Environmental Determination: The Planning Commission will consider whether to find the project to be Categorically Exempt from the provisions of the California Environmental Quality Act and Guidelines as a Class 3 (New Construction or Conversion of Small Structures) Categorical Exemption. Resolution No. PC2016-057 (Caldwell / Henninger) Approved VOTE: 5-0 Chair Lieberman and Commissioners Caldwell, Dalati, Henninger and Ramirez voted yes. Commissioners Bostwick and Seymour were absent. Project Planner: Nick Taylor njtaylor@anaheim.net OPPOSITION: None DISCUSSION TIME: 10 minutes (5:05 to 5:15 p.m.) JULY 11, 2016 PLANNING COMMISSION ACTION AGENDA 07-11-2016 Page 3 of 4 ITEM NO. 3 CONDITIONAL USE PERMIT NO. 2016-05857 VARIANCE NO. 2016-05071 (DEV2016-00010) Location: 924-926 South Beach Boulevard and 2961 West Ball Road Request: The following land use entitlements are being requested: (i) a conditional use permit to construct a new automotive washing facility and permit alterations to two legal nonconforming freestanding pole signs; and (ii) a variance to allow fewer parking spaces than required by the Zoning Code. Environmental Determination: The Planning Commission will consider whether to find the project to be Categorically Exempt from the provisions of the California Environmental Quality Act and Guidelines as a Class 32 (In-Fill Development Projects) Categorical Exemption. Resolution No. PC2016-058 A motion was made by Commissioner Caldwell, seconded by Commissioner Ramirez, to approve the request with the added conditions of approval to state that the applicant shall be required to: (i) ensure that the pole signs comply with the future Beach Boulevard Specific Plan sign requirements; and, (ii) that the applicant install double- paned or dual-glazed windows on the adjacent motel to the north as stated in page 21 of the Noise & Vibration Impact Analysis study. THE MOTION FAILED TO CARRY VOTE: 1-4 Commissioners Caldwell voted yes. Chair Lieberman and Commissioners Dalati, Henninger and Ramirez voted no. Commissioners Bostwick and Seymour were absent. ----------------------------------- A second motion was made by Commissioner Ramirez, seconded by Commissioner Dalati, to approve the request with an added condition of approval to state that the applicant install double-paned or dual-glazed windows on the adjacent motel to the north as stated in page 21 of the Noise & Vibration Impact Analysis study. APPROVED VOTE: 3-2 Chair Lieberman and Commissioners Dalati and Ramirez voted yes. Commissioners Caldwell and Henninger voted no. Commissioners Bostwick and Seymour were absent. A person spoke expressing opposition to the subject request with concerns related to potential noise impacts on the adjacent motel to the north, as well as the proposed hours of operation. IN GENERAL: Three pieces of written correspondence were received expressing concerns related to the proposed signage.
