A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ANAHEIM APPROVING A LETTER OF
UNDERSTANDING BETWEEN THE INTERNATIONAL BROTHERHOOD
OF ELECTRICAL WORKERS, LOCAL 47 AND THE CITY OF ANAHEIM
WHEREAS, the City of Anaheim and the International Brotherhood of Electrical
Workers, Local 47, have met and conferred over the transfer into the Brotherhood of certain
employees in classifications represented by the Anaheim Municipal Employees Association; and
WHEREAS, the International Brotherhood of Electrical Workers, Local 47, is in
agreement with the recommendations contained in said Letter of Understanding; and
WHEREAS, as a result thereof, the Letter of Understanding dated June 24, 2002
between the parties has been prepared and signed; and
WHEREAS, the City Council of the City of Anaheim does find that it is in the best
interest of the City of Anaheim to approve said Letter of Understanding.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Anaheim that the Letter of Understanding dated June 21, 2002, between the International
Brotherhood of Electrical Workers, Local 47, and the City of Anaheim, a copy of which is
attached hereto and incorporated by reference herein, is hereby approved.
THE FOREGOING RESOLUTION, is approved and adopted by the City Council
of the City of Anaheim this 23~:d day of July 2002.

The International Brotherhood of Electrical Workers, Local 47 ("UNI'ON'~ and the City of
Anaheim ("CFI-Y'~ have met and conferred in good faith and reached agreement regarding
wages, hours, and other terms and conditions of employment for employees working in the
classifications of Electrical Utility Inspector, Water Utility Inspector, Senior Electrical Utility
Inspector, and Senior Water Utility Inspector, previously represented by the Anaheim Municipal
Employees Association, General Employees Unit. The Parties hereby agree to the following:
Appendix "A" Wages of the Memorandum of Understanding between UNION and
C~q'Y is amended to incorporate general wage adjustments ~or the classifications of
Electrical Utility Inspector, Water Utility Inspector, Senior Electrical Utility Inspector,
and Senior Water Utility Inspector, as follows:

Employees working in the classifications of Electrical Utility Inspector, Water Utility
Inspector, Senior Electrical Utility Inspector, and Senior Water Utility Inspector shall be
considered "assigned to a department other than the Public Utilities Department" for the
purpose of administering terms and conditions of employment in accordance with the
following Articles of the Memorandum of Understanding:
Article 35 Holidays
Article 42 Overtime
Article 44 Call-Out
Article 45 Distribution
Article 47 Planned Overtime
Article 49 Short Shift Change
Article 52 Meals
This provision of this Letter of Understanding shall be effective through and including
.lanuary 1, 2004. Effective .lanuary 2, 2004, an employee working in the classification of
Electrical Utility Inspector, Water Utility Inspector, Senior Electrical Utility Inspector, or
Senior Water Utility Inspector shall be considered a "Public Utilities Department employee"
for the purpose of administering the terms and conditions of employment in accordance
with all provisions of the Memorandum of Understanding.
Except as expressly agreed to above, all terms and conditions of the Memorandum of
Understanding between the City and the International Brotherhood of Electrical Workers,
Local ~,7 dated July 21, 2001 through ,luly 27 2005 shall apply to employees working in the
classifications of Electrical Utility Inspector, Water Utility Inspector, Senior Electrical Utility
Inspector, or Senior Water Utility Inspector, effective the first day of the pay period
following City Council approval of this Letter of Understanding.
The UNION acknowledges the importance of the inspection function to the efficiency and
effectiveness of the Public Utilities Department, and agrees to cooperate with Public Utilities
management to ensure that Utility Inspectors work in an environment free of intimidation
and harassment.

The Parties affirm their mutual intent to preserve those informal practices with regard to the
assignment of work, distribution of overtime, determination of work schedules, and other
work unit practices that have evolved to serve the interests of the employees and the
department. The Parties agree that such practices shall stand unless the practice is in direct
violation of the terms and conditions of the Memorandum of Understanding. UN[ON further
agrees that it will not challenge such informal practices through the grievance procedure
without first notifying CITY of its belief that a practice is in direct violation of the terms and
conditions of the Memorandum of Understanding, and providing CITY with the opportunity
to discuss the concerns of the UN[ON. Any grievance filed challenging a work practice shall
be limited to whether or not the practice violates the express written terms and conditions
of the Memorandum of Understanding.
