A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM TO REVISE AND RESTATE IN ITS
ENTIRETY RESOLUTION NO. 2002R-110 APPROVING AND
AUTHORIZING THE APPLICATION FOR FUNDS FROM THE
"CALIFORNIA PUBLIC LIBRARY CONSTRUCTION AND RENOVATION
FUND" TO MATCH FUNDS BUDGETED BY THE CITY OF ANAHEIM
FOR THE HASKETT BRANCH LIBRARY CONSTRUCTION PROJECT AND
AUTHORIZING THE CITY MANAGER TO EXECUTE ALL NECESSARY
DOCUMENTS IN CONNECTION WITH SUCH APPLICATION AND
SUBSEQUENT AWARD OF FUNDS
WHEREAS, California Education Code Sections 19985 et seq.
established a Library Construction and Renovation Fund Bond Act
(hereinafter "Act") to expand public library services for all
residents of California; and
WHEREAS, The Act provides for the placement of the proceeds
of all bonds issued and sold pursuant to the Act to be deposited
in the California Public Library Construction and Renovation Fund
(the "Fun~'); and
WHEREAS, all moneys deposited in said Fund are continuously
appropriated to the State Librarian and are available for grants
to counties, cities and special agencies authorized at the time
of the project application to own and maintain a public library
facility for those purposes set forth in Section 19989 of
Education Code; and
WHEREAS, the City of Anaheim wishes to apply to the State
Librarian for a grant pursuant to the Act for funding the Haskett
Branch Library Construction Project ("Project").
NOW. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ANAHEIM AS FOLLOWS:
1. That the City Council hereby approves, and the City
Manager is hereby authorized to file an application for funds
under the California Library Construction and Renovation Bond Act
of 2000, set forth in Education Code Sections 19985 et seq.
2. That the City Council hereby authorizes the City
Manager to execute all necessary documents and certifications in
connection with such application and the subsequent award of
funds.
3. The City Council hereby certifies upon information and
belief to the accuracy and truthfulness of all information
submitted in the Application and the required supporting
documents.
4. That the City Manager is hereby authorized to conduct
all negotiations and execute and submit all documents including,
but not limited to applications, agreements, amendments, and
payment requests which may be necessary for the completion of the
Project.
5. That the City Council hereby makes the following
commitments on behalf of the City in connection with such
application:
(a) To provide local matching funds in an amount equal
to 35 percent of the costs of the Project, as said
costs are set forth in the Library Project Budget,
including and identifying amounts to be credited
to local matching funds pursuant to section
19995(c) and (d) of the Education Code. The value
of such matching funds shall equal $3,053,008
which includes a local land credit of $730,200,
resulting in an adjusted local match of
$2,322,808.
(b) To provide supplemental funds necessary to
complete the project at the level stated in the
Project Budget. At the present time, no unfunded
supplemental costs are included in the project
budget.
(c To make available local matching and supplemental
funds specified in the project budget when needed
to meet cash flow requirements for the Project.
(d To operate the completed facility and to provide
public library direct service, unless the public
library shall be operated in whole by a
jurisdiction other than the City of Anaheim.
(e That the facility shall be dedicated to public
library direct service use for a period of at
least forty (40) years following completion of the
project, regardless of any operating agreements
the applicant may have with other jurisdictions or
parties.
6. That the City Council of the City of Anaheim hereby
certifies that it has approved the project budget in the amount
$8,722,880.
THE FOREGOING RESOLUTION is approved and adopted by the City
Council of the City of Anaheim this llth day of June ,2002.
