ORDINANCE NO. 4873
AN ORDINANCE OF THE CITY OF ANAHEIM ADDING
NEW SECTION 2.12.120 TO CHAPTER 2.12 OF
TITLE 2 OF THE ANAHEIM MUNICIPAL CODE
PERTAINING TO REIMBURSEMENT OF TRANSIENT
OCCUPANCY TAX REVENUES TO QUALIFYING
ORGANIZATIONS.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That Section 2.12.120 be, and it is hereby, added to
+ Chapter 2.12 of Title 2 of the Anaheim Municipal Code to read as
follows:
112.12.120 Reimbursement to Qualifying Organizations
(a) The City shall reimburse any
qualifying nonprofit service organization in an
amount equal to the transient occupancy tax paid
pursuant to this chapter by the organization to a
hotel or motel to shelter homeless persons.
(b) The following definitions shall apply
to this section:
1. 'Qualifying nonprofit service
organization' shall mean any nonprofit service
organization which (a) is a member of the Anaheim
Human Services Network, (b) directly pays the cost
of sheltering homeless persons in a hotel or motel,
and (c) does not use the providing of such shelter
to directly or indirectly further any religious
purposes of the organization.
2. 'Homeless person' shall mean any
person who, immediately prior to being provided
shelter in a hotel or motel by a qualifying
nonprofit service organization, lived or resided in
the City of Anaheim.
(c) Any organization seeking
reimbursement under this section shall file, in July
of each year, a demand, accompanied by supporting
documentation establishing eligibility for
reimbursement hereunder, with the City Finance
Director for reimbursement of the transient
occupancy tax paid by the organization during the
preceding fiscal year. A fiscal year extends from
July 1 of one year to June 30 of the following
year. The City Finance Director shall draw a
warrant upon the City Treasurer for any such demand
or portion thereof which has been audited and
approved as complying with the requirements of this
section. The decision of the Finance Director to
approve a demand shall be final.
(c) No reimbursement shall be allowed for
any transient occupancy tax paid prior to July 1,
1987, nor for any demand filed later than the last
day of July for the immediately preceding fiscal
year."
SECTION 2. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance, hereby adopted, be declared for any reason to be
invalid, it is the intent of the Council that it would have passed
all other portions of this ordinance independent of the elimination
herefrom of any such portion as may be declared invalid.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 1st day of December, 1987.
