A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM SUPPORTING EQUAL OPPORTUNITY FOR
CHARTER SCHOOLS CHARTERED BY SCHOOL DISTRICTS
OPERATING WITHIN CITY LIMITS TO ACCESS AND
UTILIZE CITY FACILITIES SIMILAR TO PRE-EXISTING
JOINT USE AGREMEENTS FOR RECREATIONAL SPACE
AND DETERMINING SAID ACTION IS EXEMPT FROM THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT
PURSUANT TO CEQA GUIDELINES SECTIONS 15060(C)(2)
AND 15060(C)(3) AND NOT A PROJECT UNDER SECTION
15378
WHEREAS, every California child deserves the opportunity to have quality education;
and
WHEREAS, some California school districts are beginning to utilize a public charter
school model to provide quality education to the children they serve; and
WHEREAS, the Anaheim City School District (ACSD) approved its first charter school
petition in the district in 2014, with the approval of the GOALS Academy; and
WHEREAS, the City of Anaheim takes great pride in having a strong and longstanding
tradition of partnering with all school districts operating within the boundaries of the City and
schools in order to provide the best for the youth in our community; and
WHEREAS, the City of Anaheim has existing joint use agreements with all Anaheim
school districts that allow for the shared use of play fields for both students and citizens alike;
and
WHEREAS, charter schools could utilize non-traditional school sites that may not benefit
from one of the existing joint use agreements for recreational play space within the City and the
City desires to establish this policy to provide for opportunities for such charter schools to also
benefit from shared use of play fields.
WHEREAS, the City Council finds and determines that the establishment the matter
addressed in this Resolution, is not subject to the California Environmental Quality Act of 1970,
as amended (Public Resources Code Section 21000 et seq.; herein referred to as "CEQA"),
pursuant to Sections 15060(c)(2) and 15060(c)(3) of the State of California Guidelines for
Implementation of the California Environmental Quality Act (California Code of Regulations,
Title 14, Chapter 3; herein referred to as the "CEQA Guidelines"), because it will not result in a
direct or reasonably foreseeable physical change in the environment and is not a "project" as
defined in Section 15378 of the CEQA Guidelines.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as
follows:
The Anaheim City Council supports the goal of providing all eligible Anaheim
charter schools operated by school districts within the City's boundaries with an
equal opportunity to utilize City recreational facilities in a manner consistent with
more traditional joint use agreements, as appropriate and as may be further
considered by the City Council upon request by such charter schools.
2. The Anaheim City Council encourages all school districts within Anaheim to
proactively work with and inform the City in advance when considering the
creation of any new charter school in order to address early on any joint use or
partnerships opportunities.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of the
City of Anaheim this 1 8thday of August , 2015, by the following roll call vote:
