AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ANAHEIM
ADDING SECTION 1.04.391 TO CHAPTER 1.04 OF TITLE 1 OF THE ANAHEIM
MUNICIPAL CODE PROVIDING FOR DISTRICT -BASED APPOINTMENT OF
CITY BOARD AND COMMISSION MEMBERS; AMENDING SECTIONS
1.04.380 THROUGH 1.04.996 OF CHAPTER 1.04 OF TITLE 1 OF THE
ANAHEIM MUNICIPAL CODE RELATING TO CITY BOARDS AND
COMMISSIONS; AMENDING THE TITLE OF CHAPTER 1.04 TO INCLUDE
BOARDS AND COMMISSIONS; REPEALING SECTION 1.04.857 OF CHAPTER
1.04 RELATING TO THE SESQUICENTENNIAL COMMISSION; AND
AMENDING CHAPTER 13.04 OF TITLE 13 RELATING TO THE PARKS AND
RECREATION COMMISSION
WHEREAS, at the 2014 General Municipal election, the electors of the City of
Anaheim voted to change the way in which council members in the City are elected
from an "at large" system to a "by district" system whereby the voters in each district
in the City elect a resident of that district to serve on the City Council; and
WHEREAS, there are six districts in the City, each of which will have a district
representative following the General Municipal election in 2018; and
WHEREAS, the Mayor of the City is, and will continue to be, elected at large;
and
WHEREAS, sections 900 and 902 of the City Charter authorize the City
Council to make appointments to the City boards and commissions named in the
Charter, as well as to establish other boards and commissions as appropriate and grant
them powers and duties consistent with the Charter; and
WHEREAS, the City Council desires to change the way in which members of
City boards and commissions are selected in order to make those boards and
commissions reflective of the City's by district election system; and
WHEREAS, because the transition to district representatives will not be
complete until the General Municipal election in November of 2018, the appointment
and removal of board and commission members will be governed by
Resolution No. 2017- 049 prior to that time.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ANAHEIM DOES
HEREBY ORDAIN AS FOLLOWS:
SECTION 1. That the title of Chapter 1.04 be amended to read in full as follows:
Chapter 1.04 OFFICERS AND DEPARTMENTS; CITY BOARDS AND
COMMISSIONS
SECTION 2. That sections 1.04.380 through 1.04.996 of Chapter 1.04 be amended
to read in full as follows:
1.04.380 EXPENSE ALLOWANCES — PLANNING COMMISSION AND
CITY COUNCIL MEMBERS.
There shall be allowed to each member of the Planning Commission, except ex
officio and advisory members, the sum of fifty dollars per official meeting attended by
the member not to exceed one meeting per week, and there shall be allowed to each
member of the City Council the sum of twenty-five dollars per official meeting
attended by the member, not to exceed one meeting per week, and in addition thereto
there shall be allowed an additional sum of twenty-five dollars to the Mayor. For the
purpose of his expense allowance, a council member will be deemed to be in
attendance at any meeting from which he or she may be absent while engaged in
official City business determined to be such by a majority vote of the City Council
either in advance of or following such absence. These allowances are authorized to
reimburse members for the expense of attending meetings, traveling to and from their
usual place of business to meetings, traveling to and from property under
consideration for action by the respective body of which they are members, and all
other expenses connected with the performance of their duties as commissioners or
council member. It is recognized that the Mayor will have additional expenses by
reason of official appearances for the City not ordinarily incurred by council
members. The expenses authorized hereunder need not be accounted for by the
recipients, but no other expenses shall be allowed except as specifically authorized by
the City Council.
1.04.390 BONDS REQUIRED OF CITY OFFICERS AND EMPLOYEES.
.010 Before entering upon the duties of their respective offices, the Finance
Director and the City Treasurer of the City of Anaheim shall execute faithful
performance bonds to the City in amounts which may, from time to time, be set by the
City Council.
.020 The following employees shall be bonded under a public employees' faithful
performance blanket bond in amounts which may, from time to time, be set by the
City Council:
City Manager/Acting City Manager
Assistant City Manager
Assistant City Manager -Development
City Attorney
City Clerk
Public Works Executive Director
Chief of Police
City Engineer
Box Office Manager
Revenue Manager
Assistant Finance Director — Accounting
Convention/Sports and Entertainment General Manager
Purchasing Agent.
.030 All of the employees not specifically set forth above shall be bonded by a
public employees' blanket honesty bond in amounts which may, from time to time, be
set by the City Council.
.040 Nothing contained in this section shall prohibit the City Council from
requiring such other additional bonds for officers and employees as it shall in its
discretion deem necessary or desirable.
1.04.391 DISTRICT -BASED APPOINTMENT OF CITY BOARD AND
COMMISSION MEMBERS
.010, Appointment. In order to fulfill the purpose of district -based elections and
correspond in number to the members of the City Council, all City boards and
commissions shall be comprised of seven members with the following exceptions:
Library Board and Sister City Commission, which shall retain their existing
membership and method of appointment and removal, and the Housing and
Community Development Commission, which shall be governed by section 1.04.500
of this Chapter. Commencing with the General Municipal election in 2018, the
Mayor and each City Council member shall directly appoint one member to each
seven -member board and commission. Appointments shall be at the discretion of the
appointing elected official, however for appointments made by council members,
priority shall be given to eligible district residents. All such appointments shall be
made at a public meeting.
020. Removal. For those boards and commissions named and established in Article
IX of the City Charter (Planning Commission, Parks and Recreation Commission,
Library Board, and Public Utilities Board), members shall be removed as provided in
the City Charter. All other board and commission members may be removed at the
sole discretion of the elected official who appointed the member, provided however
that such removal must occur at a public meeting.
030. Term of Service. The terms of service of members of boards and commissions
named and established in the City Charter shall be as set forth in the Charter. The
terms of service of members of City boards and commissions for which a term of
service is not otherwise specified in either the City Charter or this Chapter shall run
concurrently with the current term of the elected official who appointed the member.
The number of terms of service of a board or commission member shall be calculated
from the date the member was first appointed.
040. Applicability. This section 1.04.391 shall not apply to the Anaheim Resort
Maintenance District Advisory Board, or to appointments or removals of board or
commission members that occur prior to the 2018 General Municipal election.
Appointments and removals that occur between the effective date of this ordinance
and the November 2018 General Municipal election shall be made pursuant to and in
accordance with City Council Resolution No. 2017-049.
1.04.395 LIMITATIONS ON CITY BOARD AND COMMISSION SERVICE.
010 Statement of Purpose.
.0101 City boards and commissions perform a valuable service to the City of
Anaheim by providing a means by which the City Council can obtain the advice,
opinions and recommendations of City residents and other members of the
community. The City has a large number of talented and qualified individuals who are
capable of serving as board and commission members. The City is best able to draw
upon the talents and abilities of its people by the periodic, systematic and continual
infusion of new members to serve on the City's appointed boards and commissions.
.0102 For the above reasons, it is the desire of the City Council to encourage and
solicit service on its boards and commissions by those who have not previously or
recently served in such capacity. Neither the establishment of limitations on board and
commission service set forth in this section, nor the failure of the City Council or any
of its members to reappoint a board or commission member eligible for
reappointment, should be viewed as a criticism of any person's performance or
service, but, rather, as a desire to encourage and facilitate public service by the
greatest number of qualified individuals.
.020 Limitation on Length of Service.
.0201 No person shall serve more than two consecutive terms as a member of a
City board or commission.
.0202 Any person who has served two consecutive terms on a City board or
commission shall not be eligible for reappointment to that board or commission until
expiration of a period of two years from the date of such person's most recent service
on that board or commission.
.0203 Any period of service equal to at least one-half of the length of a complete
term shall be considered a term of service for purposes of this section.
.0204 Any person who serves less than one-half of a complete term on a board or
commission and, within two years, is reappointed to that same board or commission to
fill an unexpired term, shall be deemed to have served a full term if the total period of
service for both such partial terms equals at least one-half of a full term of service.
.030 Prohibition on Concurrent Service.
.0301 No person shall concurrently serve as a member of two or more City boards
or commissions.
.0302 Any person appointed by the City Council to serve as a member of any City
board or commission who is then currently serving as a member of another City board
or commission shall be deemed to have vacated the prior position upon acceptance of
the new appointment.
.040 Any person serving as an ex -officio member, educational sector voting
stakeholder member, or non-voting emeritus member of any City board or
commission shall not be deemed a member of such board or commission for purposes
of the limitations imposed by this section.
1.04.396 REMOVAL OF BOARD AND COMMISSION MEMBERS DUE TO
EXCESSIVE ABSENCES FROM MEETINGS.
.010 If a member of a City board or commission shall be absent without cause
from either fifty percent or more of meetings held within any 12 -month period or
three or more consecutive meetings of the board or commission on which that
member serves, the secretary or staff liaison to such board or commission shall
immediately file a written report thereof with the City Clerk, who shall schedule
consideration of the possible removal of the member as an agenda item at the next
regular meeting of the City Council, or as soon thereafter as the matter can be
considered. If directly appointed by an individual council member or the Mayor, such
board or commission member shall be subject to removal by the affirmative vote of
the appointing council member or Mayor, respectively, at a public meeting. If
appointed by the City Council, such board or commission member shall be subject to
removal by the affirmative votes of a majority of the total membership of the City
Council.
.020 An absence shall be considered an absence for cause if either (1) the member
informs the chairperson or the City staff liaison of such City board or commission of
such member's intended absence at least 24 hours prior to the scheduled time of the
meeting, or (2) such absence is due to unforeseeable and unavoidable circumstances
which circumstances are orally reported and explained by the member at the next
regular meeting of the board or commission following such absence, or which are
reported and explained in writing to the secretary and staff liaison of the board or
commission prior to the next regular meeting of the board or commission.
.040 For purposes of this section and sections 1.04.391 and 1.04.395, the term
"City board or commission" shall mean and include any board or commission of the
City of Anaheim whose members are appointed by the City Council as specified in
Article IX of the City Charter or as otherwise created by formal action of the City
Council, including the members of any board created by a joint exercise of powers
agreement to which the City is a party and pursuant to which the City Council has the
power to appoint at least a majority of the board members.
.050 For purposes of this section, the term "meeting" shall mean and include any
regular, adjourned or special meeting of the City board or commission to which the
provisions of this section are being applied.
1.04.450 CULTURAL AND HERITAGE COMMISSION.
The Cultural and Heritage Commission is hereby established pursuant to Section
900 of the Charter of the City of Anaheim.
.010 Duties. The Cultural and Heritage Commission shall:
(a) Advise the City Council on matters concerning the arts, culture and historic
preservation and heritage;
(b) Develop prioritized strategies providing recommendations to City Council
related to the implementation of the Cultural Arts Plan;
(c) Oversee the City's cultural and historical assets (including, but not limited to,
the Anaheim Museum and the Mother Colony House).
(d) Facilitate cooperative efforts of private individuals, community organizations,
and businesses that promote and enhance the cultural and historic environment of the
City through events and programs;
(e) Develop recommendations concerning the allocation of City resources, as
available, for the support of cultural and historic works of art, events, and programs
within the City;
(f) Explore the need for cultural facilities in the City of Anaheim;
(g) Advise and make recommendations with respect to the temporary and/or
permanent placement and maintenance of works of art at City-owned facilities;
(h) Advise and make recommendations related to the acceptance of gifts of art to
the City;
(i) Develop a mechanism for soliciting and including public input in the process of
selection of works of art and their placement, when appropriate;
(j) Recommend for City Council a set of policies and procedures pertaining to
visual art in public places;
(k) Recommend for City Council a set of goals and annual objectives that will
serve the visual, performing, literary, and multi-media arts.
(1) Encourage support by private individuals and organizations of the arts and of
cultural and historic facilities and programs;
(in) Advocate and enlist community interest and participation in the arts and in
cultural and historic programs; and
(n) Perform such additional functions as may be delegated or required by the City
Council from time to time.
.020 Advisory Committees. The Commission may appoint advisory committees to
oversee the historical and cultural assets of the community. Separate advisory
committees may be appointed to address the needs of the Mother Colony House, the
Anaheim Museum, Art in Public Places, and other cultural, historical or City heritage
purposes as needed.
.030 Composition. The Cultural and Heritage Commission shall consist of seven (7)
members.
(a) The Director of the Department of Community Services or his or her designee
shall serve as the liaison to the Commission.
(b) The City Manager, the Superintendent of the Anaheim Union High School
District and a representative of the Parks and Recreation Commission and the Library
Board shall be ex -officio members of the Cultural and Heritage Commission. Such
ex -officio members shall have no voting rights at meetings of the Cultural and
Heritage Commission and shall not be counted for purposes of determining a quorum
for purposes of such meeting.
.040 Qualifications. Each member of the Cultural and Heritage Commission shall
be a resident of the City of Anaheim at the time of appointment and during the entire
tenure of service on the Commission. Appointed members shall not hold any paid
office or employment in the City government and shall not be a current officer or
board member of any Anaheim -based arts or cultural organization at the time of the
appointment and during the entire tenure of service on the Commission.
.050 Term of Office. Each member of the Commission shall serve a term that runs
concurrently with the current term of the elected official who appointed the member,
and until his or her respective successor is appointed and qualified.
.060 Unscheduled Vacancies. A vacancy occurring before the expiration of a term
of a board or commission member shall be filled by appointment for the remainder of
the term. The vacancy shall be filled by the affirmative vote of the elected official
who appointed the member at a public meeting.
.070 Meetings. The Cultural and Heritage Commission shall meet regularly at least
once a month in the City of Anaheim or in a location authorized by the City Council
or as otherwise provided by law. Regular meeting dates and times shall be established
by the Commission. A majority of the total number of members of the Commission
then in office shall constitute a quorum. The Commission shall comply with the
provisions of the Ralph M. Brown Act (commencing with Government Code Section
54950, et seq.).
.080 Procedures. The meetings and procedures of the Commission shall be subject
to and governed by the resolutions and ordinances of the City Council establishing
rules and regulations for City boards and commissions.
.090 Organization. The Cultural and Heritage Commission shall elect one of its
members as chairperson on an annual basis, which chairperson shall preside at
meetings of the Commission and shall serve at the pleasure of the Commission.
.100 No Compensation. Members of the Cultural and Heritage Commission shall
serve without compensation.
1.04.500 HOUSING AND COMMUNITY DEVELOPMENT COMMISSION.
There is hereby established the Housing and Community Development Commission
in accordance with the applicable provisions of the Housing Authorities Law
(commencing with Section 34200 of the Health and Safety Code) of the State of
California and subject to the applicable restrictions contained therein. The Housing
and Community Development Commission shall not be deemed the commission
referred to and created by Part 1.7 of Division 24 (commencing with Section 34100)
of the Health and Safety Code of the State of California.
1.04.510 COMMISSION MEMBERSHIP AND TERMS.
.010 Composition. The Housing and Community Development Commission shall
consist of nine members, two of whom shall be tenant members.
.020 Appointment. The two tenant members of the Commission shall be appointed
by the affirmative vote of a majority of the total membership of the City Council.
Commencing with the General Municipal election in 2018, the Mayor and each City
council member shall each directly appoint one member to the Commission. Such
appointments shall be at the discretion of the appointing elected official, however,
priority shall be given to eligible district residents.
.030 Qualifications. Each member of the Housing and Community Development
Commission shall be a resident of the City of Anaheim at the time of appointment and
during the entire tenure of service on the Commission and shall not hold any paid
office or employment in the City government. Tenant members, consistent with the
Housing Authorities Law, shall be tenant members at the time of appointment and
during the entire tenure of their service. Tenant members shall comply with the
applicable provisions of the Housing Authorities Law.
.040 Term of Office. Each member of the Commission shall serve a term that
runs concurrently with the current term of the elected official who appointed the
member and until his or her successor is appointed and qualified.
.050 Unscheduled Vacancies. A vacancy occurring before the expiration of the
term. of a Commission member shall be filled by appointment for the remainder of the
term. Vacancies of tenant members shall be filled by the affirmative votes of a
majority of the total membership of the City Council. All other vacancies shall be
filled by the affirmative vote of the appointing council member or the Mayor at a
public meeting.
1.04.520 ORGANIZATION AND MEETINGS.
The Commission shall, elect one of its members as a chairperson on an annual basis,
which chairperson shall preside at meetings of the Commission and shall serve at the
pleasure of the Commission. The Commission shall meet at least four times each
calendar year. A regular meeting time may be established by the Commission through
its bylaws. A majority of the total number of members of the Commission then in
office shall constitute a quorum. A majority of the quorum present and qualified to
vote shall be required to approve any action or motion of the Commission
1.04.530 POWERS AND DUTIES.
The Housing and Community Development Commission shall have the power and
duty to:
.010 Conduct and carry out such functions as are prescribed by the Housing
Authorities Law;
.020 Perform such functions and duties as prescribed in the Citizen Participation
Plan adopted by the City Council pursuant to regulations promulgated by the United
States Department of Housing and Urban Development;
.030 Conduct and carry out such advisory functions as assigned by, and make
recommendations to, the City Council relating to matters of community development;
.040 Perform such other advisory functions, if any, as may be assigned from time
to time by the City Council.
1.04.540 COMPENSATION AND REIMBURSEMENT OF EXPENSES.
Members of the Housing and Community Development Commission shall serve
without compensation but shall be reimbursed for travel and subsistence expenses
incurred in the performance of their duties while away from the City of Anaheim in
accordance with Council policy and to the extent that appropriations for such
compensation and travel allowance have been provided by the City Council.
1.04.550 RESERVED
1.04.560 RULES AND BYLAWS.
The Commission may adopt rules of order and/or bylaws relating to its meetings
provided that any such rules or bylaws shall require the approval of the City Council.
1.04.700 PUBLIC UTILITIES BOARD CREATED.

1.04.750 LIBRARY BOARD — EMERITUS MEMBERS.
The City Council may appoint one or more emeritus members to the Library Board
of the City established pursuant to Charter Section 908. Any such emeritus member
shall serve in such capacity at the pleasure of the City Council and shall have all rights
and privileges of members of the Library Board appointed pursuant to Charter Section
908 except that such emeritus member shall have no voting rights at meetings of the
Library Board and shall not be counted for purposes of determining a quorum for
purposes of such meetings.
1.04.760 EXPENSE ALLOWANCES — LIBRARY BOARD MEMBERS.
Members of the Library Board shall serve at no salary, but may be reimbursed for
travel and subsistence incurred in the performance of their duties.
1.04.800 COMMUNITY SERVICES BOARD.
There is hereby established, pursuant to Section 900 of the Charter of the City, an
advisory body which shall be called the Community Services Board.
1.04.810 COMMUNITY SERVICES BOARD; MEMBERSHIP AND TERMS.
.010 Composition. The Community Services Board shall consist of seven
members.
.020 Qualifications. Each member of the Board shall be a resident of the City of
Anaheim at the time of appointment and during the entire tenure of service on the
Commission and shall not hold any paid office or employment in the City
government.
.030 Term of Office. Each member of the Board shall serve a term that runs
concurrently with the current term of the elected official who appointed the member
and until his or her successor is appointed and qualified.
.040 Unscheduled Vacancies. A vacancy occurring before the expiration of a
term of a board member shall be filled by appointment for the remainder of the
unexpired term. The vacancy shall be filled by the affirmative vote of the elected
official who appointed the member at a public meeting.
1.04.820 ORGANIZATION AND MEETINGS.
.010 The Community Services Board shall elect one of its members as a
chairperson on an annual basis, which chairperson shall preside at meetings of the
Board and shall serve at the pleasure of the Board.
.020 Meetings of the Community Services Board shall be conducted in accordance
with Section 904 of the Charter of the City of Anaheim provided, however, that the
Board shall meet at least four times during each calendar year.
.030 A majority of the total number of members of the Community Services Board
then in office shall constitute a quorum. The Board may take action only upon the
affirmative vote of a majority of the quorum.
1.04.830 POWERS AND DUTIES.
The Community Services Board is an advisory body and, as such, shall have the
power and duty to:
.010 Advise the City Council of the social service needs of the citizens of the City
of Anaheim;
.020 Hold public meetings to receive input regarding social services from citizens
and from other governmental and private nonprofit organizations providing social
services within the City of Anaheim;
.030 Recommend methods to coordinate social service programs provided by the
City, other governmental agencies, and private nonprofit organizations;
.040 Recommend methods to match social service needs and the available social
service resources;
.050 Recommend methods to avoid duplication and waste of the social services
provided by the City, other governmental agencies, and private nonprofit
organizations;
.060 Hold public meetings and public hearings as required for state and federal
programs;
.070 Perform such additional functions as may, by resolution, be required from
time to time by the City Council.
1.04.840 EXPENSE ALLOWANCES — COMMUNITY SERVICES BOARD
MEMBERS.
Members of the Community Services Board shall serve at no salary, but may be
reimbursed for travel and subsistence expenses incurred in the performance of their
duties.
1.04.850 COMMUNITY SERVICES BOARD — EMERITUS MEMBERS.
The City Council may appoint one or more emeritus members to the Community
Services Board of the City established pursuant to Section 1.04.800 of this Chapter.
Any such emeritus member shall serve in such capacity at the pleasure of the City
Council and shall have all rights and privileges of members of the Community
Services Board appointed pursuant to Section 1.04.8 10 of this Chapter except that
such emeritus member shall have no voting rights at meetings of the Community
Services Board and shall not be counted for purposes of determining a quorum for
purposes of such meetings.
1.04.955 ANAHEIM SISTER CITY COMMISSION.
.010 Establishment. The Anaheim Sister City Commission is hereby established
pursuant to Section 900 of the Charter of the City of Anaheim
.020 Duties. The Anaheim Sister City Commission shall have the power and duties
to:
(a) Advise the City Council on matters concerning sister city relationships
including the promotion of cultural/educational exchange and knowledge sharing.
(b) Recommend to the City Council by-laws, for City Council approval, which
govern the Commission's own internal procedures consistent with the Charter,
ordinances and resolutions of the City of Anaheim and all other applicable laws, rules
and regulations.
(c) Make recommendations to the City Council of goals, objectives and programs
to ensure the successful management of the existing sister city relationships.
(d) Make recommendations to the City Council on how to effectively manage the
existing sister city relationships and ensure their success and effectiveness, as
measured by City Council approved goals, strategies and programs.
(e) Make recommendations to the City Council regarding criteria for the
establishment of new sister city relationships, including the creation of selection
criteria that aim to match the City with a suitable partners.
(f) Make recommendations to the City Council regarding the expenditure of
funds that further the approved goals, strategies and programs.
(g) Establish the appropriate subcommittees tasked with implementing specific
programs, strategies and goals, consistent with the approved by-laws and other
applicable laws, rules and regulations.
(h) Provide the Mayor and Council with an annual report outlining the programs
and accomplishments of the Commission and its affiliations.
(i) Perform such additional advisory functions as may be delegated or required
by the City Council from time to time.
.030 Composition and Appointment of Members.
(a) The Anaheim Sister City Commission shall consist of fifteen (15) members
appointed by the City Council. Each member of the Commission shall be a resident of
the City of Anaheim or other parties, including business owners and representatives
from the educational sector, that have a vested interest in Anaheim and the success of
the sister city program. Representatives from the educational sector shall be members
of the Anaheim Union High School District Board of Trustees, who are recommended
by the Anaheim Union High School District and selected by the Anaheim City
Council, and shall be designated as educational sector voting stakeholder members.
Appointed members shall not hold any paid office or employment in the City
government.
(b) For the initial appointment of the Commission only, each member of City
Council will be responsible for appointing two (2) members with the remaining five
(5) members of the commission (representing Anaheim's business, tourism and
educational sectors) to be appointed collectively by the Mayor and Council. In
accordance with subsection .040, for the initial appointments by the each member of
the City Council, each member will appoint one commissioner who shall have a term
expiring on the thirtieth day of June of the first year and one commissioner who shall
have a term expiring on the thirtieth day of June of the second year. Thereafter, as
members' terms expire, the members of the commission will be appointed collectively
by the Mayor and Council by the affirmative votes of the majority thereof.
(c) The City Manager shall appoint a City representative to serve as the staff
liaison to the Commission. This member of City staff shall be an ex official member
and will not have voting rights at meetings of the Commission and shall not be
counted for purposes of determining a quorum at the Commission meetings.
.040 Term of Office. The appointed members shall serve terms of three (3) years,
or until their respective successors are appointed. However, the initial Commission
appointees shall be appointed by the City Council, in accordance with subsection
.030, for terms specifically expiring as follows:
Five on the thirtieth day of June of the first year following appointment.
Five on the thirtieth day of June of the second year following appointment.
Five on the thirtieth day of June of the third year following appointment.
.050 Unscheduled Vacancies. A vacancy occurring before the expiration of the
term shall be filled by City Council appointment for the remainder of the term, in the
same manner as provided above, for the remainder of the term. In such cases, the City
Council will consider the existing makeup of the board and may appoint a member
that represents the appropriate industry or sector.
.060 Meetings and Procedures. The Anaheim Sister City Commission shall meet
regularly at least once a month in the City of Anaheim or in a location authorized by
the City Council or as otherwise provided by law. Regular meeting dates and times
shall be established by the Commission. A majority of the total number of members of
the Commission then in office shall constitute a quorum. The Commission shall
comply with the provisions of the Ralph M. Brown Act commencing with
Government Code Section 54950 et seq. The meetings and procedures of the
Commission shall be subject to and governed by the resolutions and ordinances of the
City Council establishing rules and regulations for City boards and commissions.
.070 Advisory Subcommittees. The Anaheim Sister City Commission shall have
the power to appoint advisory subcommittees of less than a quorum of the
Commission to perform tasks within the scope of the Commission's responsibilities
and to make reports and recommendations to the Commission.
.080 Organization. The Anaheim Sister City Commission shall annually, at its first
regular meeting following the first day of July, select one (1) of its members as
chairperson and one (1) of its members as vice -chairperson, who shall serve in this
capacity for one year or until his or her successor is selected. The Commission shall
recommend to the City Council by-laws for approval by the City Council to govern
the Commission's own internal procedures consistent with the Charter, ordinances
and resolutions of the City of Anaheim and all other applicable laws, rules and
regulations.
.090 No Compensation. Members of the Anaheim Sister City Commission shall
serve without compensation.
1.04.996 BUDGET, INVESTMENT AND TECHNOLOGY COMMISSION.
.010 Establishment. The Budget, Investment and Technology Commission is
hereby established pursuant to Section 900 of the Charter of the City of Anaheim.
.020 Composition. The Commission shall consist of seven (7) members,
.030 Qualifications. Each member of the Commission shall be a resident of the
City of Anaheim at the time of appointment and during the entire tenure of service on
the Commission and shall not hold any paid. office or employment in the City
government. The members shall also meet and retain certain qualifications, if any, as
may be established by resolution of the City Council. No member shall be financially
interested in any contract, or otherwise conduct any business with, the City or any of
its agencies, either on an individual basis or as a partner, shareholder, member or
employee of any firm.
.040 Term of Office. Each member of the Commission shall serve a term that runs
concurrently with the current term of the elected official who appointed the member
and until his or her successor is appointed and qualified.
.050 Unscheduled Vacancies. Any vacancy occurring before the expiration of the
term of a Commission member shall be filled by appointment for the remainder of
such term. The vacancy shall be filled by the affirmative vote of the elected official
who appointed the member at a public meeting.
.060 Organization, Meetings and Procedures.
.0601 The Commission shall elect one of its members as a chairperson on an annual
basis, which chairperson shall preside at meetings of the Commission and shall serve
at the pleasure of the Commission. .
.0602 The Commission shall meet regularly at least four times each year and shall
hold such other meetings as from time to time shall be called in the manner and form
required by law. Meetings shall be conducted in accordance with Section 904 of the
Anaheim City Charter. Regular meeting dates and times shall be established by the
Commission. A majority of the total number of members of the Commission then in
office shall constitute a quorum.
.0603 The meetings and procedures of the Commission shall be subject to and
governed by the resolutions and ordinances of the City Council establishing rules and
regulations for City boards and commissions.
.0604 The Commission shall have the power to appoint subcommittees of less than
a quorum of the Commission to perform tasks within the scope of the Commission's
responsibility and to make reports and recommendations for consideration by the
Commission.
.070 Appropriations. The City Council shall include in its annual budget such
appropriations of funds as, in its opinion, shall be sufficient for the efficient and
proper functioning of the Commission.
.080 No Compensation. Members of the Commission shall serve without
compensation.
.090 Powers and Duties. The Budget, Investment and Technology Commission is
an advisory body to the City Council and, as such, shall have the following powers
and duties:
.0901 Investment Policy.
.01 Review the annual investment policy proposed by the City Treasurer and the
monthly City Treasurer's report as submitted to the City Council pursuant to Section
53607 of the Government Code; and review other investment reports, if any, prepared
for submission to the City Council.
.02 Make recommendations to the City Council regarding said investment policy,
monthly City Treasurer's reports, and other investment reports, if any, submitted to
the City Council.
.03 Act in an advisory capacity to the City Council in matters pertaining to the
investment of City funds and the funds of other agencies governed by the City
Council and which funds are invested by the City Treasurer (including but not limited
to funds of the Anaheim Housing Authority and Anaheim Public Financing
Authority).
.04 Review and make recommendations on the City Treasurer's investment
strategies and portfolio asset and maturity structure. Emphasis of the Commission
shall be on overall investment activities incorporating cash flow, permitted
investments and risk/return factors. The Commission shall function in a general
oversight capacity and shall not make investment decisions on individual securities.
.0902 Budget.
.01 Review the annual budget proposed by the City Manager pursuant to Section
1201 of the City Charter.
.02 Hold public meetings concerning the proposed annual budget and make
recommendations regarding said budget to the City Council in conjunction with, and
prior to the conclusion of, the public hearing thereon required pursuant to Section
1202 of the City Charter.
.03 Act in an advisory capacity to the City Council in matters pertaining to short -
and long-range financial planning and funding of City activities.
.04 Review the City's general fund, capital improvement program, and special
funds budgets, including review of policies and procedures, time frames, format, and
specific allocation proposals. Emphasis of the Commission shall be on programs
and/or major expenditures, not on line item detail.
.05 Review proposals and make recommendations regarding new and increased
revenue sources.
.06 Review proposals and make recommendations regarding service delivery
alternatives.
.07 Explore alternative approaches for financing future capital improvement
projects.
.08 It shall not be the purpose of the Commission to advise on regular or routine
Treasury administration. It is intended that the Commission act in an advisory
capacity to the City Council only and that the Commission not be vested with final
authority in the establishment of investment strategies or the purchase of specific
securities nor that it direct City staff to conduct costly analyses unless specifically
directed and approved by the City Council.
.0903 Technology.
.01 Act in an advisory capacity to the City Council in matters relating to the use of
that information technology that will assist in the accomplishment of the City's goals
and objectives.
.02 Partner with City leaders and key stakeholders, businesses and residents to
identify long-term, strategic goals and objectives of City technology uses.
.03 Recommend technologies aimed at addressing the needs of a diverse cross-
section of the City's residents, businesses and visitors.
.04 Review and maintain knowledge of current and future technology trends.
.0904 Perform such additional duties and functions as may be required from time
to time by specific action and direction of the City Council.
.0905 Receive such administrative support, assistance and information from the
City Manager, and/or such other appointed officers or employees of the City as
directed by the City Manager, and/or such consultants, advisors or professionals as
engaged by the City for such purpose, as may be directed by the City Council, or as
may from time to time reasonably be requested by the Commission for purposes of
performing the duties and functions specified herein; provided, however, any such
requests must be consistent with the City Charter and all City ordinances, resolutions,
contracts, policies and rules, including any limitations contained in the City Charter
which are otherwise applicable to the City Council or its members.
SECTION 3. That Chapter 13.04 of Title 13 be amended to read in full as follows:
13.04.005 DEFINITIONS.
The following words and terms as used in this chapter shall have the meanings
respectively set forth in this section unless a different meaning is expressly stated.
.010 "Department" or "Parks, Recreation and Community Services Department" or
"Parks, Recreation and the Arts Department" or "Parks and Recreation Department"
shall all mean and refer to the Community Services Department of the City of
Anaheim.
.020 "Director" or "Department Head" shall mean the Director of the Community
Services Department of the City of Anaheim.
13.04.010 PARKS AND RECREATION COMMISSION; MEMBERSHIP
AND TERMS.
.010 A Parks and Recreation Commission consisting of seven members hereby
exists in the City of Anaheim pursuant to Section 907 of the Charter of the City of
Anaheim.
.020 The City Council may appoint up to seven ex officio, non-voting members,
each of whom shall be a member of the board of trustees of a separate public school
district serving the City of Anaheim. Ex officio members, if any, shall serve for a term
of four years from the date of appointment.
13.04.020 COMMISSION PROCEDURES; MEETINGS; QUORUM.
.010 The Commission may adopt rules and regulations to govern the conduct of its
meetings, subject to the approval thereof by the City Council, and shall, by vote, set a
time for regular meetings, which shall be held at least once each month.
.020 A majority of total number of members of the Commission then in office shall
constitute a quorum.
13.04.030 DUTIES OF COMMISSION.
The duties of the Parks and Recreation Commission shall be as follows:
.010 Act in an advisory capacity to the City Council and the Director in all matters
pertaining to parks and recreation, and to cooperate with other governmental agencies
and civic groups in the advancement of sound park and recreation planning and
programming.
.020 Recommend policies on recreation service for approval by the City Council.
.030 Advise the Director on problems of development of recreation areas,
facilities, programs and improved recreation services.
.040 Recommend the adoption of standards on areas, facilities, programs and
financial support.
.050 Have periodic inventories made of recreation services that exist or may be
needed, and make recommendations concerning such services to the City Council and
to the Director.
.060 Aid in coordinating the recreation service with the programs of other
governmental agencies and voluntary organizations.
.070 Review the effectiveness of the park and recreation programs with the
Director and City Manager.
.080 Interpret the policies and functions of the Community Services Department to
the public.
.090 Review the annual budget of the Community Services Department before
presentation to the City Manager and City Council, and advise the Director on the
development of the Recreation Element of the General Plan, strategic planning efforts
and any other long-range planning efforts designed to address the service needs of the
public.
SECTION 4.
The City Clerk shall certify to the passage of this ordinance and shall cause the same
to be printed once within. fifteen (15) days after its adoption in the Anaheim Bulletin,
a newspaper of general circulation, published and circulated in the City of Anaheim,
and thirty (30) days from and after its final passage, it shall take effect and be in full
force.
SECTION 5.
The City Council of the City of Anaheim hereby declares that should any section,
paragraph, sentence or word of this ordinance of the Code, hereby adopted, be
declared for any reason to be invalid, it is the intent of the Council that it would have
passed all other portions of this ordinance independent of the elimination herefrom of
any such portion as may be declared invalid.
