A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ANAHEIM AMENDING CITY COUNCIL POLICY 5.7
RELATING TO PERMIT PARKING
WHEREAS, on August 7, 2007, the City Council added City Council Policy 5.7 entitled
"Permit Parking" to the City Council Policy Manual, and thereafter amended on May 19, 2009
and January 6, 2015, relating to spillover parking and establishment of permit parking; and
WHEREAS, the City Council now desires to amend the City Council Policy Manual to
increase the required number of petition signatures, require multi -day parking study and
associated fee and streamline the survey process.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Anaheim as
follows:
Section 1. Paragraph 1 of Policy No. 5.7 entitled, "Permit Parking" is hereby deleted
in its entirety from the City Council Policy Manual and replaced with the following:

1. Anaheim Traffic and Transportation Manager receives a written petition signed
by residents, property managers or property owners representing a minimum of ten
homes or buildings in the identified area defining a parking problem in terms of tunes,
locations and source(s) of spillover parking. A parking study fee will be required to
accept the petition."
Section 2. Paragraph 2 of Policy No. 5.7 entitled, "Permit Parking" is hereby deleted
in its entirety from the City Council Policy Manual and replaced with the following:
"2. Field evaluation is performed by the City to determine whether 75% or more of
street parking spaces are used on each street segment identified in the petition during the
identified times on multiple days. If parking study shows the streets are not at least 75%
occupied, permit parking will not be an option."
Section 3. Paragraph 3 of Policy No. 5.7 entitled, "Permit Parking" is hereby deleted
in its entirety from the City Council Policy Manual and replaced with the following:
T13. Traffic and Transportation Manager sends a letter to potentially affected residents
and owners to request their participation at a meeting scheduled to refine the parking
problem definition, Permit Parking program requirements and identify appropriate study
area. If significant support is shown, the process continues to next step."
Section 4. Paragraph 7 of Policy No. 5.7 entitled, "Permit Parking' is hereby deleted
in its entirety from the City Council Policy Manual and replaced with the following:
117. A survey is mailed to residents and owners of the subject street to determine if
residents of the subject street are in favor of implementing Permit Parking on their street.
If 75% or more of the households surveyed favor implementing Permit Parking on their
street, the City Attorney's Office prepares a resolution for City Council consideration to
establish Parking District and implement Permit Parking on their street. Owner's survey
will override tenant's survey if they differ. For rental properties, one survey per parcel
will be counted. Staff will assist petitioner(s) by providing a list of non -responders so
they may encourage them to return the survey."
Section 5. Paragraph 8 of Policy No. 5.7 entitled, "Permit Parking" is hereby deleted
in its entirety from the City Council Policy Manual and replaced with the following:

8. Residents and owners will be informed of the outcome of the survey. Upon
establishment of a Permit Parking, permits will be processed as set forth in Section
14.32.450 of the Anaheim Municipal Code. Residents must self -certify garages will be
used to park operable vehicles. If Permit Parking fails to pass, implementation of a
Permit Parking may not be reconsidered until at least one year has elapsed from the date
of the election."
Section 6. Paragraph 9 of Policy No. 5.7 entitled, "Permit Parking" is hereby deleted
in its entirety from the City Council Policy Manual and replaced with the following:
19. Rescission of an established Permit Parking District may not be initiated until at
least two years have elapsed from the date of the City Council resolution establishing
Permit Parking. The survey to rescind shall use the procedure described in Step 7 and, if
approved, rescission shall be implemented by resolution of the City Council."
Section 7. Paragraphs 10, 11 and 12 of Policy No. 5.7 are hereby deleted in their
entirety.
Section 8. All other paragraphs of Policy No. 5.7 shall remain in full force and effect.
Section 9. This Resolution shall be effective immediately upon adoption

City of Anaheim this 1 5th day of -December 2015, by the following roll
call vote:
