RESOLUTION NO. 2017-042
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
VACATING A PORTION OF ALRO WAY ADJACENT TO 200 AND 205
WEST ALRO WAY AND A PORTION OF "OLD" MANCHESTER
AVENUE ADJACENT TO 200 WEST ALRO WAY (ABANDONMENT
NO. ABA2016-00342).
WHEREAS, the City Council of the City of Anaheim did, by Resolution No. 2017-
002, duly adopted, declare its intention to vacate excess right of way adjacent to 200 and 205 West
Alro Way, Anaheim, California, pursuant to the Public Streets, Highways and Service Easements
Vacation Law (Part 3 of Division 9 of the California Streets and Highways Code); and
WHEREAS, notice of a public hearing to consider said vacation was posted and
published in the manner prescribed by law; and
WHEREAS, on the 28th day of February, 2017, a public hearing was held to allow
interested persons to submit evidence concerning said proposed vacation; and
WHEREAS, the proposed abandonment is excess right of way, unnecessary for
present or prospective public street use within the contemplation of Section 8324 (b) of the
California Streets and Highways Code; and
WHEREAS, the irregularly-shaped City -owned remnant parcel located at 205 West
Alro Way cannot be independently developed to its highest and best use, and the size and irregular
shape of this parcel would preclude governmental uses as contemplated in California Government
Code, Section 54221, for affordable housing, park, recreational, enterprise zone, or school purposes;
and
WHEREAS, Section 1222 of the ANAHEIM City Charter authorizes the City to sell City
property without advertising for bids when the City Council finds such a sale is in the City's best
interests; and
WHEREAS, the abandonment approved does not convey right, title and interest in the
abandoned property to the property owner, which is conveyed by separate quitclaim deed pursuant
hereto.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Anaheim does hereby order the vacation of excess right of way adjacent to 200 and 205 West Alro
Way, as more particularly described in Exhibit "A" and shown in Exhibit "B", attached hereto and
incorporated herein by this reference; RESERVING THEREFROM, unto the City of Anaheim an
easement for public utility purposes and also RESERVING THEREFROM, unto Southern California
Gas Company, a permanent, non-exclusive easement to lay, construct, maintain, operate, repair,
replace patrol, change the size of, add to, or remove from time to time as Southern California Gas
Company deems necessary, one or more pipelines and conduits, together with metering, measuring,
regulation, cathodic protection, communications and other appurtenances.
BE IT FURTHER RESOLVED that the City Council of the City of Anaheim does
hereby find that it is in the best interests of the City to authorize the sale of the City -owned remnant
parcel located at 205 West Alro Way, consisting of approximately 14,859 square feet, together with
the portions of Alro Way and "Old" Manchester Avenue to be vacated/abandoned, the combined
abandonment area consisting of approximately 11,568 square feet, to the adjacent property owner,
Singod, at a negotiated purchase of $800,000.
BE IT FURTHER RESOLVED that the vacation authorized by this Resolution shall
not be effective until a certified copy of this Resolution is recorded in the Office of the Recorder of
the County of Orange.
BE IT FURTHER RESOLVED that the City Clerk be, and she is hereby, authorized
and directed to cause a certified copy of this Resolution to be recorded in the Office of the Recorder
of the County of Orange, upon receipt of the executed Purchase and Sale Agreement and executed
Encroachment and Maintenance Agreement.
THE FOREGOING RESOLUTION is approved and adopted by the City Council of
the City of Anaheim this 28th day of February, 2017, by the following roll call vote:
