080 of this Chapter and which are not otherwise permitted
uses pursuant to Section 18.32.020.020 hereof."
SECTION 2.
That new Section 18.32.080 be, and the same is hereby,
added to Chapter 18.32 of Title 18 of the Anaheim Municipal Code,
to read as follows:
"18.32.080 DEVELOPMENT CRITERIA FOR CERTAIN
ATTACHED ONE -FAMILY DWELLINGS.
In order to assure that any attached or
semi -attached one -family dwellings permitted by conditional use
permit pursuant to subsection .045 of Section 18.32.050 of this
Code are of high-quality and compatible architectural design and
construction, and notwithstanding any contrary provisions
contained in this Chapter, such uses shall comply with all of the
following additional development criteria:
.010 Maximum Site Coverage. The
maximum coverage by all residential and accessory buildings shall
be forty percent (40%) of the building site area. Recreational
leisure area buildings and facilities shall not be included in the
calculation of coverage.
.020 Recreational Leisure Area. The
project shall include recreational -leisure area of not less than
750 square feet per dwelling unit, and provide usable recreational
facilities therein (such as recreation rooms, swimming pools,
saunas or jacuzzis, tot lots and exercise rooms).
.030 Landscaping and Irrigation. The
project shall include landscaping of the front setback areas, side
yard areas, and interior court areas, including the installation
of an automatic irrigation system, to be provided and permanently
maintained in accordance with a detailed landscape, planting and
irrigation plan approved in conjunction with the conditional use
permit approved for such project.
.040 Property Maintenance.
Conditions of approval of the project shall require the formation
of a homeowners' association, and the recordation of an
unsubordinated covenant against each residential parcel, requiring
said association or record owner to maintain all common areas
within the project."
SECTION 3.
That Section 18.01.050 of Chapter 18.01 of Title 18 of
the Anaheim Municipal Code be, and the same is hereby, amended by
the addition thereto of the new term "Attached or Semi -Attached
One -Family Dwelling" and definition thereof to read as follows and
to be inserted in said Section in proper alphabetical sequence:
''Dwellin , Attached or Semi -Attached One -Family.'
Attached or semi -attached we ing units each of which is designed
for occupancy by a single housekeeping unit and each dwelling unit
of which is designed, intended and legally capable of separate
ownership including, but not necessarily limited to condominiums,
community apartments, stock cooperatives, townhouses, rowhouses,
or other forms of clustered dwellings with individual ownership
interests therein."
SECTION 4.
That subsection .020 of Section 18.31.020 of Chapter
18.31 of Title 18 of the Anaheim Municipal Code be, and the same
is hereby, amended to read as follows:
".020 Attached or semi -attached one -family
dwellings, subject to the provisions relating to Residential
Planned Unit Developments as prescribed in subsection .051 below."
SECTION 5.
That subsection .020 of Section 18.32.020 of Chapter
18.32, and subsection .020 of Section 18.34.020 of Chapter 18.34,
of Title 18 of the Anaheim Municipal Code be, and the same are
hereby, amended to read as follows:
".020 Attached or semi -attached one -family
dwellings, subject to all of the restrictions and regulations of
the RM -3000 Zone and the provisions relating to Residential
Planned Unit Developments as prescribed in Chapter 18.31 of this
Code."
SECTION 6.
That subsection .040 of Section 18.31.020 of Chapter
18.31, subsection .040 of Section 18.32.020 of Chapter 18.32, and

subsection .040 of Section 18.34.020 of Chapter 18.34, of Title 18
of the Anaheim Municipal Code be, and the same are hereby, amended
to read as follows:
".040 Multiple dwellings."
SECTION 7.
That subsection .050 of Section 18.32.020 of Chapter
18.32, and subsection .050 of Section 18.34.020 of Chapter 18.34,
of Title 18 of the Anaheim Municipal Code be, and the same are
hereby, amended to read as follows:
".OSO Residential Planned Unit Developments
(R.P.U.D.) subject to all restrictions and regulations of Chapter
18.31, RM -3000 Zone."
SECTION 8. SAVINGS CLAUSE.
Neither the adoption of this ordinance nor the repeal of
any other ordinance of this City shall in any manner affect the
prosecution for violations of ordinances, which violations were
committed prior to the effective date hereof, nor be construed as
a waiver of any license or penalty or the penal provisions
applicable to any violation thereof. The provisions of this
ordinance, insofar as they are substantially the same as ordinance
provisions previously adopted by the City relating to the same
subject matter, shall be construed as restatements and
continuations, and not as new enactments.
SECTION 9.
SEVERABILITY.
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance be declared for any reason to be invalid, it is the
intent of the Council that it would have passed all other
remaining portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid and that such remaining portions shall remain in full
force and effect.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 25th day of April, 1989.
