ORDINANCE NO. 4960
AN ORDINANCE OF THE CITY OF ANAHEIM ADDING NEW
SECTION 1.04.999 TO CHAPTER 1.04 OF TITLE 1 OF THE
ANAHEIM MUNICIPAL CODE RELATING TO CONFLICTS OF
INTEREST
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
SECTION 1.
That new Section 1.04.999 be, and the same is hereby,
added to Chapter 1.04 of Title 1 of the Anaheim Municipal Code to
read as follows:
"1.04.999 BOARDS AND COMMISSIONS - -
CONFLICTS OF INTEREST
.010 It shall be unlawful for any
member of any board or commission of the City of Anaheim to make,
participate in making, or in any way attempt to use his or her
official position to influence a governmental decision in which he
or she knows or has reason to know he or she has a financial
interest.
.020 The provisions of subsection
.010 above shall apply only to members of boards and commissions
of the City not subject to the provisions of Section 87100 of the
Government Code of the State of California.
.030 The definition of terms,
interpretation and application of subsection .010 above shall be
as set forth in Article 1 of Chapter 7 of Title 9 (commencing with
Section 87100) of the Government Code and all applicable
provisions of the California Administrative Code adopted pursuant
thereto, as the same may be hereinafter amended, except that the
term "public official" as used in the aforesaid provisions of the
Government Code and California Administrative Code shall refer to
members of boards and commissions which perform a solely advisory
function and which members for such reason would not otherwise be
subject to the provisions of Section 87100 of the Government Code."
SECTION 2. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance, hereby adopted, be declared for any reason to be
invalid, it is the intent of the Council that it would have passed
all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 3. PENALTY
It shall be unlawful for any person to violate any
provision or to fail to comply with any of the requirements of
this ordinance. Any person violating any provision of this
ordinance or failing to comply with any of its requirements shall
be deemed guilty of a misdemeanor and upon conviction thereof
shall be punished by a fine not exceeding Five Hundred Dollars
($500.00) or by imprisonment not exceeding six (6) months, or by
both such fine and imprisonment. Each such person shall be deemed
guilty of a separate offense for each day during any portion of
which any violation of any of the provisions of this ordinance is
committed, continued or permitted by such person, firm or
corporation, and shall be punishable therefor as provided for in
this ordinance. The penalty contained in this section shall be in
addition to any other criminal or civil penalties provided by law
for any such violation.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 20th day of September, 1988.
