AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
SECTION 18.01.120 OF CHAPTER 18.01 AND
SUBSECTION 18.06.050.0241 OF CHAPTER 18.06
OF TITLE 18 OF THE ANAHEIM MUNICIPAL CODE
RELATING THE DEFINITIONS OF KITCHENETTES AND
REQUIRED PARKING FOR HOTELS/MOTELS
RESPECTIVELY.
THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS
FOLLOWS:
SECTION 1.
That Section 18.01.120 of Chapter 18.01 of Title 18 of
the Anaheim Municipal Code be, and the same is hereby, amended by
adding the following:
"'Kitchenette' Any room or area within a motel
unit intended or designed for the preparation of
food but limited to a six (6) cubic foot
refrigerator, two (2) burner stove without
provisions for oven and/or baking facilities, and a
single compartment sink."
SECTION 2.
That Subsection 18.06.050.0241 of Section 18.06.050 of
Chapter 18.06 of Title 18 of the Anaheim Municipal Code be, and
the same is hereby, amended to read as follows:
11.0241 Hotels/Motels: For the purpose of
this paragraph, no distinction is made between
motels and hotels. The following minimum number of
parking spaces shall be provided: Four-fifths (0.8)
of a space per guest room without kitchenettes; one
and three-fifths (1.6) spaces per guest room with
kitchenettes, plus fifteen (15) spaces per 1,000
square feet of GFA of eating/drinking areas plus ten
(10.0) spaces per 1,000 square feet of
banquet/meeting room areas, plus the following
employee spaces: One quarter (0.25) space per each
employee working in guest room areas; four and
three-fifths (4.6) employee spaces per 1,000 square
feet of GFA for eating/drinking areas, one (1.0)
employee space per 1,000 square feet of GFA for
retail areas; five (5.0) employee spaces per 1,000
square feet of GFA for banquet/meeting rooms."
SECTION 3. SEVERABILITY
The City Council of the City of Anaheim hereby declares
that should any section, paragraph, sentence or word of this
ordinance, hereby adopted, be declared for any reason to be
invalid, it is the intent of the Council that it would have passed
all other portions of this ordinance independent of the
elimination herefrom of any such portion as may be declared
invalid.
SECTION 4. SAVINGS CLAUSE
Neither the adoption of this ordinance nor the repeal
hereby of any other ordinance of this City shall in any manner
affect the prosecution for violations of ordinances, which
violations were committed prior to the effective date hereof, nor
be construed as a waiver of any license or penalty or the penal
provisions applicable to any violation thereof. The provisions of
this ordinance, insofar as they are substantially the same as
ordinance provisions previously adopted by the City relating to
the same subject matter, shall be construed as restatements and
continuations, and not as new enactments.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 26th day of May, 1987.
