REQUEST: The applicant proposes to modify the sign program for four existing Mixed Use buildings within the Downtown Mixed Use Overlay zone. The revisions include new building entry placards, a Leasing Center wall sign and blade sign, a public art-style branding mural, pedestrian-oriented directional leasing signs, a freestanding sign column, and roof-mounted beacon sign. The request is being made in conjunction with an on-going “repositioning” of this mixed-use project which was recently sold to the applicant. RECOMMENDATION: Staff recommends that the Planning Commission, by motion, approve Final Site Plan No. 2004-00006B, and determine that the addendum to the previously-certified Environmental Impact Report No. 189 for the Koll Anaheim Center Project, together with other previously-approved environmental documentation, serves as the appropriate environmental documentation for the project actions. BACKGROUND: The project site consists of four mixed use buildings within Downtown Anaheim. These buildings were approved as a Planned Mixed-Use Development in 2002. The properties are located in the General Commercial, Downtown Mixed Use Overlay (C-G; DMU Overlay) zone. The properties are also designated for Mixed Use land uses by the General Plan. The properties are developed with four and five story mixed use buildings with commercial spaces on the ground floor and residential units on the upper floors. Surrounding uses include offices and parking structures to the north, east, and west, and an appliance store, apartments, single family homes, and churches to the south, across Broadway. FINAL SITE PLAN NOS. 2003-00008B AND 2004-00006B June 1, 2016 Page 2 of 3 On November 17, 2003, the Planning Commission approved Final Site Plan No. 2003-00008 permitting final elevation plans for the Broadway Arms mixed use project at 201 West Broadway. On December 13, 2004, the Planning Commission approved Final Site Plan No. 2004-00006 permitting final elevation plans for The Promenade, Doria Lofts, and Carnegie Plaza mixed used buildings at 110-160 West Center Street Promenade, 115-145 West Broadway, and 165-185 West Broadway. A coordinated sign program was approved by the Planning Commission in conjunction with its review of these final site plans. On September 21, 2015, the Planning Commission approved a modification to the color palette on the exterior elevations for all four buildings. The DMU Overlay zone requires that any modifications to final elevation plans, including exterior signage, be reviewed by the Planning Commission as a Reports and Recommendations item. PROPOSAL: The applicant requests review and approval of an amendment to the previously approved sign program for the four mixed use buildings. According to the applicant, the addendum to the sign program is part of an effort to reposition the four buildings to reflect a vibrant downtown area that includes high quality residential development, thriving commercial activity, and a pedestrian-friendly environment. The applicant’s repositioning strategy includes modernizing the appearance of the buildings, rebranding the project site under a new name (“The MiX”), adding pedestrian-oriented signage, and adding recreational amenities such as a health club, remodeled leasing office and clubhouse, new pool, and new novelty rooms for the residents. The applicant also proposes to promote more restaurant and retail activity in the ground floor commercial spaces with the modified signs, new patio spaces and awnings, storefront enhancements, modified paint colors, enhanced hardware and light fixtures, and decorative tenant plaques and window graphics. The proposed changes to each building are as follows: • Building Placard Signs: Black metal, hexagonal placards will be placed at the entry points of all four buildings to provide pedestrian-oriented branding and building identification. • Leasing Center Signs: The non-illuminated wall sign and hexagonal blade sign will be placed directly above the entrance to the redesigned leasing center located off the Carnegie Plaza. • Public Art-style Branding Mural: The vinyl sign, also located off the Carnegie Plaza, features “The MiX” branding logo, historic-style German settler girl graphic and building color background in order to blend into the existing elevation. The female figure references the historic German roots of Anaheim and is placed to give the appearance the girl is watering the landscaping in the foreground. • Pedestrian-Oriented Directional Leasing Signs: The two mobile freestanding metal signs are intended to provide directions for pedestrians to the Leasing Center in the Carnegie Plaza. FINAL SITE PLAN NOS. 2003-00008B AND 2004-00006B June 1, 2016 Page 3 of 3 • Freestanding Sign Column: The eight foot tall, four sided column sign provides co-branding for the Muzeo cultural center and “The MiX.” This sign is designed to mimic the existing column sign located on Center Street Promenade, adjacent to the Carnegie Plaza. • Roof-Mounted Beacon Sign: The “MiX” signage and illumination and will utilize an existing glass architectural roof-feature on the Promenade Building. The beacon sign will illuminate with different colors through the use of LED lights mounted on the inside of the glass architectural feature. The applicant also proposes to retain existing sign program elements which provide design guidelines for commercial tenant signs, roof-mounted building signs, and pedestrian-oriented blade signs. ANALYSIS: The proposed signs are tastefully designed and complementary to the character of the downtown area, which is in the process of being rebranded as “Center City.” This rebranding effort is envisioned to promote Downtown Anaheim as a recognizable urban city center and a public place that is dense, livable, active, and diverse, while capitalizing on new and existing amenities, historic features, and a mix of residential, commercial and civic uses. The signs provide additional visual interest to the pedestrian experience and downtown urban streetscape. In addition, the branding mural is consistent with Goal 12.1 in the Community Design Element of the General Plan, which encourages “opportunities to expand the Art in Public Places program to enrich public places and strengthening the City’s identity.” CONCLUSION: Staff has found the proposed sign program amendment to be consistent with the vision of Downtown Anaheim and the Community Design Element of the General Plan, and recommends the Planning Commission approve the proposed sign modifications. Greystar is planning to inject a significant amount of capital into the project and create a better living experience for the tenants. It is advantageous to re-introduce the property into the market under a new name (The Mix) once the improvements are complete. Greystar also believes the new name and branding will align with the City’s efforts to create a vibrant destination in Downtown Anaheim. Overview Greystar and its Consultants have worked extensively with the City’s Economic Development and Planning Departments to create a comprehensive signage package for The Mix. The package includes public art, wall plaques, blade signs, mobile freestanding signs and illuminating the existing beacon. The attached package includes a detailed specs and placement for all these signage pieces. Note: this proposal is not requesting changes to the retail signage requirements. REQUEST: The applicant requests to amend the previously-approved conditional use permit (CUP) for the Anaheim Regional Transportation Intermodal Center (ARTIC) to allow a restaurant that serves alcohol with on-site craft beer manufacturing, which requires a Type 75 license from the California Department of Alcohol Beverage Control (ABC). RECOMMENDATION: Staff recommends that the Planning Commission, by Resolution, determine that the Previously Certified Environmental Impact Report No. 2010-00343 and Addendum are the appropriate environmental documentation for this request and approve Conditional Use Permit No. 2010-05492A. BACKGROUND: ARTIC is located within the Platinum Triangle in the Semi Public (SP) Zone and the Platinum Triangle Mixed Use (PTMU) Overlay Zone. The General Plan designates the ARTIC Site for Mixed Use land use. The ARTIC Site is surrounded by Honda Center to the north across Katella Avenue; the Santa Ana River to the east; Interstate-5 and Angel Stadium to the south; an industrial park and a hotel to the east across Douglass Road; and a retail center with a brewpub restaurant (JT Schmid’s) adjacent to the northwest corner of the ARTIC parking lot. On April 23, 2012, City Council approved a conditional use permit (CUP) for ARTIC. The transit facility opened for public use in December 2014. It serves passenger rail systems (Amtrak and Metrolink), buses (Orange County Transportation Authority (OCTA), Anaheim Resort Transportation, Greyhound and Megabus.com), taxis, bikes and other modes of travel. The centerpiece of ARTIC is a three-story, 120-foot high, 67,000 square foot intermodal transportation terminal. This building includes up to 12,075 square feet of commercial space for passenger-oriented retail and restaurants. The ARTIC CUP specifically lists the types of alcohol licenses that are permitted at ARTIC. The CUP allows up to four restaurants with a Type 47 license from ABC and one bar/nightclub with a Type 48 license from ABC. In addition, the CUP prohibits the sale of alcohol for off-site consumption. CONDITIONAL USE PERMIT 2010-05492A June 1, 2016 Page 2 of 2 PROPOSAL: The applicant proposes to operate a brewpub restaurant within a tenant space on the second floor of ARTIC. The restaurant will serve Japanese-style food, craft beer brewed on- site, and a variety of beer, wine, and distilled spirits. ABC classifies a restaurant with beer manufacturing as a Type 75 license. In order to allow for this type of license, the applicant proposes to amend the ARTIC CUP to allow one Type 75 license and reduce the number of restaurants with a Type 47 license from four to three restaurants. One bar/nightclub (Type 48 license) would continue to be permitted and the restriction on the sales of alcohol for off- premises consumption would remain in place. ANALYSIS: Restaurants that serve alcohol are a permitted use within the SP Zone, subject to the approval of a CUP. The ARTIC CUP allows restaurants within the transit facility to serve alcohol by specifically permitting up to four Type 47 and one Type 48 licenses. Similar to a Type 47 license, the proposed use will function as a restaurant with full food service. However, the beer manufacturing component of the brewpub necessitates a Type 75 ABC license. The request compliments the goal of Anaheim’s Brew City Initiative and growing food industry trend towards craft brew facilities. In addition, the request is compatible with existing local land uses. A brewpub restaurant, JT Schmid’s, has been in operation since 1997 and is adjacent to the ARTIC facility to the northwest. The proposal does not represent an intensification of the previously approved land use. The total number of permitted alcohol licenses will remain at five, with three Type 47 on-sale alcohol licenses, one Type 48 public premise license and one Type 75 brewpub license. CONCLUSION: Staff believes the Type 75 brewpub license is comparable to the previously approved Type 47 on-sale restaurant license. Therefore, staff recommends that the Planning Commission determine that the previously-certified environmental impact report and addendum are the appropriate environmental determination for the request and approve the amendment to the conditional use permit. The City Council determined that EIR No. 343 addressed the environmental impacts and mitigation measures associated with the development of the ARTIC project and associated actions; and WHEREAS, on April 23, 2012, and subject to certain conditions of approval, the Planning Commission of the City of Anaheim (the "Planning Commission"), by its Resolution No. PC2012-029, approved Conditional Use Permit No. 2010-05492 (herein referred to as the "Original CUP") to permit the development and construction of ARTIC, which is located at 2626 East Katella Avenue in the City of Anaheim, County of Orange, State of California, as generally depicted on the map attached hereto as Exhibit A and incorporated herein by this reference (the “Property”); and WHEREAS, the conditions of approval that were the subject of the Original CUP shall be referred to herein as the "Previous Conditions of Approval"; and WHEREAS, by motion made on May 29, 2012 in conjunction with its adoption of Resolution No. 2012-046 approving the Original CUP, the City Council approved an Addendum to EIR No. 343 (the "Addendum"). The Addendum evaluated refinements to the project description identified in EIR No. 343, including, among other things, a reduction in building square footage at the intermodal terminal building; a change to an above-grade bus transit facility; the addition of a pedestrian concourse; removal of the Metrolink/Amtrak concourse tunnel; addition of a baggage tunnel; changes to the platform width and length; reduced width of the Douglass Road Bridge; and modifications to Douglass Road and Katella Avenue; and WHEREAS, the Original CUP permitted a total of five California Department of Alcoholic Beverage Control ("ABC") alcoholic beverage licenses at the Property: up to four Type 47 (On Sale General – Eating Place) ABC licenses authorizing the sale of beer, wine and distilled spirits for consumption at a restaurant, and one Type 48 (On-Sale General – Public Premises) ABC license authorizing the sale of beer, wine and distilled spirits for on-premises consumption without the sale and service of food; and - 2 - PC2016-*** WHEREAS, the Planning Commission did receive a verified petition to amend the Original CUP, designated as "Conditional Use Permit No. 2010-05492A", to modify the Original CUP and, specifically, Condition No. 27 of the Previous Conditions of Approval to substitute a Type 75 (On Sale General – Brewpub) ABC license in the place and stead of one of the Type 47 (On Sale General – Restaurant) ABC licenses, which would permit the sale of beer, wine and distilled spirits for consumption on a bona fide eating place plus a limited amount of brewing of beer (herein referred to as the "Proposed Project"); and WHEREAS, the Planning Commission did hold a public hearing at the Civic Center in the City of Anaheim on June 1, 2016, at 5:00 p.m., notice of said public hearing having been duly given as required by law and in accordance with the provisions of Chapter 18.60 of the Anaheim Municipal Code (the "Code"), to hear and consider evidence for and against proposed Conditional Use Permit No. 2010-05492A and to investigate and make findings and recommendations in connection therewith; and WHEREAS, pursuant to the California Environmental Quality Act (Public Resources Code Section 21000 et seq.; herein referred to as “CEQA”) and the State of California Guidelines for Implementation of the California Environmental Quality Act (commencing with Section 15000 of Title 14 of the California Code of Regulations; herein referred to as the "CEQA Guidelines"), the City is the "lead agency" for the preparation and consideration of environmental documents for the Proposed Project; and WHEREAS, the Planning Commission finds and determines that (i) EIR No. 343 and the Addendum thereto serve as the appropriate environmental documentation for the proposed Conditional Use Permit No. 2010-05492A and satisfies all of the requirements of CEQA; (ii) none of the conditions described in Sections 15162 or 15163 of the CEQA Guidelines calling for the preparation of a subsequent or supplemental EIR or Negative Declaration have occurred in connection with the proposed Conditional Use Permit No. 2010-05492A; and (iii) no further environmental documentation needs to be prepared under CEQA for the proposed Conditional Use Permit No. 2010-05492A; and WHEREAS, the Planning Commission desires and intends to use EIR No. 343 and the Addendum thereto as the environmental documentation required by CEQA and the CEQA Guidelines for the proposed Conditional Use Permit No. 2010-05492A; and WHEREAS, in connection with the proposed Conditional Use Permit No. 2010-05492A, the Planning Commission has independently reviewed EIR No. 343 and the Addendum thereto and has exercised its independent judgment in making the findings and determinations set forth herein; and WHEREAS, the Property is located in the "SP" Semi-Public Zone and the Platinum Triangle Mixed Use (PTMU) Overlay Zone, meaning that the provisions of the PTMU Overlay Zone shall apply to the Property in addition to and, where inconsistent therewith, shall supersede any regulations of the "SP" Semi-Public Zone. The Anaheim General Plan designates the Property for Mixed-Use land uses; and WHEREAS, the sale of alcoholic beverages to consumers for consumption off the premises where sold is a conditionally permitted use within the PTMU Overlay Zone and, but for - 3 - PC2016-*** the existence of the Original CUP, would supersede the regulations of the "SP" Semi-Public Zone related to the Property, which only permits the sale of alcoholic beverages to consumers for consumption on the premises where sold. With respect to the Property, the Original CUP and Conditions No. 27, 29 and 31 of the Previous Conditions of Approval govern the sale and consumption of alcoholic beverages at the Property. Condition No. 29 of the "Previous Conditions of Approval" prohibits the sale at the Property of alcoholic beverages for consumption off the premises where sold; and WHEREAS, the Planning Commission, after due inspection, investigation and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing pertaining to the request for Conditional Use Permit No. 2010-05492A, does find and determine the following facts: 1. While the Original CUP permitted up to four Type 47 (On Sale General – Eating Place) ABC licenses authorizing the sale of beer, wine and distilled spirits for consumption at a restaurant at the Property, Condition No. 31 of the Previous Conditions of Approval anticipated that an ABC license for a restaurant authorized under the Original CUP could be exchanged for another type of ABC license so long as such exchange did not involve the substitution for a "public premises" type license. Moreover, the sale of beer, wine and distilled spirits at the Property for consumption on the premises where sold is a conditionally permitted use in the "SP" Semi-Public Zone under paragraph .0402 of subsection .040 of Section 18.14.030 (Uses) of the Code provided that the sale of alcoholic beverages to consumers is limited to consumption on the premises where sold, and is also a conditionally permitted use within the PTMU Overlay Zone under subsection .030 of Section 18.20.030 (Mixed Use District Uses) of the Code. 2. The proposed amendment to Conditional Use Permit No. 2010-05492, as conditioned herein, would not adversely affect the adjoining land uses and the growth and development of the area in which it is proposed to be located because the transit facility would be a relocation of an existing transit facility located approximately one quarter mile away, in a larger facility with more parking and services than the existing station, and said transit facility would not be detrimental to the adjacent properties. 3. The size and shape of the site for the use is adequate to allow the full development of the Proposed Project in a manner not detrimental to the particular area or to the health and safety. 4. The traffic generated by the Proposed Project will not impose an undue burden upon the streets and highways designed and improved to carry the traffic in the area because the proposed project includes street improvements to adequately serve the traffic generated by the transit facility. 5. The granting of Conditional Use Permit No. 2010-05492A under the conditions imposed will not be detrimental to the health and safety of the citizens of the City of Anaheim as the proposed project will be compatible with the surrounding area through conditions of approval for the use and is not a health or safety risk to the citizens of the City of Anaheim. WHEREAS, the Planning Commission determines that the evidence in the record constitutes substantial evidence to support the actions taken and the findings made in this - 4 - PC2016-*** Resolution, that the facts stated in this Resolution are supported by substantial evidence in the record, including testimony received at the public hearing, the staff presentations, the staff report and all materials in the project files. There is no substantial evidence, nor are there other facts, that detract from the findings made in this Resolution. The Planning Commission expressly declares that it considered all evidence presented and reached these findings after due consideration of all evidence presented to it. NOW, THEREFORE, BE IT RESOLVED that the Planning Commission, for the reasons hereinabove specified does hereby approve Conditional Use Permit No. 2010-05492A to amend the Original CUP to allow a Type 75 (On Sale General – Brewpub) ABC license in the place and stead of one of the Type 47 (On Sale General – Restaurant) ABC licenses authorized and permitted under Condition No. 27 of the Previous Conditions of Approval, which would permit the sale of beer, wine and distilled spirits for consumption on a bona fide eating place plus a limited amount of brewing of beer. To that end, effective upon the effective date of this Resolution, Condition No. 27 of the Previous Conditions of Approval is hereby amended and restated to read in full as follows: 27. That the transit facility shall only include as accessory uses, those uses permitted by right within the Semi-Public Zone and the following uses as described in Chapter 18.36 (Types of Uses) of the Anaheim Municipal Code: 1. Alcoholic Beverages Sales-On-Sale (up to two Type 47 ABC Licenses, one Type 75 (On Sale General – Brewpub) ABC License, and one Type 48 ABC License 2. Automated Teller Machines (ATM’s) 3. Automotive - Public Parking 4. Automotive - Rental Agencies 5. Bars and Nightclubs (one Type 48 ABC License) 6. Business & Financial Services 7. Convenience Stores 8. Kiosks 9. Open-Air Festivals 10. Outdoor Displays 11. Personal Services – General 12. Petroleum Storage – Incidental 13. Portable Food Carts 14. Recreation-Low-Impact 15. Recycling Services – Consumer 16. Restaurants-General 17. Special Events - 5 - PC2016-*** BE IT FURTHER RESOLVED that all references to Condition No. 27 of the Original CUP shall be to the Previous Conditions of Approval, as amended by this Conditional Use Permit No. 2010-05492A, which shall control and govern the Property. BE IT FURTHER RESOLVED that amendments, modifications and revocations of this permit may be processed in accordance with Chapters 18.60.190 (Amendment to Permit Approval) and 18.60.200 (City-Initiated Revocation or Modification of Permits) of the Anaheim Municipal Code. BE IT FURTHER RESOLVED that the Planning Commission does hereby find and determine that adoption of this Resolution is expressly predicated upon applicant's compliance with each and all of the conditions hereinabove set forth. Should any such condition, or any part thereof, be declared invalid or unenforceable by the final judgment of any court of competent jurisdiction, then this Resolution, and any approvals herein contained, shall be deemed null and void. BE IT FURTHER RESOLVED that approval of this application constitutes approval of the proposed request only to the extent that it complies with the Anaheim Municipal Zoning Code and any other applicable City, State and Federal regulations. Approval does not include any action or findings as to compliance or approval of the request regarding any other applicable ordinance, regulation or requirement. THE FOREGOING RESOLUTION was adopted at the Planning Commission meeting of June 1, 2016. Said resolution is subject to the appeal provisions set forth in Chapter 18.60 (Procedures) of the Anaheim Municipal Code and may be replaced by a City Council Resolution in the event of an appeal.
