AN ORDINANCE OF THE CITY OF ANAHEIM ADDING,
DELETING AND AMENDING VARIOUS CHAPTERS,
SECTIONS AND SUBSECTIONS OF TITLE 6 OF THE
ANAHEIM MUNICIPAL CODE RELATING TO PUBLIC
HEALTH AND SAFETY
WHEREAS, the City Council of the City of Anaheim
desires to conform Title 6 of the Anaheim Municipal Code to
changes in state law and previous amendments to the City Charter;
and
WHEREAS, the City Council desires to correct errors,
delete unnecessary provisions, and otherwise update various
provisions in Title 6 of the Anaheim Municipal Code.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM
HEREBY ORDAINS AS FOLLOWS:
SECTION 1.
That Section 6.04.020 of Chapter 6.04 of Title 6 of the
Anaheim Municipal Code be, and the same is hereby, amended to
read as follows:
"6.04.020 DEFINITIONS.
.010 Emergency. As used in this chapter, the term
"emergency" or "local emergency" shall mean the actual or
threatened existence of conditions of disaster or of extreme
peril to the safety of persons or property within the City
resulting from air pollution, fire, flood, storm, epidemic, riot,
earthquake, actual or threatened enemy attack, actual or
threatened acts of terrorism, sabotage, war or imminent threat of
war, or other public calamity, except any condition resulting
from a labor controversy, which conditions are or are likely to
be beyond the effective control of the services, personnel,
equipment and facilities of the City and which require the
combining of forces with other communities or political
jurisdictions to combat effectively."
SECTION 2.
That subsection .030 of Section
6.04 of Title 6 of the Anaheim Municipal
hereby, amended to read as follows:

".030 Wear, carry, or display, without authority, any actual,
simulated or counterfeit form of identification specified or
purporting to be issued by any emergency or disaster agency, any
public or private humanitarian or assistance agency, any media or
news agency, or by any branch of the federal, state, regional,
county or local governmental agency, or by any branch thereof."
SECTION 3.
That Section 6.24.060 of Chapter 6.24 of Title 6 of the
Anaheim Municipal Code be, and the same is hereby, repealed.
SECTION 4.
That Section 6.24.070 of Chapter 6.24 of Title 6 of the
Anaheim Municipal Code be, and the same is hereby, repealed.
SECTION S.
That Section 6.30.055 of Chapter 6.30 of Title 6 of the
Anaheim Municipal Code be, and the same is hereby, amended to
read as follows:
"6.30.055 SMOKING PROHIBITED WITHIN THE ANAHEIM CONVENTION
CENTER.
.010 It is unlawful for any person to smoke in any place or
area within the Anaheim Convention Center.
.020 The term `Anaheim Convention Center' as used herein
shall mean the indoor areas of the facilities generally located
at 800 West Katella Avenue, Anaheim, California, including
without limitation the arena facility operated at such location,
regardless of whether such facilities continue to be known by
such name or by any other commercial or non-commercial name."
SECTION 6.
That Section 6.30.065 of Chapter 6.30 of Title 6 of the
Anaheim Municipal Code be, and the same is hereby, amended to
read as follows:
"6.30.065 SMOKING PROHIBITED WITHIN ANAHEIM STADIUM.
.010 It is unlawful for any person to smoke in any place or
area within Anaheim Stadium, including, but not limited to, any
event seating and aisle areas, except as hereinafter provided.

.020 Notwithstanding subsection .010 above, nothing
contained in this section shall be deemed to prohibit smoking
within the following places and areas within Anaheim Stadium:
.0201 Upon or within any concourses or rampways.
For purposes of this section, `concourses' means the pedestrian
walkways on each level of the stadium which are generally located
between the event seating areas and the outside walls or confines
of the stadium structure and which walkways provide patron
circulation within and around each level of the stadium. For
purposes of this section, `rampways' means the pedestrian
accessways which connect and provide patron access from one level
of the stadium to another.
.0202 Within any enclosed suite unless the Stadium
lessee or the licensee or other person or entity having control
of the occupancy of the suite shall have posted or caused to be
posted therein signs prohibiting smoking in such suite. The
posting of any such suite as a nonsmoking area shall be at the
sole discretion of such lessee, licensee or the person or entity
having control of the occupancy thereof.
.0203 Within any office or other enclosed area
(except any stadium restaurant) leased, rented, licensed or for
which the right of exclusive or private occupancy has been
granted to any person or entity for a period of time, unless the
lessee, tenant or licensee or person or entity having control of
the occupancy thereof shall have posted or caused to be posted
signs prohibiting smoking within such office or other enclosed
area, or (ii) smoking in such office is prohibited by Section
6404.5 of the Labor Code of the State of California or any other
provision of law.
.030 The term `Anaheim Stadium' as used in this chapter
shall mean the stadium generally located at 2000 Gene Autry Way,
Anaheim, California, currently known and referred to as Edison
International Field of Anaheim, regardless of whether such
stadium continues to be known by such commercial name or by any
other commercial or non-commercial name."
SECTION 7.
That new Section 6.30.066 be, and the same is hereby,
added to Chapter 6.30 of Title 6 of the Anaheim Municipal Code,
to read as follows:

"6.30.066 SMOKING PROHIBITED WITHIN THE ANAHEIM ARENA.
.010 It is unlawful for any person to smoke in any place or
area within the Anaheim Arena.
.020 The term `Anaheim Arena' as used herein shall mean the
indoor areas of the arena and facilities generally located at
2695 East Katella Avenue, Anaheim, California, currently known
and referred to as the Arrowhead Pond of Anaheim, regardless of
whether such facilities continue to be known by such name or by
any other commercial or non-commercial name."
SECTION 8.
That Section 6.30.090 of Chapter 6.30 of Title 6 of the
Anaheim Municipal Code be, and the same is hereby, repealed.
SECTION 9.
That Section 6.30.110 of Chapter 6.30 of Title 6 of the
Anaheim Municipal Code be, and the same is hereby, repealed.
SECTION 10.
That new Section 6.30.170 be, and the same is hereby,
added to Chapter 6.30 of Title 6 of the Anaheim Municipal Code,
to read as follows:
"6.30.170 CHAPTER AS SUPPLEMENT TO STATE LAW.
The purpose and intent of this chapter is to regulate
environmental smoke and smoking activities only to the extent
such regulation is permitted by state law. Nothing contained in
this chapter shall be deemed to permit any activity or conduct
which is otherwise prohibited by state law. In the event any
provision of this chapter is deemed to prohibit any activity or
conduct which is prohibited, or which is regulated to the
exclusion of any local regulation, by any state law, the
provision of this chapter shall be deemed inoperative so long as
such provision of state law is in effect."
SECTION 11.
That Chapter 6.36 of Title 6 of the Anaheim Municipal
Code be, and the same is hereby, repealed.
SECTION 12.
That Chapter 6.42 of Title 6 of the Anaheim Municipal
Code be, and the same is hereby, amended, in its entirety, to
read as follows:

"Chapter 6.42
CHRISTMAS TREE LOTS AND PUMPKIN PATCHES
6.42.010 PERMIT REQUIRED.
No person, firm, partnership or corporation shall establish
or maintain within the City any lot, property or premises for the
purpose of the outdoor sale or other disposition of any Christmas
trees or Halloween pumpkins except as provided in this chapter.
6.42.020 LICENSE DIVISION TO ISSUE PERMITS.
Permits for the temporary outdoor display and sale or other
disposition of Christmas trees or Halloween pumpkins shall be
issued by the City License Division after approval of such permit
by the License Division, Planning Department and Fire Department.
6.42.030 APPLICATIONS FOR PERMITS.
Applications for such temporary permits shall be made in
writing and filed with the City License Division at least ten
days before the date the applicant desires to commence the
outdoor sale or disposition of Christmas trees or Halloween
pumpkins and shall state the name of the applicant, his address,
the location of the premises proposed for the sale or disposition
of Christmas trees or Halloween pumpkins, and the names and
addresses of the persons who will actually operate the premises
for such sale or disposition. Application for the sale of
Christmas trees or Halloween pumpkins by any charitable,
fraternal or benevolent organization shall state the name of such
organization and shall state the name of the person or
organization to which the proceeds will be donated or otherwise
received. Copies of said application shall be sent to the
Building Department and Fire Department.
6.42.040 FILING FEE.
The application shall be accompanied by a filing fee payable
to the City of Anaheim in the sum of twenty-seven dollars, no
part of which shall be waived or refunded.
6.42.050 LIMITATION ON PERMITS.
Every person, firm, partnership or corporation receiving a
permit pursuant to this chapter for the sale or disposition of
Christmas trees or Halloween pumpkins and having as its primary
business the temporary display and sale of Christmas trees or

Halloween pumpkins shall be limited to one of each such permits
per year and shall be limited to one location for the sale of
Christmas trees and one location for the sale of Halloween
pumpkins. Such permit shall not be transferable.
6.42.060 EXPIRATION OF TEMPORARY PERMIT.
.010 Every temporary permit for the display and sale or
disposition of Christmas trees or Halloween pumpkins shall expire
on the 7th day of January of the year immediately following the
Christmas or Halloween for which the permit was approved and
issued.
6.42.070 APPEAL FROM DENIAL OF PERMIT.
If the application for a temporary permit be disapproved by
the License Division, Planning Department or Fire Department on
the ground that provisions of this chapter have not been complied
with, the applicant may take an appeal from such action by filing
a written notice of appeal from such denial with the License
Collector within ten days following the date of the denial of the
application. Such written notice of appeal shall set forth the
reasons for appeal from the denial of the application. Upon
receipt of a notice of appeal, a hearing shall be set before the
City Manager or his or her designee not less than ten days, nor
more than thirty days, from the date of the filing of the appeal.
Upon such hearing the City Manager or his or her designee may
approve or deny the application upon such conditions as he or she
shall deem proper. Upon any such appeal, the decision of the
City Manager or his or her designee shall be final.
6.42.080 POSTING OF CASH SECURITY.
At the time of approval of any such temporary permit, the
License Division shall require the applicant to deposit the sum
of one hundred dollars cash to insure that the premises used for
the temporary display and sale shall be cleared of all equipment
and temporary structures used in connection with such sale and
display and that such premises are left in a clean and sanitary
condition. If such equipment and temporary structures are removed
and such premises are left in a clean and sanitary condition on
or before midnight of January 7th of the year immediately
following the year in which the application for such permit was
filed, the said cash shall be returned to the applicant. If the
premises are not put in a clean and sanitary condition, and if
all equipment or temporary structures used in connection with the
temporary display and sale of Christmas trees or Halloween
pumpkins are not removed, then the City or its agents or
employees may enter upon the property and do all things necessary
to clean said premises and remove said equipment and temporary

structures, and the cost of such work shall be deducted from said
cash deposit and the remainder, if any, returned to the
permittee. As a condition to the acceptance of the permit it
shall be expressly agreed in writing by both the owner of the
premises as well as the permittee that the City or its agents
shall have authority to enter upon the premises to carry out the
provisions of this section.
6.42.090 FIRE EXTINGUISHER ON PREMISES.
There shall be maintained in each premises within which
Christmas trees or Halloween pumpkins are sold or offered for
sale a fire extinguisher in good order and condition and of a
water type approved by the Chief of the Fire Department.
6.42.100 INSPECTION OF PREMISES.
.010 After the approval of said permit and upon the
establishment of such premises, the Fire Department shall inspect
said premises to insure said premises are in all respects in
conformity with the provisions of Title 16 of the Anaheim
Municipal Code.
.020 If the inspection pursuant to subsection .010 above
reveals that said premises do not conform to the aforementioned
provisions of the Anaheim Municipal Code, such premises shall not
be operated for the purpose of the temporary sale or disposition
of Christmas trees or Halloween pumpkins until such time as said
premises do conform to such provisions.
6.42.110 PARKING AND ZONING REQUIREMENTS.
No such premises shall be established unless adequate
parking has been provided for the use of the customers of such
premises. Such parking provisions shall not result in the
creation of dust conditions, and no such premises shall be
established in any zone except C, M or R -A Zones, unless the City
Council shall, upon proper application to it, approve the
establishment of premises in some other location.

6.42.120 ESTABLISHMENT OF TEMPORARY STRUCTURES ON PREMISES.
.010 If guards or watchmen are provided for the purpose of
watching Christmas trees or Halloween pumpkins on any premises,
such guards or watchmen shall be at least eighteen years of age.
.020 Temporary sanitary facilities may be provided by the
permittee for the use of guards, watchmen and other persons
connected with the sale or disposition of such Christmas trees or
Halloween pumpkins, remaining on the premises. Such sanitary
facilities shall be subject to the approval of the Department of
Public Works.
.030 Provisions may be made by the permittee for the
placement of temporary structures, house trailers or tents on the
premises for the use of the permittee or his agents. No such
temporary structure, house trailer or tent shall be permitted on
the premises unless the same shall have been expressly approved
by the Building Division.
6.42.130 ADULT ON DUTY DURING SALES HOURS.
A person of at least eighteen years of age shall be on duty
at all times during the sale or disposition of Christmas trees or
Halloween pumpkins and all sales shall be made from the premises.
6.42.140 SEVERABILITY.
If any section, subsection, sentence, clause or phrase of
this chapter is for any reason held to be unconstitutional or
void, such decision shall not affect the validity of the
remaining portions of this chapter. The City Council hereby
declares that it would have adopted and passed this chapter and
each section, subsection, sentence, clause and phrase thereof
irrespective of the fact that any one or more sections,
subsections, sentences, clauses or phrases be declared
unconstitutional or void.
6.42.150 PENALTY FOR VIOLATIONS.
Any person who violates any of the provisions of this
chapter is guilty of a misdemeanor and shall, upon conviction
thereof, be punished in the manner provided in Section 1.01.370.
Failure of a permittee to conform to all applicable provisions of
this chapter shall constitute grounds for denial of a subsequent
permit under this chapter."
SECTION 13.
That paragraph .0702 of subsection .070 of Section
6.44.010 of Chapter 6.44 of Title 6 of the Anaheim Municipal Code
be, and the same is hereby, amended to read as follows:
".0702 Maintaining property where buildings exist in
any of the following conditions:
.01 Maintaining property where buildings have
been left boarded up for a period in excess of ten days without a
valid demolition or building permit on file with the Anaheim
Building Division to abate said boarded up condition.
.02 Maintaining property where buildings have
been left open and unsecured from trespassers, children or
vandals for a period in excess of ten days.
.03 Maintaining property where buildings, vacant
or occupied, have been left in a state of partial construction
and where for ten days or more no current (unexpired) building
permit was on file with the Anaheim Building Division to complete
said construction."
SECTION 14.
That paragraph .0705 of subsection .070 of Section
6.44.010 of Chapter 6.44 of Title 6 of the Anaheim Municipal Code
be, and the same is hereby, amended to read as follows:
".0705 Maintaining property with overgrown
vegetation:
.01 Causing detriment to neighboring properties
or property values or causing a hazardous condition to pedestrian
and/or vehicular traffic.
.02 Likely to harbor rats, vermin or other
nuisances.
.03 Preventing, impeding or otherwise restricting
access to electric, water or gas meters, or to any other public
equipment or facilities, by persons representing the City of
Anaheim Public Utilities Department or any other utility
requiring or seeking access thereto."

SECTION 15.
That subsection .080 of Section 6.44.010 of Chapter
6.44 of Title 6 of the Anaheim Municipal Code be, and the same is
hereby, amended to read as follows:
".080 Graffiti. Permitting or allowing any graffiti to remain
on any building, wall, fence, vehicle or structure for a period
in excess of five days."
SECTION 16.
That paragraph .0904 of subsection .090 of Section
6.44.010 of Chapter 6.44 of Title 6 of the Anaheim Municipal Code
be, and the same is hereby, amended to read as follows:
".0904 Whenever any building, portion of a building,
or any member, appurtenance or ornamentation on the exterior
thereof is not of sufficient strength or stability or is not so
anchored, attached, or fastened in place so as to be capable of
resisting wind pressure, earthquake forces, live -load or
dead -load as specified in the Anaheim Building Code as adopted by
Title 15 of this Code without exceeding the working stresses
permitted in the Anaheim Building Code."
SECTION 17.
That paragraph .0909 of subsection .090 of Section
6.44.010 of Chapter 6.44 of Title 6 of the Anaheim Municipal Code
be, and the same is hereby, amended to read as follows:
".0909 Any building or structure which has been
_ constructed or which now exists or is maintained in violation of
any specific requirement or prohibition applicable to such
building or structure of the building regulations of this City as
set forth in the Anaheim Building Code or Anaheim Housing Code,
or of any law or ordinance of this State or City relating to the
construction, condition, location or structure of buildings."
SECTION 18.
That paragraph .0913 of subsection .090 of Section
6.44.010 of Chapter 6.44 of Title 6 of the Anaheim Municipal Code
be, and the same is hereby, amended to read as follows:
".0913 Any building which meets the definition of a
substandard building in the Anaheim Housing Code."

SECTION 19.
That paragraph .0914 of subsection .090 of Section
6.44.010 of Chapter 6.44 of Title 6 of the Anaheim Municipal Code
be, and the same is hereby, amended to read as follows:
".0914 Any building that does not conform to fire
resistive requirements of the Anaheim Building Code."
SECTION 20.
That paragraph .0915 of subsection .090 of Section
6.44.010 of Chapter 6.44 of Title 6 of the Anaheim Municipal Code
be, and the same is hereby, repealed.
SECTION 21.
That new Section 6.44.180 be, and the same is hereby,
added to Chapter 6.44 of Title 6 of the Anaheim Municipal Code,
to read as follows:
"6.44.180 DEFINITIONS.
.010 The term `Anaheim Building Code' as used in this
chapter shall mean that certain building code adopted pursuant to
Chapter 15.02 of Title 15 of the Anaheim Municipal Code.
.020 The term `Anaheim Housing Code' as used in this chapter
shall mean that certain housing code adopted pursuant to Chapter
15.02 of Title 15 of the Anaheim Municipal Code."
SECTION 22.
That Section 6.56.010 of Chapter 6.56 of Title 6 of the
Anaheim Municipal Code be, and the same is hereby, amended to
read as follows:
"6.56.010 FENCE REQUIRED — SPECIFICATIONS.
.010 Any swimming pool, ponds or other body of water on
private property designed or intended to contain water more than
eighteen inches in depth at any point, shall be enclosed by a
barrier adequate to prevent entry of small children. The solid
walls of a fence, dwelling, building or structure may constitute
a part of the barrier. Such barriers, fences and walls shall
comply with Sections 419, 420 and 421 of the Appendix of the most
current edition of the Anaheim Building Code.

.020 Compliance. No pool or pond subject to this chapter
shall be plastered or filled with water until the Building
Official has determined that the provisions of this chapter have
been met.
.030 Exceptions to the requirements of this section shall be
as set forth in the most current edition of the Anaheim Building
Code."
SECTION 23.
That Section 6.68.030 of Chapter 6.68 of Title 6 of the
Anaheim Municipal Code be, and the same is hereby, amended to
read as follows:
"6.68.030 AUTHORITY OF THE HEALTH OFFICER.
The Health Officer is hereby authorized to administer and
enforce the provisions of the Health and Safety Code of the State
of California, and any rules and regulations adopted thereunder,
pertaining to wiping rags and wiping rags businesses.
A permit under this chapter shall be issued by the Health
Officer if the applicant complies with the provisions of Article
4 of Chapter 1 of Part 15 of Division 104 of the Health and
Safety Code and any regulations adopted thereunder, or any
successor provisions or regulations thereto. The period of the
permit shall be one year from date of issuance. Any permit issued
hereunder may be suspended or revoked in the manner prescribed in
Section 118470 of the Health and Safety Code, or any successor
provision thereto."
SECTION 24.
That Section 6.68.050 of Chapter 6.68 of Title 6 of the
Anaheim Municipal Code be, and the same is hereby, amended to
read as follows:
"6.68.050 PENALTY.
Any person violating any of the provisions of this chapter
shall be deemed guilty of a misdemeanor."
SECTION 25.
That Section 6.70.030 of Chapter 6.70 of Title 6 of the
Anaheim Municipal Code be, and the same is hereby, amended to
read as follows:

"6.70.030 ENFORCEMENT.
The Code Enforcement Manager of the City of Anaheim shall
enforce the provisions of this chapter."
SECTION 26. SEVERABILITY
The City Council of the City of Anaheim declares that
should any section, paragraph, sentence or word of this ordinance
hereby adopted be declared for any reason to be invalid, it is
the intent of the Council this it would have passed all other
portions of this ordinance independent of the elimination
herefrom of any such portion as may be declared invalid.
SECTION 27. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal
or amendment of any other ordinance of this City shall in any
manner affect the prosecution for violations of ordinances, which
violations were committed prior to the effective date thereof,
nor be construed as a waiver of any tax, license or penalty or of
the penal provisions applicable to any violations thereof. The
provisions of the ordinance, insofar as they are substantially
the same as ordinance provisions previously adopted by the City
relating to the same subject matter, shall be construed as
restatements and continuations, and not as new enactments.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 11thday of June ,
2002.
