RESOLUTION 2008- 151
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM VACATING A PORTION OF A PUBLIC UTILITY
EASEMENT LOCATED AT 8710 HEATHERWOOD ROAD
PURSUANT TO CALIFORNIA STREETS AND HIGHWAY
CODE SECTION 8330, ET SEQ. SUMMARY VACATION.
(Abandonment No. ABA 2007 00147)
WHEREAS, an applicant has requested the vacation of a portion of an easement for
public utility purposes located at 8710 Heatherwood Road, Anaheim, California, in order to clear
title to the land for the construction of a swimming pool; and
WHEREAS, the public utility easement to be vacated is not necessary for present or
prospective public utility purposes; and
WHEREAS, the easement to be vacated is superseded by relocation of public utilities
and there are no other public facilities located within the easement; and
WHEREAS, the easement to be vacated has not been used for the purpose for which
it was dedicated or acquired for five consecutive years immediately preceding this proposed
vacation.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of a portion of the easement for public utility purposes, as
dedicated and delineated on Tract Map 15072, recorded May 19, 1998 in Book 767, Pages 11
through 14 of the records of Official records, Orange County, State of California and more
particularly described in Exhibits "A" and "B" attached hereo.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby authorized
and directed, to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange.
BE IT FURTHER RESOLVED that from and after the date the certified copy of this
Resolution is recorded in the Office of the Recorder of the County of Orange, the vacation shall be
complete and the public service easement vacated shall no longer constitute a public service
easement.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 12th day of August 2008, by the following roll call vote:
