4899ORDINANCE NO. 4899
AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
CHAPTER 18.03 OF TITLE 18 OF THE ANAHEIM
MUNICIPAL CODE PERTAINING TO ZONING PROCEDURES.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
FOLLOWS:
SECTION 1.
That Section 18.03.071 of Chapter 18.03 of Title 18 of
the Anaheim Municipal Code be, and it is hereby, amended to read
as follows:
"SECTION 18.03.071 NOTIFICATION OF PLANNING
COMMISSION ACTIONS
Not later than ten (10) days
following the passage of any Planning Commission
resolution granting or denying any reclassification,
conditional use permit or variance, the Secretary of
the Planning Commission shall mail a copy of the
resolution to the applicant and shall forward to the
City Clerk a conformed copy of the resolution, the
minutes of the meetings wherein the matter was
considered, the staff reports relating to the item, and
the location map of the project."
SECTION 2.
That Section 18.03.080 of Chapter 18.03 of Title 18 of
the Anaheim Municipal Code be, and it is hereby, amended to read
as follows:
"SECTION 18.03.080 REVIEW AND APPEALS OF PLANNING
COMMISSION ACTIONS.
The action of the Planning
Commisson on any reclassification, variance or
conditional use permit shall be final and effective
twenty-two (22) days following the action thereon,
unless, within such twenty -two-day period, an appeal in
writing is filed with the City Council by either the
applicant or an opponent, or unless a request to review
said decision is made by one (1) or more members of the
City Council, or unless the City Planning Commission
requests a review of its decision. Upon receipt of
such appeal or request to review the decision of the
Planning Commission, the City Clerk shall so notify the
Secretary of the Planning Commission. The Secretary of
the Planning Commission or the Planning Director shall
make available at the City Council public hearing
thereon, all files, records, exhibits and plans
pertaining to the application or applications."
SECTION 3. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance, hereby adopted, be declared for any reason to be
-- invalid, it is the intent of the Council that it would have passed
all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 4. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal
hereby of any other ordinance of this City shall in any manner
affect the prosecution for violations of ordinances, which
violations were committed prior to the effective date hereof, nor
be construed as a waiver of any license or penalty or the penal
provisions applicable to any violation thereof. The provisions of
this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 16th day of February, 1988.
