4901ORDINANCE NO. 4901
AN ORDINANCE OF THE CITY OF ANAHEIM ADDING AND
AMENDING VARIOUS SECTIONS AND SUBSECTIONS OF
VARIOUS CHAPTERS OF TITLE 18 OF THE ANAHEIM
MUNICIPAL CODE RELATING TO ZONING FOR
CONVENIENCE MARKETS AND COMMERCIAL RETAIL
CENTERS.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN
AS FOLLOWS:
SECTION 1.
That subsections .070 of Section 18.42.020 of
Chapter 18.42, subsection .180 of Section 18.44.020 of
Chapter 18.44, subsection .190 of Section 18.45.020 of
Chapter 18.45, and subsection .260 of Section 18.46.020 of
Chapter 18.46, all of Title 18 of the Anaheim Municipal Code
be, and the same are hereby, amended to read as follows:
"Markets or grocery stores having an interior
building floor area of not less than 15,000 square
feet."
SECTION 2.
That new subsection .090 be, and the same is
hereby, added to Section 18.42.25 of Chapter 18.42, that new
subsection .070 be, and the same is hereby, added to Section
18.44.025 of Chapter 18.44, that new subsection .080 be, and
the same is hereby, added to Section 18.45.025 of Chapter
18.45, and that new subsection .090 be, and the same is
hereby, added to Section 18.46.025 of Chapter 18.46, all of
Title 18 of the Anaheim Municipal Code, to read as follows:
"No combination of otherwise permitted uses or
businesses which constitute a 'Commercial Retail
Center' as defined in Section 18.01.040 of this
Code shall be permitted unless a conditional use
permit is first obtained therefor pursuant to
Chapter 18.03 hereof.'
SECTION 3.
That new subsection .085 be, and the same is
hereby, added to Section 18.42.050 of Chapter 18.42, that
new subsection .195 be, and the same is hereby, added to
Section 18.44.050 of Chapter 18.44, that new subsection .195
be, and the same is hereby, added to Section 18.45.050 of
Chapter 18.45, and that new subsection .185 be, and the same
is hereby, added to Section 18.46.050 of Chapter 18.46, all
of Title 18 of the Anaheim Municipal Code, to read as
follows:
Alternative A
"Markets or grocery stores having an interior
building floor area of less than 15,000 square
feet."
SECTION 4.
That new subsection .055 be, and the same is
hereby, added to Section 18.42.050 of Chapter 18.42, that
new Subsection .135 be, and the same is hereby, added to
Section 18.44.050 of Chapter 18.44, that new subsection .135
be, and the same is hereby, added to Section 18.45.050 of
Chapter 18.45, and that new subsection .135 be, and the same
is hereby, added to Section 18.46.050 of Chapter 18.46, all
of Title 18 of the Anaheim Municipal Code, to read as
follows:
"Commercial Retail Centers as defined in Section
18.01.040 of this Code."
SECTION S.
That a new definition of "Commercial Retail Center"
be, and the same is hereby, added to Section 18.01.040 of
Chapter 18.01 of Title 18 of the Anaheim Municipal Code, to
be placed in proper alphabetical sequence in said Code and
to read as follows:
"'Commercial Retail Center.' Any combination of
three or more commercial uses or commercial
businesses otherwise permitted or conditionally
permitted in the zone in which located which uses
or businesses are either (i) located on a single
parcel of property, (ii) constructed as a single
development project, or (iii) result from a
remodeling, partitioning or other division of space
in a building, business, or use on a single parcel
of property."
SECTION 6. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the
repeal hereby of any other ordinance of this City shall in
any manner affect the prosecution for violations of
ordinances, which violations were committed prior to the
effective date hereof, nor be construed as a waiver of any
license or penalty or the penal provisions applicable to any
violation thereof. The provisions of this ordinance, insofar
as they are substantially the same as ordinance provisions
previously adopted by the City relating to the same subject
matter, shall be construed as restatements and
continuations, and not as new enactments.

SECTION 7. SEVERABILITY
The City Council of the City of Anaheim hereby
declares that should any section, paragraph, sentence or
word of this ordinance, hereby adopted, be declared for any
reason to be invalid, it is the intent of the Council that
it would have passed all other portions of this ordinance
independent of the elimination herefrom of any such portion
as may be declared invalid.
THE FOREGOING ORDINANCE is approved and adopted by
the City Council of the City of Anaheim this 23rd day of
February, 1988.
