A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM REQUESTING THE STATE OF CALIFORNIA,
ACTING BY AND THROUGH ITS DEPARTMENT OF
TRANSPORTATION "CAI,TRANS TO ALLOCATE
$2,800,000 MEASURE M CONSTRUCTION CAPITAL COST
FUNDS TO CITY OF ANAHEIM FOR DAMAGES TO CITY
STREETS DURING THE INTERSTATE 5 WIDENING
PROJECT
WHEREAS, the citizens of Orange County approved passage of Measure M in
November, 1990, authorizing the Orange County Transportation Authority "OCTA to
administer a one -half of one percent transportation sales tax to support a specific transportation
improvement plan, applicable in the incorporated and unincorporated territory of the County of
Orange; and
WHEREAS, Measure M provided funding for numerous transportation projects,
including freeways, local roads, major streets, interchanges, the Metrolink commuter train
system, senior bus fare stabilization, signal synchronization and more; and
WHEREAS, the State of California, by and through its Department of
Transportation "Caltrans widened Interstate 5 between Route 22 and Route 91 and during
such transportation improvement project utilized City of Anaheim "City streets for freeway
detours during construction of said improvements; and
WHEREAS, Caltrans received Two Million Eight Hundred Thousand Dollars
($2,800,000.00) in Measure M construction capital cost funds from OCTA after entering into a
cooperative agreement in order to reimburse City; and
WHEREAS, Caltrans and City desire to enter into a cooperative agreement (the
"Agreement which Agreement provides for the transfer of Two Million Eight Hundred
Thousand Dollars ($2,800,000.00) from Caltrans to the City for the purpose of reimbursing the
City for damages to the pavement of City streets used for the freeway detours during the
Interstate 5 widening project; and
WHEREAS, the terms and conditions of the Agreement are in the best interest of
the City of Anaheim and are acceptable to the City Council.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim that the terms and conditions of the Agreement be, and they are hereby, approved.
BE IT FURTHER RESOLVED that the Mayor and City Clerk be, and they are
hereby, authorized and directed to sign said Agreement on behalf of the City of Anaheim
BE IT FURTHER RESOLVED by the City Council of the City of Anaheim that
the State of California, acting by and through its Department of Transportation is hereby
requested to allocate to the City of Anaheim the sum of Two Million Eight Hundred Thousand
Dollars ($2,800,000.00) Measure M construction capital cost funds for construction of said
freeway detour improvements.
THE FOREGOING RESOLUTION is approved and adopted by the City Council
of the City of Anaheim this 1 6th day of September 2008, by the following roll
