5821ORDINANCE NO. 5821 AN ORDINANCE OF THE CITY OF ANAHEIM REPEALING EXISTING CHAPTER 15.02 AND ADDING NEW CHAPTER 15.02 TO TITLE 15 OF THE ANAHEIM MUNICIPAL CODE ADOPTING BY REFERENCE WITH AMENDMENTS THE 2001 EDITION OF THE CALIFORNIA BUILDING STANDARDS CODE, KNOWN AS CALIFORNIA CODE OF REGULATIONS, TITLE 24, INCORPORATING THE 1997 EDITION OF THE UNIFORM BUILDING CODE, THE 2000 EDITION OF THE UNIFORM MECHANICAL CODE, THE 2000 EDITION OF THE UNIFORM PLUMBING CODE, AND THE 1999 EDITION OF THE NATIONAL ELECTRICAL CODE; ADOPTING BY REFERENCE THE 1997 EDITION OF THE UNIFORM CODE FOR THE ABATEMENT OF DANGEROUS BUILDINGS, ADOPTING BY REFERENCE WITH AMENDMENTS THE 1997 EDITIONS OF THE UNIFORM SOLAR ENERGY CODE, THE UNIFORM SWIMMING POOL, SPA, AND HOT TUB CODE; AND THE 1997 EDITION OF THE UNIFORM HOUSING CODE, AS INCORPORATED INTO TITLE 25 OF THE CALIFORNIA CODE OF REGULATIONS. THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES ORDAIN AS FOLLOWS: SECTION 1. REPEAL OF CHAPTERS That Chapters 15.02 of Title 15 of the Anaheim Municipal Code be, and the same are hereby, repealed. SECTION 2. That new Chapter 15.02 of Title 15 be, and the same is hereby, added to the Anaheim Municipal Code to read as follows: "Chapter 15.02 UNIFORM CODES PERTAINING TO BUILDING AND CONSTRUCTION 15.02.000 APPROVAL OF UNIFORM CODES. The City Council does hereby find and determine, as a result of investigation conducted by the City and its Building Official, and by reason of the accepted principles and tests by recognized national or state authorities and technical and scientific organizations that each of the following uniform codes is approved for adoption by reference within the meaning of Section 50022.1 et seq of the Government Code of the State of California and Section 513 of the City Charter: .010 The 2001 Edition of the California Building Standards Code, known as Title 24 of the California Code of Regulations incorporating the following Uniform Codes: .0101 Uniform Building Code - 1997 ICBO Edition, as amended herein, including Appendices in addition to the Chapters listed in the California Adoption Matrix as follows: A4 BARRIERS FOR SWIMMING POOLS, SPAS AND HOT TUBS Al2 DIVISION I- INTERIOR ENVIRONMENT -VENTILATION Al2 DIVISION II & IIA -SOUND TRANSMISSION CONTROL A15 REROOFING A16 DIVISION II -EARTHQUAKE RECORDING INSTRUMENTATION A16 DIVISION IV -EARTHQUAKE REGULATIONS FOR SEISMIC ISOLATED STRUCTURES A18 WATER PROOFING AND DAMP PROOFING FOUNDATIONS A31 DIVISION I -FLOOD RESISTANT CONSTRUCTION A31 DIVISION II- MEMBRANE STRUCTURES A31 DIVISION III -PATIO COVERS A34 DIVISION III -REPAIRS TO BUILDINGS AND STRUCTURES DAMAGED BY THE OCCURRENCE OF AN NATURAL DISASTER, AS AMENDED HEREIN .0102 National Electrical Code- - 1999 NFPA Edition, with appendices, as amended herein. .0103 Uniform Mechanical Code- - 2000 IAPMO Edition, with appendices, as amended herein. .0104 Uniform Plumbing Code- - 2000 IAPMO Edition, with appendices, as amended herein. .020 The Uniform Code For The Abatement of Dangerous Buildings -1997 ICBO Edition, as amended herein. .030 The Uniform Housing Code -1997 ICBO Edition, as amended herein. .040 The Uniform Solar Energy Code -1997 IAPMO Edition, as amended herein. .050 The Uniform Swimming Pool, Spa, and Hot Tub Code -1997 IAPMO Edition, as amended herein. .060 The Codes set forth in this section are collectively referred to and may be cited as the "Uniform Codes", and, individually as the Anaheim Building Code, Anaheim Code for the F, Abatement of Dangerous Buildings, Anaheim Electrical Code, Anaheim Uniform Housing Code, Anaheim Mechanical Code, Anaheim Plumbing Code, Anaheim Solar Energy Code, Anaheim Swimming Pool, Spa, and Hot Tub Code and the California Building Standards Code, known as Title 24 of the California Code of Regulations. 15.02.010 ADOPTION OF UNIFORM CODES. The Uniform Codes, as amended by this chapter, are hereby adopted pursuant to Section 50022.1 et seq. of the California Government Code and Section 513 of the City Charter. 15.02.020 DESIGNATION OF ADMINISTRATIVE AUTHORITY. "Administrative Authority" or "Building Official" when used in the Uniform Codes shall mean the Building Official as designated in Section 1.04.150 of the Anaheim Municipal Code. 15.02.030 BOARD OF APPEALS. "Board of Appeals" when used in the Uniform Codes shall mean the Planning Commission. Said members shall hold their respective membership on said Board of Appeals by reason of, and concurrently with their respective terms of service as Planning Commissioners and shall cease to be such members of the Board of Appeals upon their ceasing to be planning commissioners. The Building Official shall be an ex officio member of the Board of Appeals. If not otherwise established in each of the Uniform Codes, a Board of Appeals is hereby established for each of the Uniform Codes. 15.02.040 FEES AUTHORIZED. .010 Notwithstanding any fees established in the Uniform Codes, the City Council may, by resolution, establish the fee for each permit, inspection, reinspection and other activity. Any reference in any Uniform Code to "fees" shall be deemed a reference to said resolution. If no such resolution is adopted, the fee set forth in the Uniform Code shall apply. .020 The fees for a permit for work which was commenced prior to issuance of the permit may be waived by the Building Official upon determining, in writing, that the work was undertaken as an emergency measure when the obtaining of a permit was impracticable and that the permittee applied for the permit as soon as practicable to do so. 3 15.02.050 EXPIRATION OF PERMITS ISSUED FOR ALL UNIFORM CODES .010 Expiration. Every permit issued by the Building Official under the provision of this code shall expire by limitation and become null and void if the building or work authorized by such permit has not passed final inspection 365 days from the date of permit issuance. After the original permit has expired, work may not commence or continue until an investigative inspection or plan review is conducted to ascertain that no changes have or will be made in the original plans and specifications. Appropriate fees for an investigative inspection or plan review shall be charged. .020 Once the investigation is complete, a renewed permit shall be obtained. In order to renew action on a permit after expiration, the permittee shall be required to pay one-half the amount required for a new permit for such work, provided that no changes have been made or will be made in the original plans and specifications. If new plans and specifications are to be used, the permittee shall pay a new full permit fee. A renewed permit shall be valid for 180 days. In order to renew a permit beyond the 180 day renewal period, the permittee shall pay a new full permit fee. .030 A permittee holding an unexpired permit may apply for an extension of time within which work may be commenced or continued under the permit when the permittee is unable to obtain a final inspection within the time required by this section for good and satisfactory reasons. The Building Official may extend the time for action by the permittee for a period not exceeding 180 days upon written request by the permittee showing that circumstances beyond the control of the permittee have prevented action from being taken. 15.02.060 AMENDMENTS TO UNIFORM BUILDING CODE. The following sections, definitions and provisions of the Uniform Building Code, 1997 ICBO Edition, as incorporated into the California Building Standards Code, Title 24 of the California Code of Regulations, are amended as set forth in this section: .010 Section 106.4.4 relating to Permit Expiration is hereby deleted since it has been replaced by Section 15.02.050 hereinabove. 0 .020 The Caption for Section 403 is hereby amended to read as follows: 'SECTION 403 - SPECIAL PROVISIONS FOR ALL HIGH RISE OCCUPANCIES' .030 Section 403.1 is hereby amended to read as follows: 'Section 403.1 Scope. This section applies to all occupancies each having floors used for human occupancy located more than 55 feet (16,764 mm) above the lowest level of fire department vehicle access. Such buildings shall be of Type I or Type II-F.R. construction and shall be provided with an approved automatic fire sprinkler system in accordance with Section 403.2.' .040 Section 403.1.1 [For SFM] is hereby amended to read as follows: `Section 403.1.1 [For SFM]. In addition to other applicable requirements of these regulations, the provisions of this section shall apply to every new building of any type of construction or occupancy having floors used for human occupancy located more than 55 feet above the lowest level of the fire department vehicle access. EXCEPTIONS: 1. Hospitals as defined in Section 1250 of the Health and Safety Code. 2. The following structures, while classified as high-rise buildings, shall not be subject to the provisions of this section, but shall conform to all other applicable provisions of this regulation. 2.1 Buildings used exclusively as open parking structures. 2.2 Buildings where all floors above the 55 -foot level are used exclusively as open parking structures. 2.3 Floors of buildings used exclusively as open parking garages and located above all 5 other floors used for human occupancy. 2.4 Buildings such as power plants. Lookout towers, steeples, grain houses and similar structures with non -continuous human occupancy, when so determined by the enforcing official. 2.5 Buildings used exclusively for jails and prisons. .050 Section 1005.3.3.7 is hereby amended to read as follows: 'Section 1005.3.3.7 Pressurized enclosure. In a building having a floor level used for human occupancy located more than 55 feet above the lowest level of fire department vehicle access, all required exit enclosures shall be pressurized in accordance with Section 905 and this section. Pressurization shall occur automatically upon activation of an approved fire alarm system. EXCEPTION: If the building is not equipped with a fire alarm system, pressurization shall occur upon activation of a spot -type smoke detector listed for releasing service within 5 feet (1524mm) of each vestibule entry. A controlled relief vent capable of discharging a minimum of 2,500 cubic feet per minute (1180L/s) of air at the design pressure difference shall be located in the upper portion of such pressurized exit enclosures. .060 Section 1503 is hereby amended to read as follows: 'Section 1503 Roofing Requirements. In all Group R-3 occupancy classifications, the roof covering or roof assembly of any building hereinafter constructed regardless of type or occupancy classification, including any re -roofing of any existing building when 50% or more of the total re -roof area is re -roofed within any one-year period, as specified in Chapter 15 of the Appendix hereto, shall be a Class A assembly in all areas of the City of Anaheim located east of the Costa Mesa Freeway (SR -55) and south of the Riverside Freeway (SR -91). 0 EXCEPTION: Attached room additions to existing residences. The roof covering or roofing assembly on any structure regulated by this code shall be as specified in Table No. 15-A and as classified in Section 1504. '(1) depicts buildings which are not more than two stories in height and have not more than 6,000 square feet (557 m) of projected roof area and where there is a minimum of 10 feet (3,048 m) from the extremity of the roof to the property line or assumed property line on all sides except for street fronts shall be of non- combustible or fire retardant roof covering as define din 1504.2. -(2) See Section 308.2 .2 3(3) All structures, regardless of occupancy classification, located within the "Special Protection area" or the "Very High Fire Hazard Severity Zone" as defined and periodically modified by the Fire Chief, shall be provided with Class "A" roof system.. 080 Section 1900.4.4 is hereby amended to read as follows: 'Minimum Slab Thickness. The Minimum thickness of concrete floor slabs supported directly on the ground shall not be less than 3 1/2 inches (89 mm). An approved vapor barrier membrane shall be placed under slab floors for human occupancy and supported directly on the grade in Group I and R, Division 1 and 3 occupancies. EXCEPTION: When justified by a soils report and approved by the Building Official, the vapor barrier may be omitted.' .090 Section 1922.10 is hereby amended to read as follows: `1922.10 Seismic Requirements for Plain concrete. 1922.10.1 General. The design and construction of plain concrete components that resist seismic forces shall conform to the requirements of Section 1922, except as modified by this section. 1922.10.2 Seismic Zones 0 and 1. Structural plain concrete members located in Seismic Zones 0 and 1 shall be designed in accordance with the provisions of Sections 1922.1 through 1022.1 through 1922.9. 1922.10.3 Seismic Zones 2, 3 and 4. Structural plain concrete members are not permitted in buildings located in Seismic Zones 2, 3 and 4. EXCEPTIONS: 1. Footings for buildings of Group R, Division 3 or Group U, Division 1 Occupancy constructed in accordance with Table 18-1-C. 2. Post -tensioned slabs -on -grade and topping slabs when supported by approved structural systems.' .100 Section 1612.2.1 is hereby amended to read as follows: `1612.2.1 Basic load combinations. Where Load and Resistance Factor Design (Strength Design) is used, structures and all portions thereof shall resist the 0 most critical effects from the following combinations of factored loads: 1.4D 1.2D + 1.6L + 0.5 (Lr or S) 1.2D + 1.6 (Lr or S) + (f1L or 0.8 W) 1.2D + 1.3W + (f1L + 0.5 (Lr or S) 1.2D + 1.0E + (f1L + f2S) 0.90± (1.OpEh or 1.3W) WHERE: (12-1) (12-2) (12-3) (12-4) (12-5) (12-6) fl = 1.0 For floors in places of public assembly, for Live loads in excess of 100psf (4.9 kN/m2), and for Garage live load. = 0.5 for other live loads. f2 = 0.7 for roof configurations (such as saw tooth) that do not shed snow off the structure. = 0.2 for other roof configurations. EXCEPTIONS: 1. Factored load combinations for concrete per Section 1909.2 where load combinations do not include seismic forces. 2. Where other factored load combinations are specifically required by the provisions of this code.' .110 Section 1629.4.2 is hereby amended to read as follows: 11629.4.2 Seismic Zone 4 near -source factor. In Seismic Zone 4, each site shall be assigned a near -source factor in accordance with Table 16-S and the Seismic Source Type set forth in Table 16-U. The value of Na used in determining Ca need not exceed 1.1 for structures complying with all the following conditions: 10 1. The soil profile type is SA, SB, SC or SD. 2. p = 1.0. 3. Except in single -story structures, Group R, Division 3 and Group U, Division 1 Occupancies, moment frame systems designated as part of the lateral -force -resisting system shall be special moment -resisting frames. 4. The provisions in Sections 9.6a and 9.6b of RISC - Seismic Part I shall not apply, except for columns in one-story buildings or columns at the top story of multistory buildings. 5. None of the following structural irregularities is present: Type 1, 4 or 5 of Table 16-L, and Type 1 or 4 of Table 16-M.' .120 Section 1630.8.2.2 is hereby amended to read as follows: `1630.8.2.2 Detailing reauirements in Seismic Zones 3 and 4. In Seismic Zones 3 and 4, elements supporting discontinuous systems shall meet the following detailing or member limitations: 1. Reinforced concrete or reinforced masonry elements designed primarily as axial -load members shall comply with Section 1921.4.4.5. 2. Reinforced concrete elements designed primarily as flexural members and supporting other than light -frame wood steel wall systems or light -frame steel and wood structural panel shear wall systems shall comply with Sections 1921.3.2. and 1921.3.3. Strength computations for portions of slabs designed as supporting elements shall include only those portions of the slab that comply with the requirements of these Sections. 3. Masonry elements designed primarily as axial -load carrying members shall comply with Sections 2106.1.12.4, Item 1, and 2108.2.6.2.6. 4. Masonry elements designed primarily as flexural members shall comply with Section 2108.2.6.2.5. 11 5. Steel elements designed primarily as flexural members or trusses shall have bracing for both top and bottom beam flanges or chords at the location of the support of the discontinuous system and shall comply with the requirements of AISC-Seismic Part I, Section 9.4b. 6. Wood elements designed primarily as flexural members shall be provided with lateral bracing or solid blocking at each end of the element and at the connection location(s) of the discontinuous system.' .130 Section 2205.3 of Chapter 22, Division 1, is hereby amended to read as follows: "2205.3 Seismic Design Provisions for Structural Steel. Steel structural elements that resist seismic forces shall, in addition to the requirements of Section 2205.2, be designed in accordance with Division IV, as amended herein." .140 Division V (Seismic Provisions for Structural Steel Buildings for Use With Allowable Stress Design) of Chapter 22 is hereby deleted in its entirety. .150 Division IV of Chapter 22 is amended in its entirety to read as follows: `DIVISION IV SEISMIC PROVISIONS FOR STRUCTURAL STEEL BUILDINGS Based on Seismic Provisions for Structural Steel Buildings, of the American Institute of Steel Construction, Parts I, and II dated April 15, 1997 and Supplement No. 2, dated November 10, 2000.' SECTION 2210 - ADOPTION Except for the modifications as set forth in Sections 2211 and 2212 of this division IV and the requirements of the California Building Standards Code, the seismic design, fabrication, and erection of structural steel shall be in accordance with the Seismic Provisions for Structural Steel Buildings, April 15, 1997 published by the American Institute of Steel Construction, 1 East Wacker Drive, Suite 3100, Chicago, IL 60601, which seismic provisions are 12 incorporated by reference as though fully set forth at length herein. The adoption of Seismic Provisions for Structural Steel Buildings in this Division, hereinafter referred to as AISC-Seismic, shall include Parts I (LRFD), III (ASD) and Supplement No. 2 dated November 10, 2000. Where other codes, standards, or specifications are referred to in this specification, they are to be considered as only an indication of an acceptable method or material that can be used with the approval of the Building Official. SECTION 2211 - DESIGN METHODS When the load combinations from Section 1612.2 for LRFD are used, structural steel buildings shall be designed in accordance with Chapter 22 Division II (AISC-LRFD) and Part I of AISC-Seismic as modified by this Division. When the load combinations from Section 1612.3 for ASD are used, structural steel buildings shall be designed in accordance with Chapter 22 Division III (AISC-ASD) and Part III of AISC-Seismic as modified by this Division. SECTION 2212 - AMENDMENTS The AISC-Seismic adopted by this Division applies to the seismic design of structural steel members except as modified by this Section. 1. The following terms that appear in AISC-Seismic shall be construed in accordance with the following definitions in the 1997 Uniform Building Code. AISC - Seismic 1997 Uniform Building Code Seismic Force Resisting System - Lateral Force Resisting System Design Earthquake - Design Basis Ground Motion Load Combinations Eqs (4-1) - Chapter 16 Eqs. 13 And (4-2) LRFD Specification Section (A4-1) and (A4-6) QoQE = Em (12-17) and (12-18) Respectively - Chapter 16 Eqs. (12-1) through (12-6) respectively - Em 2. Sec. 1 of Part I (Structural Steel Buildings)of the AISC Seismic Provisions is hereby revised as follows: `1. SCOPE These provisions are intended for the design and construction of structural steel members and connections in the Seismic Force Resisting Systems in buildings for which the design forces resulting from earthquake motions have been determined on the basis various levels of energy dissipation in the inelastic range of response. These provisions shall apply to buildings in Seismic Zone 2 with an importance factor greater than one, in Seismic Zone 3 and 4 or when required by the Engineer of Record. of I These provisions shall be applied in conjunction with, Chapter 22, Division II, hereinafter referred to as the LRFD Specification. All members and connections in the Lateral Force Resisting System shall have a design strength as provided in the LRFD Specification to resist load combinations 12-1 through 12-6 (in chapter 16) and shall meet the requirements in these provisions. Part I includes a Glossary, which is specifically applicable to this Part, and Appendix S. 3. Section 4.1 of Part I (Structural Steel Buildings) of the AISC Seismic Provisions is revised as follows: `4.1 Loads and Load Combinations The loads and load combinations shall be those set forth in Section 1612.2 except as modified throughout these provisions.' 14 .160 Section 419 of Appendix to Chapter 4 is hereby amended to read as follows: 'The provisions of this section apply to the design and construction of barriers for swimming pools for R occupancies.' .170 Section 420 of Appendix Chapter 4 is hereby amended by amending the definition of "Swimming Pool" to read as follows: 'Swimming pool' is a structure intended for swimming or recreational bathing that contains or is designed to contain water over eighteen (18) inches, (457 mm) deep. This includes in -ground, above ground on -ground swimming pools, hot tubs, portable and non-portable spas, and fixed in place wading pools.' .180 The first sentence of paragraph 421.1 of Section 421 of Appendix to Chapter 4 is hereby amended by to read as follows: '1. The top of the barrier shall be at least sixty (60) inches (1524 mm) above grade measured on the side of the barrier, which faces away from the swimming pool.' 15.02.070 AMENDMENTS TO NATIONAL ELECTRICAL CODE. The following sections, definitions, and provision of the National Electrical Code, 1999 NFPA Edition, are amended as set Forth in this section: .010 Section 110-5 of Article 110 of the National Electrical Code, 1999 NFPA Edition is hereby amended to read as Follows: 'Section 110-5 Conductors. Conductors normally used to carry current shall be of copper or of aluminum unless otherwise provided in this Code. Where other materials are used, the size shall be changed accordingly. Aluminum conductors of No. 6 or smaller used for branch circuits shall require continuous inspection by an independent testing agency approved by the Building Official for proper torquing of connections at their termination point. (FPN): For aluminum and copper -clad aluminum conductors see Section 310-15.' 15.02.080 AMENDMENTS TO UNIFORM MECHANICAL CODE The following sections, definitions and provisions of the Uniform Mechanical Code, 2000 ICBO Edition, are amended as set Forth in this section: .010 Section 114.4.1 of Chapter 1 relating to Permit Expiration is hereby deleted since it is superseded by Section 15.02.050 hereinabove. 15.02.090 AMENDMENT TO UNIFORM PLUMBING CODE. The following sections, definitions, and provisions of the Uniform Plumbing Code, 2000 IAPMO Edition, are amended as set forth in this section: .010 Subsection 103.3.4 of Section 103 of Chapter 1 is hereby deleted since it has been superseded by Section 15.02.050 hereinabove. 15.02.100 AMENDMENTS TO THE UNIFORM SWIMMING POOL, SPA AND HOT TUB CODE The following sections, definitions, and provisions of the Uniform Swimming Pool, Spa and Hot Tub Code, 1997 IAPMO Edition, are amended as set forth in this section: .010 Section 1.7 of Part 1 (Administration) is hereby deleted in its entirety since it has been superseded by Section 15.02.050 hereinabove. .020 Section 102 of Chapter 1 (Definitions)is hereby amended by changing the definition of the word "swimming pool" and "wading pool" to read as follows: 'Swimming Pool - See Appendix Section 420 of the Anaheim Building Code.' 'Wading Pool - see Appendix Section 420 of the Anaheim Building code.' 15.02.110 AMENDMENT TO UNIFORM SOLAR ENERGY CODE. The following sections, definitions, and provisions of the Uniform Solar Energy Code, 1997 IAPMO Edition, are amended as set forth in this Section: 16 .010 Section 20.3 of Part 1 (Administration) is hereby deleted in its entirety since it has been superseded by Section 15.02.050 hereinabove. 15.02.120 PENALTY It shall be unlawful for any person, firm or corporation to violate any provision or to fail to comply with any of the requirements of this ordinance or any provision of the Uniform Codes adopted by this ordinance. Any person, firm or corporation violating any provision of this ordinance or the Uniform Codes or failing to comply with any of the requirements therein shall be deemed guilty of a misdemeanor and upon conviction thereof shall be punished by a fine not exceeding One Thousand Dollars ($1,000.00) or by imprisonment not exceeding six (6) months, or by both such fine and imprisonment. Each such person, firm or corporation shall be deemed guilty of a separate offense for each day during any portion of which any violation of any of the provisions of this ordinance or the Uniform Codes is committed, continued or permitted by such person, firm or corporation, and shall be punishable therefore as provided for in this ordinance. SECTION 3. SEVERABILITY The City Council of the City of Anaheim hereby declares that should any section, paragraph, sentence or word of this ordinance of the Code, hereby adopted, be declared for any reason to be invalid, it is the intent of the Council that it would have passed all other portions of this ordinance independent of the elimination here from of an such portion as many be declared invalid. SECTION 4. SAVINGS CLAUSE Neither the adoption of this ordinance nor the repeal of any other ordinance of this City shall in any manner affect the prosecution of violations of ordinances, which violations were committed prior to the effective date hereof, nor be construed as a waiver of any license or penalty or the penal provisions applicable to any violation thereof. The provision of this ordinance, insofar as they are substantially the same as ordinance provisions previously adopted by the City relating to the same subject matter, shall be construed as restatements and continuations, and not as new enactments. 17 SECTION 5. EFFECTIVE DATE AND PUBLICATION This Ordinance shall become effective thirty (30) days from and after the date of its adoption by the City Council.
