AN ORDINANCE OF THE CITY OF ANAHEM EXTENDING
INTERIM ORDINANCE NO. 4711 PROHIBITING ANY
USES OF CERTAIN DESCRIBED PROPERTY WHICH USES
ARE IN CONFLICT WITH THE ZONING PROPOSAL THE
CITY IS CONSIDERING FOR SUCH PROPERTY AND
DECLARING THAT THIS ORDINANCE IS AN URGENCY
MEASURE WHICH SHALL TAKE IMMEDIATE EFFECT.
WHEREAS, the City Council of the City of Anaheim did, on
May 6, 1986, adopt Ordinance No. 4711 as an urgency measure; and
WHEREAS, Ordinance No. 4711 did prohibit the issuance of
permits, certificates of occupancy or other entitlements to use
for certain properties for uses not in conformity with Section 1
of Ordinance No. 4711; and
WHEREAS, Ordinance No. 4711 was adopted pursuant to
Section 65858 of the Government Code and will expire by its terms
on the forty-fifth day after adoption of Ordinance No. 4711; and
WHEREAS, Section 65858 permits the extension of such an
interim ordinance for up to ten (10) months and fifteen (15) days;
and
WHEREAS, an extension of Ordinance No. 4711 is necessary
to prevent issuance of any permits for uses inconsistent with the
General Plan.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM
DOES ORDAIN AS FOLLOWS:

That Ordinance No. 4711 be, and it is hereby, extended
for a period of ten (10) months and fifteen (15) days.
SECTION 2_
That the City Council finds and determines that there is
a current and immediate threat to the public health, safety, or
welfare, in that the approval of additional subdivisions, use
permits, variances, building permits or other entitlements to use
on properties shown in red on that map on file in the Zoning
Division of the Community Development and Planning Department
entitled Commercial -Recreation Area - Urgency C-R Ordinance, dated
June 17, 1986, except as permitted in Section 1 of Ordinance No.
4711, would result in a threat to public health, safety, or
welfare.
SECTION 3
That the City Council may, by resolution, exempt
parcel(s) from the prohibition of Ordinance No. 4711 upon an
approval of an agreement with the property owner and a finding
that the proposed development is not detrimental to the public
health, safety or welfare.
THE FOREGOING ORDINANCE is approved and adopted by the
City Council of the City of Anaheim this 17th day of June, 1986.
