AN ORDINANCE OF THE CITY OF ANAHEIM AMENDING
THE ZONING MAP REFERRED TO IN TITLE 18 OF THE
ANAHEIM MUNICIPAL CODE RELATING TO ZONING
BASED UPON THE FINDING AND DETERMINATION THAT
SAID AMENDMENT IS EXEMPT FROM THE PROVISIONS
OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT
(CEQA) PURSUANT TO SECTION 15060(C)(2) OF THE
STATE CEQA GUIDELINES.

WHEREAS, the Planning Commission of the City of Anaheim (the "Planning
Commission") did receive a verified petition. to "pre -zone" a 395 square foot (approximate)
parcel of land (herein referred to as the "Pre -zone Parcel") that is presently located within the
City of Orange. The Pre -zone Parcel is legally described on Exhibit A attached hereto and
graphically depicted on Exhibit B attached hereto, both of which exhibits are incorporated herein
by this reference; and
WHEREAS, the Pre -zone Parcel is a part of that certain real property located at 2300
South Lewis Street and 2237 South Manchester Avenue in the City of Anaheim, County of
Orange, State of California, as generally depicted on the map attached hereto as Exhibit C and
incorporated herein by this reference (the "Property"), which Property is designated by the
Orange County Assessor as Assessor's Parcel No. 137-451-35; and
WHEREAS, the petitioner is the owner of the Pre -zone Parcel and has applied to the
Local Agency Formation Commission (LAFCO) to have the Pre -zone Parcel annexed to the
City; and
WHEREAS, State law pennits a city to pre -zone property adjoining the city for the
purpose of determining zoning that will apply to such property in the event of subsequent
annexation to the city. Pre -zoning becomes effective at the same time that the annexation
becomes effective; and
WHEREAS, following a duly noticed public hearing held on August 10, 2015, pursuant
to the provisions of Chapter 18.60 of the Anaheim Municipal Code, the Planning Commission of
the City of Anaheim did adopt its Resolution No. PC2015-054, determining that the Pre -zone
Parcel should be pre -zoned to the"RM-4" Multiple -Family Residential Zone; and
WHEREAS, pursuant to and in accordance with the provisions of the California
Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as
"CEQA"), the State of California Guidelines for Implementation of the California Environmental
Quality Act (herein referred to as the "CEQA Guidelines"), and the City's Local CEQA
Procedure Manual, the City is the "lead agency" for the preparation and consideration of
environmental documents for Reclassification No. 2015-00281; and
WHEREAS, the Planning Commission did find and determine that (1) there will be no
change to the existing uses of the Pre -zone Parcel as a result of proposed Reclassification No.
Reclassification No. 2015-00281, (2) proposed Reclassification No. 2015-00281 does not
involve a commitment to any specific project which may be proposed on the Property to which
the Pre -zone Parcel is attached, (3) the Proposed Project will not result in a direct or reasonably
foreseeable indirect physical change in the environment, and, therefore, is exempt from the
provisions of CEQA pursuant to Section 15060(c)(2) of the CEQA Guidelines; and
WHEREAS, accordingly, in consideration of the determination and recommendation of
the Planning Commission and its own independent judgment, this City Council finds and
determines that Reclassification No. 2015-00281 is exempt from the provisions of CEQA under
and pursuant to Section 15060(c)(2) of the CEQA Guidelines; and
WHEREAS, the proposed pre -zoning is consistent with the Anaheim General Plan,
which designates that portion of the Property adjacent to the Pre -zone Parcel for "Medium
Density Residential" land uses.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES
ORDAIN AS FOLLOWS:
SECTION 1.
That the Zoning Map referred to in Title 18 of the Anaheim Municipal Code be, and the
same is hereby, amended by zoning the Pre -zone Parcel, as described above, into the "RM -4"
Multiple -Family Residential Zone of the City of Anaheim effective upon annexation of the Pre-
zone Parcel to the City of Anaheim.
SECTION 2.
Effective upon annexation of the Pre -zone Parcel to the City of Anaheim, the City Zoning
Map shall be amended and the above-described Pre -zone Parcel shall be made a part of the "RM -
4" Multiple -Family Residential Zone, and said City Zoning Map, as amended, is hereby adopted.
Effective upon annexation of the Pre -zone Parcel to the City of Anaheim, the Planning and
Building Department is hereby directed to prepare a sectional zoning map to be added to the City
Zoning Map showing the changes hereby approved and adopted.
SECTION 3. CERTIFICATION
The City Clerk shall certify to the passage of this ordinance and shall cause the same to
be printed once within fifteen (15) days after its adoption in the Anaheim Bulletin, a newspaper
of general circulation, published and circulated in the City of Anaheim, and thirty (30) days from
and after its final passage, it shall take effect and be in full force.
