ORDINANCE NO. 4929
AN ORDINANCE OF OF THE CITY OF ANAHEIM
ADDING AND AMENDING VARIOUS CHAPTERS OF
TITLE 18 OF THE ANAHEIM MUNICIPAL CODE
RELATING TO SENIOR CITIZENS' APARTMENT
PROJECTS.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That Section 18.01.200 of Chapter 18.01 of Title 18 of
the Anaheim Municipal Code be, and the same is hereby, amended by
the addition of the following definitions as "S" words and placed
alphabetically in said section to read as follows:
"'Senior Citizens' Apartment Project -Congregate Care.'
A Senior CitizensApartment Fro3ect, as the term is
defined in this Section, which also provides nursing,
dietary and other personal services to residents."
"'Senior Citizen Housing Development.' A Senior
Citizens' Apartment Project, as the term is defined in
this Section, which under state law permits senior
citizens of age 55 years or older and contains at least
150 dwelling units."
SECTION 2.
That new subsection .0133 be, and the same is hereby,
added to Section 18.06.050 of Chapter 18.06 of Title 18 of the
Anaheim Municipal Code to read as follows:
11.0133 Senior Citizen Housing Development: not less
than one and one-quarter (1.25) parking spaces for the
initial bachelor or one bedroom unit plus three quarters
(.75) of a space for each additional bedroom in the
project. Parking spaces shall be unassigned and equally
available to all residents, guests, and employees.
Parking spaces shall be located so as to minimize
walking distance from the living area to the parking
facility."
SECTION 3.
That subsection .0269 of Section 18.06.050 of Chapter
18.06 of Title 18 be, and the same is hereby, amended to read as
follows:
11.0269 Convalescent Home and Senior Citizens' Apartment
Project -Congregate Care: Four -Fifths (0.8) of a space
per living unit, or bed in a dormitory residence."
SECTION 4.
That new subsection .011 be and the same is hereby, added
to Section 18.94.032 of Chapter 18.94 of Title 18 to read as
follows:
11.011 Required Elevators. Any Senior Citizens'
Apartment Project which contains three (3) or more
stories (including any below -grade parking) or which
contains thirty (30) or more units above the first story
(including any at grade or below -grade parking) shall
include one (1) or more elevators so that each unit
entrance is located no more than one hundred fifty (150)
feet from an elevator. Each elevator shall comply with
all applicable state of California Fire Life Safety
regulations."
SECTION S. PENALTY
It shall be unlawful for any person, firm or corporation
to violate any provision or to fail to comply with any of the
requirements of this ordinance. Any person, firm or corporation
violating any provision of this ordinance or failing to comply with
any of its requirements shall be deemed guilty of a misdemeanor and
upon conviction thereof shall be punished by a fine not exceeding
One Thousand Dollars ($1,000.00) or by imprisonment not exceeding
six (6) months, or by both such fine and imprisonment. Each such
person, firm or corporation shall be deemed guilty of a separate
offense for each day during any portion of which any violation of
any of the provisions of this ordinance is committed, continued or
permitted by such person, firm or corporation, and shall be
punishable therefor as provided for in this ordinance.
SECTION 6. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance, hereby adopted, be declared for any reason to be
invalid, it is the intent of the Council that it would have passed
all other portions of this ordinance independent of the elimination
here from of any such portion as may be declared invalid.
SECTION 7. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal
hereby of any other ordinance of this City shall in any manner
affect the prosecution for violations of ordinances, which
violations were committed prior to the effective date hereof, nor
be construed as a waiver of any license or penalty or the penal
provisions applicable to any violation thereof. The provisions of
this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to the
same subject matter, shall be construed as restatements and
continuations, and not as new enactments.

THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 31st day of May, 1988.
